Et \u00e0 mesure que les moyens de surveillance se d\u00e9veloppent, la capacit\u00e9 \u00e0 ce qu&#039;elle se produise de mani\u00e8re invisible dans les coulisses des interfaces que nous utilisons quotidiennement s&#039;est \u00e9galement \u00e9largie. Le travail \u00e0 distance, comme de nombreuses personnes l&#039;ont fait pendant la pand\u00e9mie, a intensifi\u00e9 l&#039;int\u00e9r\u00eat du lieu de travail pour un tel suivi et la vuln\u00e9rabilit\u00e9 des personnes \u00e0 celui-ci, car les fronti\u00e8res entre le domicile et le travail sont floues.<\/p>\n<p>Ainsi, l&#039;annonce de l&#039;Ontario, aujourd&#039;hui, que le gouvernement envisage de pr\u00e9senter une nouvelle l\u00e9gislation plus tard ce mois-ci pour \u00ab\u00a0<a href=\"https:\/\/news.ontario.ca\/en\/release\/1001654\/ontario-requiring-employers-to-disclose-electronic-monitoring\" target=\"_blank\" rel=\"noopener\">obliger les employeurs \u00e0 dire \u00e0 leurs travailleurs si et comment ils sont surveill\u00e9s par voie \u00e9lectronique<\/a>\u00bb est le bienvenu. Il y a longtemps qu&#039;il y a une lacune dans la protection des travailleurs dans nos lois sur la protection de la vie priv\u00e9e, et ce sera un petit premier pas pour la combler.<\/p>\n<p>Cependant, bien que l&#039;ajout de telles protections soit une bonne chose, elles doivent \u00eatre authentiques. Tout d&#039;abord, il convient de noter que si les exigences de transparence semblent favorables aux travailleurs, la mani\u00e8re dont elles sont mises en \u0153uvre fera la diff\u00e9rence entre leur utilit\u00e9 ou leur transformation en une case \u00e0 cocher lors d&#039;une orientation des employ\u00e9s. C&#039;est une chose de savoir comment et pourquoi vous \u00eates surveill\u00e9 sur un lieu de travail, mais en l&#039;absence de toute obligation pour les employeurs de limiter leur surveillance \u00e0 ce qui peut \u00eatre justifi\u00e9 de mani\u00e8re significative, cela pourrait finir par \u00eatre un exercice de frustration pour les employ\u00e9s (et de m\u00eame contre-productif pour les employeurs).<\/p>\n<p>Il y a une ligne fine entre le d\u00e9sir et le besoin en mati\u00e8re de collecte de donn\u00e9es. C&#039;est une ligne que nous voyons franchie de diff\u00e9rentes mani\u00e8res tout autour de nous. Sur le lieu de travail, o\u00f9 les employeurs ont le pouvoir d&#039;embaucher et de licencier, et o\u00f9 d\u00e9missionner n&#039;est peut-\u00eatre pas une option pour les employ\u00e9s ayant une famille et des hypoth\u00e8ques, ce d\u00e9s\u00e9quilibre de pouvoir peut \u00eatre \u00e9norme.<\/p>\n<p>Cela signifie que ce que nous avons vraiment besoin de voir, c&#039;est l&#039;ench\u00e2ssement de certaines pratiques exemplaires pour prendre des d\u00e9cisions concernant tout type de surveillance du lieu de travail, telles que\u00a0:<\/p>\n<ul>\n<li>D\u00e9terminez que les m\u00e9thodes moins intrusives ne peuvent pas faire le travail et qu&#039;il existe un probl\u00e8me document\u00e9, sp\u00e9cifique, continu et v\u00e9rifiable.<\/li>\n<li>Engager une consultation des employ\u00e9s sur les mesures et les moyens<\/li>\n<li>\u00c9laborez des politiques et des proc\u00e9dures qui d\u00e9crivent les r\u00f4les et les responsabilit\u00e9s des personnes impliqu\u00e9es dans la collecte d&#039;informations personnelles \u2013 comment les informations seront-elles utilis\u00e9es pour ou contre les travailleurs et qui d\u00e9cide ? Quelles sont les garanties ?<\/li>\n<li>Exiger que les grandes entreprises effectuent des \u00e9valuations d&#039;impact sur la vie priv\u00e9e pour les nouveaux outils afin de s&#039;assurer qu&#039;ils sont con\u00e7us pour minimiser l&#039;impact sur la vie priv\u00e9e et conformes \u00e0 la loi sur la protection de la vie priv\u00e9e<\/li>\n<li>Offrir une formation \u00e0 ceux qui travaillent avec les donn\u00e9es<\/li>\n<li>Documenter la mani\u00e8re dont la s\u00e9curit\u00e9 appropri\u00e9e des donn\u00e9es est assur\u00e9e<\/li>\n<li>Mener des examens et des \u00e9valuations de conformit\u00e9 avec la politique de transparence et les politiques de surveillance plus larges autour de l&#039;utilisation des outils de suivi<\/li>\n<li>Assurer l&#039;acc\u00e8s des employ\u00e9s \u00e0 leurs propres informations personnelles collect\u00e9es par les outils de surveillance<\/li>\n<li>Pr\u00e9voir des audits\/\u00e9valuations r\u00e9guliers<\/li>\n<\/ul>\n<p>L&#039;introduction d&#039;exigences de transparence pour la surveillance du lieu de travail n&#039;est qu&#039;un premier pas vers des protections significatives pour les travailleurs. La deuxi\u00e8me \u00e9tape est la l\u00e9gislation, peut-\u00eatre en <a href=\"https:\/\/www.ontariocanada.com\/registry\/showAttachment.do?postingId=37468&amp;attachmentId=49462\" target=\"_blank\" rel=\"noopener\">La nouvelle loi potentielle sur la protection des renseignements personnels de l&#039;Ontario<\/a>, qui met certaines garanties sur les types de surveillance, dans quelles conditions, est raisonnable du tout et offre un recours aux travailleurs confront\u00e9s \u00e0 des pratiques qu&#039;ils jugent trop invasives. En d&#039;autres termes, les travailleurs n&#039;ont pas seulement besoin de savoir quand ils sont surveill\u00e9s, ils ont besoin d&#039;\u00eatre prot\u00e9g\u00e9s de la surveillance elle-m\u00eame si ou quand elle franchit la fronti\u00e8re entre le besoin l\u00e9gitime de l&#039;employeur et une collecte de donn\u00e9es oppressive de l&#039;employeur.<\/p>\n<p>C&#039;est une mesure l\u00e9gislative \u00e0 surveiller en Ontario au cours des prochaines semaines.
