Le 22 novembre 2021, la Cour sup\u00e9rieure de l'Ontario entendra les arguments dans l'affaire Working Families, qui conteste la constitutionnalit\u00e9 des restrictions impos\u00e9es \u00e0 la publicit\u00e9 \u00e9lectorale de tiers pendant une ann\u00e9e enti\u00e8re avant une \u00e9lection. Les r\u00e8gles contest\u00e9es signifient que les individus et les organisations non affili\u00e9s \u00e0 un parti politique ou \u00e0 un candidat sont limit\u00e9s dans ce qu'ils peuvent dire sur les questions de politique publique. Le gouvernement a prolong\u00e9 la p\u00e9riode pendant laquelle les restrictions s'appliquent dans une tentative int\u00e9ress\u00e9e d'\u00e9touffer les voix de leurs d\u00e9tracteurs.<\/p>\n

Les restrictions avaient d\u00e9j\u00e0 \u00e9t\u00e9 annul\u00e9es en tant que restriction d\u00e9raisonnable \u00e0 la libert\u00e9 d'expression, mais le gouvernement de l'Ontario a r\u00e9\u00e9dict\u00e9 les r\u00e8gles, invoquant la \u00ab clause nonobstant \u00bb qui permet aux lois de s'appliquer m\u00eame si elles violent chartes<\/em>- des droits et libert\u00e9s prot\u00e9g\u00e9s. Dans la nouvelle affaire, les requ\u00e9rants (principalement des syndicats et des individus et groupes qui leur sont affili\u00e9s) soutiennent que les restrictions violent le droit de vote, l'un des rares chartes<\/em>-des droits prot\u00e9g\u00e9s auxquels la clause nonobstant ne peut d\u00e9roger. L'ACLC est intervenue dans cette affaire pour faire valoir que les voix de tiers sont essentielles \u00e0 la capacit\u00e9 des citoyens de participer de mani\u00e8re significative aux \u00e9lections et que la clause nonobstant ne peut pas \u00eatre utilis\u00e9e pour isoler le gouvernement de la responsabilit\u00e9 d\u00e9mocratique.<\/p>\n
