L'ACLC intervient devant la Cour supr\u00eame du Canada dans une affaire qui examinera la port\u00e9e de la Charte <\/em>protection de la libert\u00e9 d'association. Dans Soci\u00e9t\u00e9 des casinos du Qu\u00e9bec <\/em>la Cour supr\u00eame est appel\u00e9e \u00e0 examiner une disposition du Code du travail du Qu\u00e9bec qui exclut les cadres de la d\u00e9finition de \u00ab salari\u00e9 \u00bb et \u00e0 d\u00e9cider si cette exclusion viole la protection de la libert\u00e9 d'association des Chartes qu\u00e9b\u00e9coise et canadienne.<\/p>\n

L'ACLC est intervenue pour pr\u00e9senter des observations juridiques sur la mani\u00e8re dont la libert\u00e9 d'association peut \u00eatre prot\u00e9g\u00e9e de mani\u00e8re significative et soutient que la Cour devrait tenir compte de l'objet et de l'effet de la l\u00e9gislation pertinente. Le Les soumissions de l'ACLC<\/a> soulignent que les tribunaux reconnaissent depuis longtemps la vuln\u00e9rabilit\u00e9 inh\u00e9rente des employ\u00e9s qui les emp\u00eache de n\u00e9gocier avec leurs employeurs sur un pied d'\u00e9galit\u00e9 et qui affecte presque tous les aspects de la relation d'emploi. Alors que les arguments des employeurs dans l'affaire sugg\u00e8rent que les managers recherchent une sorte de droit positif ou de soutien de l'\u00c9tat pour exercer leur libert\u00e9 d'association, cela ignore le r\u00f4le de l'\u00c9tat dans la conception des conditions qui interf\u00e8rent avec l'exercice significatif de cette libert\u00e9. L'ACLC soutient que l'accent devrait \u00eatre mis sur ce que doivent \u00eatre les droits et les devoirs dans la relation de travail afin de respecter les garanties minimales \u00e9nonc\u00e9es \u00e0 l'article 2(d) de la Charte, <\/em>prot\u00e9ger la libert\u00e9 d'association.<\/p>\n

L'audience dans cette affaire aura lieu devant la Cour supr\u00eame le 20 avril 2023.
