TORONTO — Pro bono lawyers representing CCLA are in court today challenging the Government of New Brunswick’s withholding of documents that explain why the Minister of Education and Early Childhood Development made changes to a provincial policy on gender identity that harms transgender and gender diverse students.
The CCLA will argue there is no public interest in secrecy of the government’s reasons for these changes and that properly resolving the human rights and constitutional rights engaged by the Minster’s decisions requires transparency.
The Government of New Brunswick is also asking the Court to separate the CCLA’s case into two parts. CCLA opposes this request because it is inefficient and will delay addressing the harms to vulnerable transgender and gender diverse students whose rights have been infringed.
