Tel est le message adress\u00e9 aux d\u00e9put\u00e9s par diverses organisations de la soci\u00e9t\u00e9 civile canadienne qui publient aujourd\u2019hui leurs <a href=\"https:\/\/drive.google.com\/file\/d\/1pQn4-us3wf7qOIm2gI5scLQPGTaumkiO\/view\">recommandations d\u00e9taill\u00e9es<\/a> touchant les amendements \u00e0 apporter, selon elles, \u00e0 la l\u00e9gislation controvers\u00e9e sur la cybers\u00e9curit\u00e9 envisag\u00e9e par le gouvernement f\u00e9d\u00e9ral \u2013 le <a href=\"https:\/\/www.parl.ca\/LegisInfo\/fr\/projet-de-loi\/44-1\/c-26\">projet de loi C-26<\/a>.<\/p>\n<p>L\u2019automne dernier, ces m\u00eames organisations ont publi\u00e9 une <a href=\"https:\/\/drive.google.com\/file\/d\/12KiMUx3zj-i5kUn5G37GfeUWesvILzkW\/view\">lettre conjointe<\/a> qui pr\u00e9cisait que le projet de loi C-26 \u00ab est extr\u00eamement probl\u00e9matique et doit \u00eatre modifi\u00e9 \u00bb tout en soulignant les pr\u00e9occupations qu\u2019il soul\u00e8ve en mati\u00e8re de protection de la vie priv\u00e9e, de gouvernance responsable et d\u2019impartialit\u00e9 de la justice. Les amendements figurant dans la proposition publi\u00e9e aujourd\u2019hui visent \u00e0 r\u00e9pondre \u00e0 ces pr\u00e9occupations tout en renfor\u00e7ant l\u2019arsenal canadien en mati\u00e8re de cybers\u00e9curit\u00e9, ce qui est plus que n\u00e9cessaire.<\/p>\n<p>L\u2019examen en seconde lecture du projet de loi C-26 \u00e0 la Chambre des communes a r\u00e9cemment donn\u00e9 lieu \u00e0 un <a href=\"https:\/\/www.parl.ca\/LegisInfo\/en\/bill\/44-1\/C-26?view=details#bill-profile-tabs\">d\u00e9bat<\/a> muscl\u00e9, lors duquel les d\u00e9put\u00e9s de l\u2019ensemble de l\u2019\u00e9chiquier politique se sont dits pr\u00e9occup\u00e9s par les cons\u00e9quences du projet de loi en question sur les libert\u00e9s civiles. Le projet de loi C-26 fait actuellement l\u2019objet d\u2019un examen approfondi par le Comit\u00e9 permanent de la s\u00e9curit\u00e9 publique et nationale.<\/p>\n<p>\u00ab Nous tenons \u00e0 faire part de nos pr\u00e9occupations, qui rejoignent celles exprim\u00e9es par l\u2019ensemble de l\u2019\u00e9chiquier politique lors de l\u2019examen du projet de loi C-26 en seconde lecture \u00bb, peut-on lire dans l\u2019introduction du document du groupe d\u2019organisations pr\u00e9cit\u00e9, consacr\u00e9 aux amendements sugg\u00e9r\u00e9s par ce dernier. Le document en question pr\u00e9cise que ces amendements \u00ab visent \u00e0 faire en sorte que le projet de loi C-26 assure la cybers\u00e9curit\u00e9 de tous les Canadiens tout en garantissant l\u2019imputabilit\u00e9 et la pr\u00e9servation des droits civiques \u00bb.<\/p>\n<p>Un grand nombre des amendements recommand\u00e9s refl\u00e8tent les conclusions du rapport d\u2019expert de M. Christopher Parsons, <a href=\"https:\/\/citizenlab.ca\/wp-content\/uploads\/2022\/10\/Report158-critical-analysis-telecom-act.pdf\">La cybers\u00e9curit\u00e9 ne prosp\u00e9rera pas dans l\u2019obscurit\u00e9<\/a>publi\u00e9 en octobre 2022 par le Citizen Lab de l\u2019Universit\u00e9 de Toronto. Ces amendements visent \u00e0 pr\u00e9server les libert\u00e9s civiles en :<\/p>\n<ol>\n<li aria-level=\"1\">restreignant les pouvoirs du ministre;<\/li>\n<li aria-level=\"1\">assurant la protection des renseignements personnels et commerciaux confidentiels;<\/li>\n<li aria-level=\"1\">maximisant la transparence;<\/li>\n<li aria-level=\"1\">permettant \u00e0 des avocats sp\u00e9ciaux de d\u00e9fendre l\u2019int\u00e9r\u00eat public;<\/li>\n<li aria-level=\"1\">renfor\u00e7ant l\u2019imputabilit\u00e9 du Centre de la s\u00e9curit\u00e9 des t\u00e9l\u00e9communications.<\/li>\n<\/ol>\n<p>La <a href=\"https:\/\/drive.google.com\/file\/d\/1pQn4-us3wf7qOIm2gI5scLQPGTaumkiO\/view\">proposition d\u2019amendements<\/a> ci-jointe a \u00e9t\u00e9 approuv\u00e9e par l\u2019Association canadienne des libert\u00e9s civiles, la Fondation canadienne de la Constitution, la Coalition pour la surveillance internationale des libert\u00e9s civiles, la Ligue des droits et libert\u00e9s, le Conseil national des musulmans canadiens, OpenMedia, le Conseil du Canada de l\u2019acc\u00e8s et la vie priv\u00e9e, ainsi que Professeur Andrew Clement et Mme Brenda McPhail.<\/p>\n<p>-30-<\/p>\n<p><strong>Communications avec les m\u00e9dias :<\/strong><\/p>\n<p>Rosa Addario, Responsable des communications, OpenMedia<\/p>\n<p><a href=\"mailto:press@openmedia.org\">presse@openmedia.org<\/a><\/p>\n<p>1.888.441.2640 poste. 0<\/p>\n<p>Alex Nanoff, Relations avec les m\u00e9dias, ACLC<br \/>\n<a href=\"mailto:media@ccla.org\">media@ccla.org<\/a><br \/>\n613.709.6318<\/p>\n<p><strong>Citations de repr\u00e9sentants des organisations de d\u00e9fense des libert\u00e9s civiles<\/strong><\/p>\n<p>\u00ab Il est essentiel que le Parlement parvienne \u00e0 un juste \u00e9quilibre entre les imp\u00e9ratifs de s\u00e9curit\u00e9 et le respect des droits constitutionnels bien \u00e9tablis \u00e0 la libert\u00e9 et \u00e0 la protection de la vie priv\u00e9e. Cette l\u00e9gislation est n\u00e9cessaire au renforcement de la s\u00e9curit\u00e9 du pays, mais un meilleur \u00e9quilibre s\u2019impose pour prot\u00e9ger les droits constitutionnels des Canadiens. Les recommandations que nous formulons en coop\u00e9ration avec d\u2019autres organisations de d\u00e9fense des libert\u00e9s civiles peuvent favoriser l\u2019atteinte de cet \u00e9quilibre. \u00bb \u2013 <strong>Stephen Brun<\/strong>, pr\u00e9sident, Conseil national des musulmans canadiens<\/p>\n<p>\u00ab Tel qu'il est r\u00e9dig\u00e9, le projet de loi C-26 met en danger la vie priv\u00e9e et les informations personnelles de tous les Canadiens. Personne ne devrait avoir \u00e0 sacrifier ses droits fondamentaux pour obtenir les protections que nous m\u00e9ritons tous en mati\u00e8re de cybers\u00e9curit\u00e9. Ces recommandations montrent que nous pouvons renforcer la cybers\u00e9curit\u00e9 tout en pr\u00e9servant les droits et les libert\u00e9s qui nous sont chers. Il qualifie les secrets commerciaux d\u2019information confidentielle ne pouvant \u00eatre partag\u00e9e avec d\u2019autres \u00c9tats, mais sans qualifier de la sorte les renseignements personnels des Canadiens.
