STATEMENT ON THE RCMP’S USE OF SPYWARE<\/strong><\/p>\n

June 30, 2022<\/p>\n

TORONTO \u2014 Brenda McPhail, Director of Privacy Technology and Surveillance Program for the Canadian Civil Liberties Association, made the following statement:<\/p>\n

The RCMP uses spyware against Canadians in targeted investigations. The revelation was buried in a document tabled in Parliament on June 22, 2022 in response to MP questions regarding uses of surveillance by Canadian agencies, and is the first time a police service in Canada has confirmed using these controversial and invasive tools.<\/p>\n

The Covert Access and Intercept Team (CAIT), we now know, has used \u201con-Device Investigate [sic] Tools\u201d to remotely collect texts, emails, even to turn on microphones or cameras remotely. This happens after obtaining a warrant, and was used in 10 targeted investigations between 2018 and 2020. The Privacy Commissioner of Canada was not consulted.<\/p>\n

That is what we know. What we don\u2019t know is vast. What kinds of investigations are deemed serious enough to use such invasive tools? What tools are being used, and who supplies them? Is it one of the many vendors of spyware known for selling such tools to authoritarian states who use it to target human rights defenders and journalists? What are the internal decision and authorization processes undertaken to authorize this nuclear option for surveillance of Canadians? Why was the Privacy Commissioner not consulted when the invasiveness and controversial nature of such tools on the world stage is explicit and well known?<\/p>\n

The CCLA calls for public transparency on these important questions. We call for open discussion of the appropriateness of the use of such tools, and the kinds of legal safeguards and frameworks needed to ensure accountability for the decision to use these dangerous tools against Canadians.

S\u2019agit-il de l\u2019un des nombreux fournisseurs de logiciels espions dont on sait qu\u2019ils vendent ces outils \u00e0 des \u00c9tats autoritaires qui s\u2019en servent pour cibler les d\u00e9fenseurs des droits de la personne et les journalistes? Quels m\u00e9canismes internes de d\u00e9cision et d\u2019autorisation sont mis en place pour permettre le recours \u00e0 cette \u00ab option nucl\u00e9aire \u00bb pour la surveillance des Canadiennes et des Canadiens? Pourquoi le commissaire \u00e0 la protection de la vie priv\u00e9e n\u2019a-t-il pas \u00e9t\u00e9 consult\u00e9 alors que le caract\u00e8re invasif et controvers\u00e9 de ces outils sur la sc\u00e8ne mondiale est explicite et bien connu?<\/p>\n

L\u2019ACLC demande la transparence publique sur ces questions importantes. Nous r\u00e9clamons une discussion ouverte sur la pertinence de l\u2019utilisation de ces outils, et sur les types de garanties et de cadres juridiques n\u00e9cessaires pour assurer la reddition de comptes \u00e0 l\u2019\u00e9gard de la d\u00e9cision d\u2019utiliser ces outils dangereux \u00e0 l\u2019endroit de la population canadienne.
