L&#039;ACLC a pr\u00e9sent\u00e9 cet argument dans des m\u00e9moires \u00e0 la r\u00e9cente \u00e9tude sur la technologie de reconnaissance faciale (FRT) par le Comit\u00e9 permanent de l&#039;acc\u00e8s \u00e0 l&#039;information, de la protection des renseignements personnels et de l&#039;\u00e9thique (ETHI). Nous sommes tout \u00e0 fait d&#039;accord avec les conclusions du Comit\u00e9 dans son rapport publi\u00e9 le 4 octobre 2022 :<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">L&#039;\u00e9tude du Comit\u00e9 a confirm\u00e9 que le cadre l\u00e9gislatif actuel du Canada ne r\u00e9glemente pas ad\u00e9quatement le TRF et l&#039;IA. Sans un cadre appropri\u00e9, le FRT et d&#039;autres outils d&#039;IA pourraient causer un pr\u00e9judice irr\u00e9parable \u00e0 certaines personnes.<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Le Comit\u00e9 est donc d&#039;avis que, lorsque le TRF ou d&#039;autres technologies d&#039;IA sont utilis\u00e9es, elles doivent l&#039;\u00eatre de mani\u00e8re responsable, dans un cadre l\u00e9gislatif solide qui prot\u00e8ge les droits \u00e0 la vie priv\u00e9e et les libert\u00e9s civiles des Canadiens. Puisqu&#039;un tel cadre l\u00e9gislatif n&#039;existe pas \u00e0 l&#039;\u00e9poque, une pause nationale devrait \u00eatre impos\u00e9e \u00e0 l&#039;utilisation du TRF, notamment en ce qui concerne les services de police.<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Le Comit\u00e9 formule 19 recommandations g\u00e9n\u00e9ralement fortes. Les points saillants comprennent des recommandations interdisant l&#039;obtention d&#039;informations personnelles obtenues ill\u00e9galement et exigeant des rapports publics lorsque le FRT ou d&#039;autres outils algorithmiques, y compris des essais gratuits, sont acquis par des institutions gouvernementales. Ces recommandations aideraient \u00e0 pr\u00e9venir un futur scandale comme celui cr\u00e9\u00e9 lorsque la GRC a secr\u00e8tement utilis\u00e9 le logiciel Clearview AI, d\u00e9termin\u00e9 par la suite par un <\/span><a href=\"https:\/\/www.priv.gc.ca\/en\/opc-news\/news-and-announcements\/2021\/nr-c_210610\/\"><span data-contrast=\"none\">enqu\u00eate conjointe<\/span><\/a><span data-contrast=\"auto\"> des commissaires \u00e0 la protection de la vie priv\u00e9e comme \u00e9tant ill\u00e9gale en vertu de la loi canadienne.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">D&#039;autres recommandations cl\u00e9s sont ax\u00e9es sur la responsabilisation et la transparence, notamment la cr\u00e9ation d&#039;un registre public d&#039;IA des outils utilis\u00e9s par les entit\u00e9s op\u00e9rant au Canada, l&#039;augmentation de l&#039;engagement des intervenants de la soci\u00e9t\u00e9 civile dans les processus d&#039;\u00e9valuation d&#039;impact de l&#039;IA existants et l&#039;\u00e9tablissement de \u00ab\u00a0mesures politiques solides au sein du secteur public pour le l&#039;utilisation de la technologie de reconnaissance faciale qui pourrait&quot; [nous dirions devrait] &quot;inclure un avis public imm\u00e9diat et pr\u00e9alable et des commentaires publics, une consultation avec des groupes marginalis\u00e9s et des m\u00e9canismes de surveillance ind\u00e9pendants&quot;.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Pour faire face aux risques bien connus de pr\u00e9jug\u00e9s et d&#039;impacts discriminatoires des syst\u00e8mes FRT, il existe des recommandations appelant le gouvernement \u00e0 investir dans l&#039;\u00e9tude de l&#039;impact de l&#039;intelligence artificielle sur diff\u00e9rents groupes, et \u00e0 assurer &quot;la divulgation compl\u00e8te et transparente des informations raciales, d&#039;\u00e2ge ou autres&quot;. biais inconscients qui peuvent exister dans la technologie de reconnaissance faciale utilis\u00e9e par le gouvernement, d\u00e8s que le biais est constat\u00e9 dans le cadre de sc\u00e9narios de test ou d&#039;applications en direct de la technologie, sous r\u00e9serve de probl\u00e8mes de s\u00e9curit\u00e9 nationale. Bien s\u00fbr, l&#039;exclusion de la s\u00e9curit\u00e9 nationale est probl\u00e9matique, \u00e9tant donn\u00e9 que les risques de discrimination sont particuli\u00e8rement \u00e9lev\u00e9s dans des contextes tels que la s\u00e9curit\u00e9 des fronti\u00e8res.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Il existe une s\u00e9rie de recommandations surveillance et la confidentialit\u00e9 de la technologie de reconnaissance faciale, y compris des mesures de surveillance proactives.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\n<\/ul>\n<p><span data-contrast=\"auto\">Et enfin, l&#039;une des recommandations les plus importantes concerne la n\u00e9cessit\u00e9 de prot\u00e9ger les photos de personnes, en ligne ou captur\u00e9es dans des espaces publics, contre la r\u00e9cup\u00e9ration non consensuelle pour une utilisation dans les syst\u00e8mes d&#039;IA. La recommandation 17 stipule :<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-contrast=\"auto\">Que le gouvernement du Canada modifie la Loi sur la protection des renseignements personnels et la<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><span data-contrast=\"auto\">Loi sur la protection de l&#039;information et les documents \u00e9lectroniques pour interdire la pratique consistant \u00e0 capturer des images de Canadiens \u00e0 partir d&#039;Internet ou d&#039;espaces publics pour<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><span data-contrast=\"auto\">but de remplir des bases de donn\u00e9es de technologies de reconnaissance faciale ou artificielles<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><span data-contrast=\"auto\">algorithmes de renseignement.<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Le comit\u00e9 ETHI a fait un bon travail de synth\u00e8se et de r\u00e9flexion sur les pr\u00e9occupations des t\u00e9moins qui ont comparu devant eux et a formul\u00e9 des recommandations qui contribueraient grandement \u00e0 prot\u00e9ger les gens partout au Canada contre les utilisations portant atteinte aux droits du FRT et d&#039;autres technologies ax\u00e9es sur l&#039;IA. Il appartient maintenant au gouvernement de reprendre les recommandations. Le rapport arrive \u00e0 point nomm\u00e9, alors que le nouveau projet de loi C-27 sur la protection de la vie priv\u00e9e dans le secteur priv\u00e9 fait son chemin vers le comit\u00e9. Des modifications \u00e0 ce projet de loi pourraient et devraient \u00eatre apport\u00e9es en r\u00e9ponse \u00e0 certaines de ces recommandations, et des r\u00e9formes de la Loi sur la protection des renseignements personnels sont \u00e9galement indiqu\u00e9es. En attendant cette l\u00e9gislation, le moratoire sur les services de police f\u00e9d\u00e9raux et les industries canadiennes sur l&#039;utilisation du FRT recommand\u00e9 par ETHI et soutenu par un large \u00e9ventail de t\u00e9moins, y compris l&#039;ACLC, devrait \u00eatre d\u00e9clench\u00e9 imm\u00e9diatement.
