Ils sont dirig\u00e9s par et repr\u00e9sentent les individus et les communaut\u00e9s les plus touch\u00e9s par l&#039;ASFC et la GRC, notamment les Autochtones, les Noirs et d&#039;autres personnes racialis\u00e9es. Nous poss\u00e9dons des d\u00e9cennies d&#039;expertise dans les domaines du droit de l&#039;immigration et des r\u00e9fugi\u00e9s, du droit p\u00e9nal, des droits de la personne, du droit international, des libert\u00e9s civiles et de la s\u00e9curit\u00e9 nationale, pour n&#039;en nommer que quelques-uns.<\/p>\n<p>L'expertise collective de nos groupes peut aider le gouvernement f\u00e9d\u00e9ral \u00e0 remplir le mandat de ce projet de loi, exprim\u00e9 par le ministre de la S\u00e9curit\u00e9 publique en novembre 2022, \u00e0 savoir : renforcer la responsabilisation ind\u00e9pendante et combattre le racisme et la discrimination syst\u00e9miques. Malgr\u00e9 son objectif d\u00e9clar\u00e9 de favoriser la responsabilisation, le gouvernement l'esquive en ne consultant pas correctement les communaut\u00e9s que nous repr\u00e9sentons et en ne les incluant pas dans le processus d\u00e9mocratique d'\u00e9laboration des lois.<\/p>\n<p>Le projet de loi C-20 pr\u00e9sente de nombreuses lacunes. Les aspects qui doivent \u00eatre abord\u00e9s comprennent :<\/p>\n<ul>\n<li>la n\u00e9cessit\u00e9 de garantir l'ind\u00e9pendance des activit\u00e9s de la Commission;<\/li>\n<li>l'acc\u00e8s ind\u00e9pendant de la Commission \u00e0 l'information;<\/li>\n<li>la n\u00e9cessit\u00e9 de garantir l'existence d'un m\u00e9canisme de plaintes sur les questions syst\u00e9miques;<\/li>\n<li>les plaintes de tiers; et<\/li>\n<li>l'\u00e9largissement des pouvoirs de r\u00e9paration et de recours de la Commission.<\/li>\n<\/ul>\n<p>En annexe de cette d\u00e9claration se trouve un r\u00e9sum\u00e9 des principales recommandations de nos m\u00e9moires soumis au Comit\u00e9 permanent de la s\u00e9curit\u00e9 publique et nationale, indiquant comment le projet de loi C-20 peut \u00eatre modifi\u00e9 afin de r\u00e9pondre \u00e0 l'objectif et au mandat qui lui sont assign\u00e9s.<\/p>\n<p>La prise en compte de nos m\u00e9moires et des questions que nous soulevons ne d\u00e9pend pas de nous. Bien que nous ayons bon espoir, il est clair, vu le manque d'engagement sur cette question, que le gouvernement risque de rendre la Commission une coquille vide qui reproduira ou m\u00eame exacerbera les probl\u00e8mes existants de l'ASFC et de la GRC.<\/p>\n<p>Nous demandons instamment au Comit\u00e9 permanent de prendre en consid\u00e9ration les recommandations pr\u00e9sent\u00e9es dans les divers m\u00e9moires pr\u00e9sent\u00e9s par nos groupes et d'int\u00e9grer les amendements que nous proposons. Nous accueillons toute possibilit\u00e9 de nous adresser aux membres du Comit\u00e9 permanent et de r\u00e9pondre \u00e0 leurs questions.<\/p>\n<p>Sign\u00e9s :<\/p>\n<p>Amnistie internationale Canada (anglophone)<br \/>\nAmnistie internationale Canada (francophone)<br \/>\nAssociation des libert\u00e9s civiles de la Colombie-Britannique<br \/>\nAssociation canadienne des libert\u00e9s civiles<br \/>\nConseil canadien pour les r\u00e9fugi\u00e9s<br \/>\nAssociation canadienne des avocats en immigration<br \/>\nAssociation canadienne des avocats musulmans<br \/>\nConseil canadien des affaires publiques musulmanes<br \/>\nCoalition pour la surveillance internationale des libert\u00e9s civiles<\/p>\n<p><strong>Enjeux cl\u00e9s conjoints \u2013 projet de loi C-20<\/strong><\/p>\n<p><strong>1. La Commission devrait \u00eatre ind\u00e9pendante et dot\u00e9e de ressources ad\u00e9quates<\/strong><\/p>\n<p>PRINCIPE : L'efficacit\u00e9 de la Commission est min\u00e9e par la proposition voulante qu'elle rel\u00e8ve du ministre responsable de la GRC et de l'ASFC et qu'elle soit financ\u00e9e par ce dernier.<\/p>\n<p>SUGGESTION : la Commission devrait \u00eatre \u00e9tablie comme un organe du Parlement, et son allocation budg\u00e9taire ne devrait pas \u00eatre li\u00e9e \u00e0 un minist\u00e8re qui supervise directement ou indirectement la GRC et\/ou l'ASFC.<\/p>\n<p><strong>2. Les plaignant.es ne doivent pas \u00eatre limit\u00e9.es aux personnes concern\u00e9es<\/strong><\/p>\n<p>PRINCIPE : Veiller \u00e0 ce que des tiers puissent d\u00e9poser des plaintes et pr\u00e9senter des observations lors des audiences, \u00e0 la lumi\u00e8re des nombreux obstacles au d\u00e9p\u00f4t de plaintes auxquels sont confront\u00e9es les personnes vuln\u00e9rables marginalis\u00e9es, en particulier les personnes sans statut, y compris celles qui sont en processus de d\u00e9portation.<\/p>\n<p>SUGGESTION : les articles 33(1) et 33(2) devraient \u00eatre modifi\u00e9s pour reconna\u00eetre sp\u00e9cifiquement le droit des tiers de d\u00e9poser une plainte : \u00ab Tout particulier ou tiers peut\u2026<\/p>\n<p>SUGGESTION : supprimer les alin\u00e9as 38(1)(b) et 52(1)(b).<\/p>\n<p><strong>3. Les plaintes ne doivent pas se limiter \u00e0 des circonstances individuelles<\/strong><\/p>\n<p>PRINCIPE : Pr\u00e9voir des plaintes syst\u00e9miques et politiques, sans d\u00e9signer les personnes concern\u00e9es, pour traiter les comportements r\u00e9p\u00e9t\u00e9s\/r\u00e9pandus ou les politiques et op\u00e9rations probl\u00e9matiques.<\/p>\n<p>SUGGESTION : ajouter les articles 33.1(1) et 33.1(2) pour refl\u00e9ter le libell\u00e9 des articles 33(1) et 33(2) mais autoriser sp\u00e9cifiquement tout individu ou tiers \u00e0 d\u00e9poser une plainte syst\u00e9mique.<\/p>\n<p>SUGGESTION : supprimer la r\u00e9f\u00e9rence \u00e0 \u00ab futile \u00bb dans les articles 38(1)(a) et 52(1)(a).<\/p>\n<p><strong>4. Manque de clart\u00e9 sur qui doit \u00e9valuer la pertinence et la n\u00e9cessit\u00e9 des informations \u00e0 divulguer pour une enqu\u00eate, et manque de m\u00e9canismes d'examen pour les litiges qui en d\u00e9coulent.<\/strong><\/p>\n<p>PRINCIPE : Veiller \u00e0 ce que les informations pertinentes soient enregistr\u00e9es et stock\u00e9es, et puissent \u00eatre consult\u00e9es de mani\u00e8re ind\u00e9pendante par la Commission, afin que les plaintes puissent faire l'objet d'une enqu\u00eate approfondie.<\/p>\n<p>SUGGESTION : fournir un m\u00e9canisme pour trancher les litiges portant sur des informations \u00ab pertinentes et n\u00e9cessaires \u00bb.<\/p>\n<p><strong>5. La Commission devrait enqu\u00eater sur les plaintes plut\u00f4t que la GRC et l'ASFC<\/strong><\/p>\n<p>PRINCIPE : \u00c9tant donn\u00e9 le racisme syst\u00e9mique qui a \u00e9t\u00e9 reconnu comme un fl\u00e9au \u00e0 la fois au sein de la GRC et de l'ASFC, le fait de les laisser enqu\u00eater elles-m\u00eames conduit \u00e0 une appr\u00e9hension de biais \u00e0 la source et peut exacerber les probl\u00e8mes existants.<\/p>\n<p>SUGGESTION : la Commission devrait avoir comp\u00e9tence unique\/exclusive pour enqu\u00eater sur les plaintes.<\/p>\n<p><strong>6. \u00c0 titre subsidiaire, la n\u00e9cessit\u00e9 d'enqu\u00eater efficacement sur les plaintes en temps opportun<\/strong><\/p>\n<p>PRINCIPE : La surveillance exerc\u00e9e par la Commission ne doit pas perdre son sens en raison de longs retards dans l'enqu\u00eate initiale des plaintes par l'ASFC et la GRC.<\/p>\n<p>SUGGESTION : \u00e9tablir des d\u00e9lais stricts pour que l'ASFC\/la GRC accuse r\u00e9ception, enqu\u00eate et fasse rapport sur les plaintes.<\/p>\n<p><strong>7. Le besoin de coordination, recours pendant une enqu\u00eate et r\u00e9paration en cas de plainte justifi\u00e9e<\/strong><\/p>\n<p>PRINCIPE : Assurer la coordination entre la Commission et les autres organes de plainte et de r\u00e9vision, en particulier dans le traitement des pr\u00e9occupations li\u00e9es \u00e0 la s\u00e9curit\u00e9 nationale, afin que les plaintes soient r\u00e9solues efficacement et ne soient pas rejet\u00e9es en raison de la simple existence d'un autre m\u00e9canisme\/proc\u00e9dure de contr\u00f4le, en particulier lorsque l\u2019autre organisme refuse d'enqu\u00eater.<\/p>\n<p>PRINCIPE : La Commission devrait \u00eatre dot\u00e9e des pouvoirs n\u00e9cessaires pour r\u00e9pondre aux besoins provisoires au cours d'une enqu\u00eate et pour obtenir r\u00e9paration en cas de plainte justifi\u00e9e.<\/p>\n<p>SUGGESTION : La Commission devrait \u00eatre dot\u00e9e des pouvoirs suivants :<\/p>\n<ul>\n<li>Faire des recommandations ex\u00e9cutoires sur les ordonnances provisoires telles que la suspension de l&#039;expulsion\u00a0;<\/li>\n<li>Faire des recommandations ex\u00e9cutoires pour initier ou imposer des mesures disciplinaires ou pour porter des accusations en cas de non-respect de sa loi habilitante.<\/li>\n<\/ul>\n<p><strong>8.
