TORONTO \u2014 Harini Sivalingam, directrice de l\u2019\u00e9galit\u00e9 \u00e0 l\u2019Association canadienne des libert\u00e9s civiles, a fait la d\u00e9claration suivante :<\/p>\n

L'Association canadienne des libert\u00e9s civiles salue la d\u00e9cision de la Cour europ\u00e9enne des droits de l'homme qui confirme et prot\u00e8ge les droits des personnes transgenres et de leurs enfants \u00e0 une vie de famille. La Cour a d\u00e9termin\u00e9 que la r\u00e9siliation de l'accord de placement d'un parent en raison de son identit\u00e9 transgenre viole les droits \u00e0 la vie priv\u00e9e et familiale.<\/p>\n

Le CCLA, en tant que membre du R\u00e9seau international des organisations de d\u00e9fense des libert\u00e9s civiles (INCLO), a particip\u00e9 \u00e0 cette contestation judiciaire en soumettant des observations \u00e0 l'examen des tribunaux.<\/p>\n

L\u2019affaire concernait un homme transgenre russe dont les deux enfants plac\u00e9s en famille d\u2019accueil avaient \u00e9t\u00e9 retir\u00e9s de son foyer en raison de son identit\u00e9 de genre et de sa transition.<\/p>\n

Bien que cette d\u00e9cision renforce la protection des droits de la famille, la Cour europ\u00e9enne des droits de l\u2019homme a manqu\u00e9 une occasion de consolider davantage les droits \u00e0 l\u2019\u00e9galit\u00e9 des personnes transgenres en ne prenant pas en compte la revendication de non-discrimination qui est au c\u0153ur de cette affaire.<\/p>\n

Ce jugement est une d\u00e9cision bienvenue et constituera un outil important de plaidoyer pour consolider les droits familiaux des personnes trans au sein des \u00c9tats membres du Conseil de l\u2019Europe.<\/p>\n
