L&#039;ACLC soutient que cette approche ne favorise pas les objectifs de sant\u00e9 publique et peut en fait saper ces objectifs. Nous avons exhort\u00e9 le ministre \u00e0 changer la politique.<\/em><\/p>\n<p>++++++<\/p>\n<p>1er novembre 2021<\/p>\n<p>Honorable Carla Qualtrough<br \/>\nMinistre de l&#039;Emploi, du D\u00e9veloppement de la main-d&#039;\u0153uvre et de l&#039;Inclusion des personnes handicap\u00e9es<br \/>\nChambre des communes<br \/>\nOttawa, ON K1A 0A6<br \/>\ncarla.qualtrough@parl.gc.ca<\/p>\n<p><strong>Livr\u00e9 par e-mail\u00a0<\/strong><\/p>\n<p><strong>OBJET : Refus d&#039;assurance-emploi en fonction du statut vaccinal\u00a0<\/strong><\/p>\n<p>Cher Ministre Qualtrough,<\/p>\n<p>Je vous \u00e9cris au nom de l&#039;Association canadienne des libert\u00e9s civiles (ACLC) concernant les commentaires que vous avez faits dans les m\u00e9dias et les informations sur le site Web de l&#039;assurance-emploi (AE) concernant l&#039;admissibilit\u00e9 \u00e0 l&#039;AE. Comme vous le savez, la position d\u00e9clar\u00e9e est que si une personne est licenci\u00e9e pour ne pas se conformer au mandat de vaccination d&#039;un employeur, la personne ne sera pas consid\u00e9r\u00e9e comme admissible aux avantages sociaux. En effet, un refus de se faire vacciner, ou de divulguer son statut vaccinal \u00e0 un employeur, est assimil\u00e9 \u00e0 une inconduite. \u00c0 notre avis, cette politique est erron\u00e9e, contre-productive et pourrait bien entrer en conflit avec les obligations constitutionnelles et les droits de l&#039;homme du gouvernement. Nous vous exhortons vivement \u00e0 reconsid\u00e9rer cette position.<\/p>\n<p>Les mandats de vaccination en milieu de travail ne sont pas une simple question de sant\u00e9 et s\u00e9curit\u00e9 au travail. Le gouvernement f\u00e9d\u00e9ral, par exemple, exige des employ\u00e9s qui travaillent \u00e0 distance qu&#039;ils fournissent une attestation qu&#039;ils sont vaccin\u00e9s, sous peine de licenciement. L&#039;application de cette politique \u00e0 un employ\u00e9 qui n&#039;interagit pas physiquement avec d&#039;autres employ\u00e9s ne peut pas \u00eatre consid\u00e9r\u00e9e comme requise en raison de probl\u00e8mes de sant\u00e9 et de s\u00e9curit\u00e9 ou li\u00e9s \u00e0 l&#039;emploi. Au contraire, le gouvernement f\u00e9d\u00e9ral lui-m\u00eame semble utiliser son r\u00f4le de plus grand employeur du pays pour encourager ou \u00ab\u00a0encourager\u00a0\u00bb la vaccination. Nous connaissons d&#039;autres employeurs qui exigent \u00e9galement la vaccination des personnes qui n&#039;entrent jamais physiquement dans un lieu de travail communautaire.<\/p>\n<p>Nous acceptons qu&#039;encourager les individus \u00e0 se faire vacciner est un objectif politique valable, mais il ne peut pas \u00eatre poursuivi sans limites. Les personnes qui sont pr\u00eates \u00e0 perdre leur emploi plut\u00f4t que d&#039;accepter le vaccin ont clairement une objection authentique et sinc\u00e8re. Bien qu&#039;il puisse \u00eatre facile d&#039;essayer de rejeter toutes ces personnes et de supposer que leur h\u00e9sitation est fond\u00e9e sur de la d\u00e9sinformation, nous savons que ce n&#039;est pas le cas de toutes les personnes qui refusent le vaccin. Nous connaissons, par exemple, certaines personnes \u00e0 qui leur m\u00e9decin a conseill\u00e9 de ne pas se faire vacciner en raison de probl\u00e8mes de sant\u00e9 personnels complexes. Cependant, de nombreux employeurs, y compris le gouvernement f\u00e9d\u00e9ral, ne semblent pas dispos\u00e9s \u00e0 accepter cela comme une exemption m\u00e9dicale valide. En tant que ministre responsable de l&#039;inclusion des personnes handicap\u00e9es, votre bureau devrait \u00eatre particuli\u00e8rement sensible \u00e0 cette question et aux pr\u00e9occupations de nombreux membres de la communaut\u00e9 des personnes handicap\u00e9es concernant l&#039;approche inflexible adopt\u00e9e en mati\u00e8re d&#039;exemptions m\u00e9dicales.<\/p>\n<p>Il y a un moment o\u00f9 les encouragements et les incitations deviennent une coercition de facto. \u00c0 notre avis, refuser des prestations d&#039;assurance-emploi \u00e0 des personnes qui ont perdu leur emploi plut\u00f4t que de se conformer \u00e0 un mandat de vaccination franchit cette ligne. De plus, \u00e9tant donn\u00e9 que la pauvret\u00e9 est l&#039;un des principaux d\u00e9terminants sociaux de la sant\u00e9, une telle approche peut tr\u00e8s bien \u00eatre contre-productive du point de vue de la sant\u00e9 publique. Enfin, les circonstances individuelles de ceux qui peuvent se voir refuser l&#039;assurance-emploi en raison de cette politique peuvent donner lieu \u00e0 des r\u00e9clamations en vertu de la Charte ou des droits de la personne. Nous vous exhortons vivement \u00e0 reconsid\u00e9rer l&#039;approche de votre gouvernement sur cette question.
