TORONTO \u2014 Ana\u00efs Bussi\u00e8res McNicoll, directrice des libert\u00e9s fondamentales \u00e0 l\u2019Association canadienne des libert\u00e9s civiles, a fait la d\u00e9claration suivante :<\/p>\n

Malgr\u00e9 la constatation qu'il n'y avait aucune preuve de violence dans le campement \u00e9tudiant de protestation situ\u00e9 sur le campus de l'Universit\u00e9 de Toronto, la Cour sup\u00e9rieure de justice de l'Ontario a ordonn\u00e9 le d\u00e9mant\u00e8lement de ce campement. Cette partie de la d\u00e9cision est d\u00e9cevante. Il est regrettable que la Cour ait statu\u00e9 que la libert\u00e9 d'expression et le droit de manifester ne permettent pas aux manifestants de camper, d'\u00e9riger des structures et de manifester sur le campus universitaire pendant la nuit. Cette conclusion porte atteinte \u00e0 un aspect important de la manifestation, \u00e0 savoir sa nature perturbatrice.<\/p>\n

Cela \u00e9tant dit, la CCLA est heureuse que la Cour ait reconnu l\u2019importance de\u00a0chartes\u00a0<\/em>La Cour a \u00e9galement donn\u00e9 un sens concret \u00e0 ces valeurs en reconnaissant que les manifestants pouvaient continuer \u00e0 manifester sur le campus de l'Universit\u00e9 de Toronto pendant la journ\u00e9e.<\/p>\n

La CCLA est intervenue dans cette affaire en tant qu'ami de la Cour, non pas pour approuver ou condamner la manifestation en cause, mais pour faire valoir que\u00a0chartes\u00a0<\/em>La protection s'\u00e9tend \u00e0 ceux qui s'expriment sur le campus d'une universit\u00e9 financ\u00e9e et r\u00e9glement\u00e9e par des fonds publics. Comme l'a fait valoir l'ACLC dans son m\u00e9moire, l'enseignement sup\u00e9rieur\u00a0d\u00e9pend<\/em>\u00a0sur la libert\u00e9 de pens\u00e9e et d'expression. La nature quasi publique des campus universitaires en fait \u00e9galement des lieux\u00a0destin\u00e9\u00a0<\/em>de favoriser le libre \u00e9change d'id\u00e9es et les d\u00e9bats sur les questions politiques, sociales et \u00e9ducatives. L'ACLC a donc fait valoir que, pour \u00e9valuer si le crit\u00e8re de mesure injonctive a \u00e9t\u00e9 respect\u00e9 par l'Universit\u00e9, la Cour ne devrait pas seulement appliquer\u00a0chartes\u00a0<\/em>droits et valeurs, mais il faut aussi leur accorder une grande importance.<\/p>\n
