Abby Deshman, directrice du programme de justice p\u00e9nale \u00e0 l\u2019Association canadienne des libert\u00e9s civiles (ACLC), vient de faire la d\u00e9claration suivante :<\/p>\n

\u00ab\u2009Nous saluons la d\u00e9cision du gouvernement de r\u00e9voquer la proclamation de l\u2019\u00e9tat d\u2019urgence, une d\u00e9cision qui n\u2019a que trop tard\u00e9.<\/p>\n

Rappelons cependant que, d\u00e8s le d\u00e9part, nous avons d\u00e9clar\u00e9 que le gouvernement n\u2019avait pas atteint les seuils l\u00e9gaux requis pour invoquer la Loi sur les mesures d\u2019urgence.<\/p>\n

Nous continuons de penser que son invocation ne reposait pas sur une base juridique suffisante et que les d\u00e9crets \u00e9mis en vertu de la loi \u00e9taient inconstitutionnels.<\/p>\n

Nous continuons \u00e9galement de penser qu\u2019il est important que les tribunaux se prononcent sur le seuil juridique requis pour l\u2019invoquer et sur les enjeux constitutionnels qu\u2019elle pose afin de guider les actions des prochains gouvernements.<\/p>\n

M\u00eame si les d\u00e9crets \u00e9mis r\u00e9cemment ne sont plus en vigueur, la population canadienne se retrouve avec le pr\u00e9c\u00e9dent que les actions gouvernementales ont cr\u00e9\u00e9.<\/p>\n

Dans les jours qui viennent, nous consulterons nos avocats afin de d\u00e9cider des prochaines d\u00e9marches. Mais ce qui est certain, \u00e0 l\u2019heure actuelle, c\u2019est que nous poursuivrons la proc\u00e9dure entam\u00e9e. \u00bb<\/p>\n

L\u2019Association canadienne des libert\u00e9s civiles (ACLC) a demande au gouvernement de r\u00e9voquer sa d\u00e9claration d\u2019urgence publique. Dans une lettre adress\u00e9e au gouvernement,<\/a>, l\u2019ACLC soulignait que si les barrages d\u2019Ottawa \u00e9taient \u00e0 pr\u00e9sent lev\u00e9s, les divers barrages frontaliers avaient \u00e9t\u00e9 lev\u00e9s avant m\u00eame l\u2019invocation des pouvoirs d\u2019urgence et sans que l\u2019on ait eu besoin d\u2019y recourir.<\/p>\n\t<\/div>\n<\/div>\n\n\n\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t
