CCLA has been granted leave to intervene in the <\/span>Mathur v His Majesty the King in Right of Ontario<\/em> before the Ontario Court of Appeal. <\/span>Mathur<\/em> is a <\/span>Charter<\/em> challenge to the Ontario government\u2019s primary legislative response to climate change, which was brought in under the <\/span>Cap and Trade Cancellation Act, 2018<\/em>,<\/em> S.O. 2018, c. 13<\/span>. The case is the first in Ontario to receive a full hearing on the merits of the government\u2019s responsibilities to address the threat of climate change.<\/span>\u00a0<\/span><\/p>\n

The Appellants, a group of young persons (and their guardians), argued that climate change poses \u201cdangerous and existential risks to the life and well-being of Ontarians and the world\u201d and that the government\u2019s revised emissions target \u201ceffectively authorizes an overall amount of [Greenhouse Gas Emissions] that, in turn, will lead to section 7 deprivations.\u201d The judge at first instance found that although the issues in the application were justiciable, the appellants had not established any violation of <\/span>Charter<\/em> sections 7 or 15.\u00a0<\/span>\u00a0<\/span><\/p>\n

CCLA\u2019s intervention will focus on the rights of individuals under section 7 of the <\/span>Charter<\/em>.<\/span>\u00a0<\/span><\/p>\n
