CCLA Demands Immediate Repeal of Regulations Limiting Abortion Access in NB

CCLA DEMANDS IMMEDIATE REPEAL OF REGULATIONS LIMITING ABORTION ACCESS IN NB

July 27, 2022

TORONTO — In the wake of the US Supreme Court’s decision overturning Roe v. Wade, the CCLA has once again called on the government of New Brunswick to repeal a regulation which limits access to abortion in the province. In their sent a letter to the Premier, Executive Director and General Counsel Noa Mendelsohn Aviv and Fundamental Freedoms Program Director Cara Zwibel urge the repeal of the Regulation that is currently the subject of a challenge before the New Brunswick court. The letter notes the current crisis in healthcare in New Brunswick, telling the Premier:

“As your government looks to take action to improve the system, it is incumbent on you to take all measures necessary to improve access to care, alleviate the pressure on hospitals, and act consistently with constitutional rights […] to help improve access to care and relieve pressure on overstretched hospitals, the Regulation should be immediately repealed.”

They continued:

“the Regulation is a particularly egregious and unconstitutional barrier that arbitrarily limits access to necessary healthcare. It is contrary to the Canada Health Act and violates the Canadian Charter of Rights and Freedoms”

L’ACLC demande l’abrogation immédiate des mesures limitant l’accès à l’avortement au N-B

Toronto, le 27 juillet 2022 — Dans la foulée de la décision de la Cour suprême des États-Unis qui a invalidé l’arrêt Roe v. Wade, l’ACLC a une fois de plus demandé au gouvernement du Nouveau-Brunswick d’abroger un règlement qui limite l’accès à l’avortement dans la province. Dans leur lettre au premier ministre, la directrice générale et avocate générale Noa Mendelsohn Aviv et la directrice du programme des libertés fondamentales Cara Zwibel demandent instamment l’abrogation du règlement qui fait actuellement l’objet d’une contestation devant le tribunal du Nouveau-Brunswick. La lettre fait état de la crise actuelle dans le domaine des soins de santé au Nouveau-Brunswick et dit au premier ministre :

« Alors que votre gouvernement s’emploie à améliorer le réseau, il vous incombe de prendre toutes les mesures nécessaires. Pour améliorer l’accès aux soins, […] agir en conformité avec les droits constitutionnels […],et soulager la pression sur les hôpitaux débordés, le Règlement devrait être abrogé immédiatement. »

Elles soulignent par ailleurs que:

« […] le Règlement constitue un obstacle particulièrement flagrant et inconstitutionnel qui restreint arbitrairement l’accès à des soins de santé nécessaires. Il est contraire à la Loi canadienne sur la santé et enfreint la Charte canadienne des droits et libertés. »
