CCLA DEMANDS IMMEDIATE REPEAL OF REGULATIONS LIMITING ABORTION ACCESS IN NB<\/strong><\/p>\n

July 27, 2022<\/p>\n

TORONTO \u2014\u00a0In the wake of the US Supreme Court\u2019s decision overturning\u00a0Roe v. Wade,\u00a0<\/em>the CCLA has once again called on the government of New Brunswick to repeal a regulation which limits access to abortion in the province. In their\u00a0sent a letter to the Premier, Executive Director and General Counsel Noa Mendelsohn Aviv and Fundamental Freedoms Program Director Cara Zwibel urge the\u00a0repeal of the Regulation that is currently the subject of a challenge before the New Brunswick court. The letter notes the current crisis in healthcare in New Brunswick, telling the Premier:<\/p>\n

“As your government looks to take action to improve the system, it is incumbent on you to take all measures necessary to improve access to care, alleviate the pressure on hospitals, and act consistently with constitutional rights [\u2026] to help improve access to care and relieve pressure on overstretched hospitals, the Regulation should be immediately repealed.”<\/p>\n

They continued:<\/p>\n

\u201cthe Regulation is a particularly egregious and unconstitutional barrier that arbitrarily limits access to necessary healthcare. It is contrary to the\u00a0Canada Health Act\u00a0<\/em>and violates the\u00a0Canadian Charter of Rights and Freedoms\u201d<\/em><\/p>\n

Toronto, le 27\u00a0juillet\u00a02022\u00a0\u2014 Dans la foul\u00e9e de la d\u00e9cision de la Cour supr\u00eame des \u00c9tats-Unis qui a invalid\u00e9 l\u2019arr\u00eat Roe v. Wade, l\u2019ACLC a une fois de plus demand\u00e9 au gouvernement du Nouveau-Brunswick d\u2019abroger un r\u00e8glement qui limite l\u2019acc\u00e8s \u00e0 l\u2019avortement dans la province. Dans leur lettre au premier ministre, la directrice g\u00e9n\u00e9rale et avocate g\u00e9n\u00e9rale Noa Mendelsohn Aviv et la directrice du programme des libert\u00e9s fondamentales Cara Zwibel demandent instamment l\u2019abrogation du r\u00e8glement qui fait actuellement l\u2019objet d\u2019une contestation devant le tribunal du Nouveau-Brunswick. La lettre fait \u00e9tat de la crise actuelle dans le domaine des soins de sant\u00e9 au Nouveau-Brunswick et dit au premier ministre\u00a0:<\/p>\n

\u00ab Alors que votre gouvernement s\u2019emploie \u00e0 am\u00e9liorer le r\u00e9seau, il vous incombe de prendre toutes les mesures n\u00e9cessaires. Pour am\u00e9liorer l\u2019acc\u00e8s aux soins, […]\u00a0agir en conformit\u00e9 avec les droits constitutionnels […],et soulager la pression sur les h\u00f4pitaux d\u00e9bord\u00e9s, le R\u00e8glement devrait \u00eatre abrog\u00e9 imm\u00e9diatement. \u00bb<\/p>\n

Elles soulignent par ailleurs que:<\/p>\n

\u00ab […] le R\u00e8glement constitue un obstacle particuli\u00e8rement flagrant et inconstitutionnel qui restreint arbitrairement l\u2019acc\u00e8s \u00e0 des soins de sant\u00e9 n\u00e9cessaires. Il est contraire \u00e0 la Loi canadienne sur la sant\u00e9 et enfreint la Charte canadienne des droits et libert\u00e9s. \u00bb<\/p>\n
