Cela signifie que les fruits d&#039;une perquisition ne peuvent servir \u00e0 justifier une atteinte d\u00e9raisonnable \u00e0 la vie priv\u00e9e. Cet argument \u00e9tait au c\u0153ur de l&#039;intervention de l&#039;ACLC devant la Cour supr\u00eame du Canada (CSC) dans <\/span><em>Conseil scolaire du district de la r\u00e9gion de York c. F\u00e9d\u00e9ration des enseignantes et des enseignants de l&#039;\u00e9l\u00e9mentaire de l&#039;Ontario<\/em><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Plus t\u00f4t dans la journ\u00e9e, la CSC a confirm\u00e9 que les enseignants des conseils scolaires publics de l&#039;Ontario sont prot\u00e9g\u00e9s par l&#039;article 8 de la <\/span><em>chartes<\/em> <span data-contrast=\"auto\">sur le lieu de travail. La d\u00e9cision majoritaire a \u00e9galement statu\u00e9 que l&#039;\u00e9valuation de l&#039;existence d&#039;une attente raisonnable de respect de la vie priv\u00e9e au moment de la perquisition devait \u00eatre neutre quant au contenu. La d\u00e9cision minoritaire a d\u00e9velopp\u00e9 cette conclusion, expliquant que l&#039;\u00e9valuation de l&#039;attente raisonnable de respect de la vie priv\u00e9e des enseignants ne d\u00e9pendait pas de ce qui \u00e9tait <\/span><em>r\u00e9ellement<\/em><span data-contrast=\"auto\"> trouv\u00e9. Ce qui comptait, c&#039;\u00e9tait le <\/span><em>potentiel<\/em><span data-contrast=\"auto\"> que la perquisition r\u00e9v\u00e8le des renseignements touchant les renseignements biographiques essentiels des enseignants. Cela concorde avec les observations formul\u00e9es par l&#039;ACLC en tant qu&#039;intervenante dans cette affaire. S&#039;il en \u00e9tait autrement, les acteurs gouvernementaux comme les conseils scolaires seraient encourag\u00e9s \u00e0 lire un journal ou une conversation avant de se demander ce qu&#039;ils doivent faire pour respecter les droits \u00e0 la vie priv\u00e9e de leurs employ\u00e9s.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">La d\u00e9cision minoritaire a \u00e9galement fait \u00e9cho aux observations de l&#039;ACLC sur la n\u00e9cessit\u00e9 d&#039;adopter une approche large et flexible de ce qui constitue une communication priv\u00e9e pour suivre l&#039;\u00e9volution technologique et les nouvelles formes de communication. La d\u00e9cision minoritaire a statu\u00e9 que les informations contenues sur les appareils connect\u00e9s \u00e0 Internet tendent normativement \u00e0 r\u00e9v\u00e9ler les int\u00e9r\u00eats, les go\u00fbts et les propensions sp\u00e9cifiques d&#039;une personne et qu&#039;elles sont donc au c\u0153ur m\u00eame du noyau biographique prot\u00e9g\u00e9 par l&#039;article 8. La majorit\u00e9 n&#039;a pas abord\u00e9 cette question directement.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Cet appel fait suite \u00e0 une d\u00e9cision de la Cour d&#039;appel de l&#039;Ontario qui a statu\u00e9 qu&#039;un directeur du York Region District School Board (le Conseil) avait effectu\u00e9 une perquisition et une saisie ill\u00e9gales de l&#039;ordinateur portable d&#039;un enseignant lorsqu&#039;il avait consult\u00e9, lu et captur\u00e9 des captures d&#039;\u00e9cran des communications priv\u00e9es de deux enseignants. Les captures d&#039;\u00e9cran de ces communications enregistr\u00e9es dans leur journal personnel prot\u00e9g\u00e9 par un mot de passe stock\u00e9 dans le Cloud ont \u00e9t\u00e9 utilis\u00e9es dans le cadre de proc\u00e9dures disciplinaires contre les deux enseignants. Le syndicat a d\u00e9pos\u00e9 un grief pour violation du droit \u00e0 la vie priv\u00e9e des enseignants par le Conseil.
