L&#039;Association canadienne des libert\u00e9s civiles (\u00ab ACLC \u00bb) craint que le plan ne viole les droits constitutionnels des Canadiens. L&#039;objectif du gouvernement provincial m\u00e9rite d&#039;\u00eatre clarifi\u00e9, et l&#039;effet de ce plan peut \u00eatre disproportionn\u00e9, ne parvenant pas \u00e0 \u00e9quilibrer les droits individuels avec d&#039;autres objectifs. En fait, c&#039;est le probl\u00e8me : le plan peut \u00eatre motiv\u00e9 davantage par une n\u00e9cessit\u00e9 politique que par la science empirique de la sant\u00e9 publique.<\/p>\n<p>Notre compr\u00e9hension du plan de vaccination pour des b\u00e9n\u00e9fices est la suivante. Les r\u00e9sidents du Manitoba enti\u00e8rement vaccin\u00e9s peuvent voyager au Canada sans s&#039;isoler \u00e0 leur retour chez eux, selon vos commentaires \u00e0 la presse, et confirm\u00e9s dans des ordonnances de sant\u00e9 publique r\u00e9cemment publi\u00e9es. Des \u00ab\u00a0avantages\u00a0\u00bb suppl\u00e9mentaires pour les personnes enti\u00e8rement vaccin\u00e9es seront annonc\u00e9s dans les semaines \u00e0 venir, avez-vous d\u00e9clar\u00e9.<\/p>\n<p>L&#039;objectif vis\u00e9 par un tel programme n&#039;est pas clair. L&#039;ACLC vous exhorte \u00e0 \u00eatre transparent sur votre objectif. Nous avons des questions et des pr\u00e9occupations \u00e0 prendre en compte lorsque vous envisagez les prochaines \u00e9tapes. Nous abordons d&#039;abord les modifications apport\u00e9es aux r\u00e8gles de voyage, suivies d&#039;une discussion sur les \u00abautres avantages\u00bb non d\u00e9finis qui peuvent d\u00e9couler de ceux qui ont \u00e9t\u00e9 vaccin\u00e9s.<\/p>\n<p><strong>Voyages interprovinciaux et auto-isolement\u00a0<\/strong><\/p>\n<p>Avant la pand\u00e9mie, les mesures de contr\u00f4le aux fronti\u00e8res entre les provinces impliquaient des marchandises et non des personnes. Le commerce interprovincial \u00e9tait compliqu\u00e9 mais r\u00e9gi par la Constitution. Les d\u00e9placements interprovinciaux des Canadiens \u00e9taient pr\u00e9sum\u00e9s \u00eatre un droit garanti par la Constitution, mais dans la pratique, la restriction des d\u00e9placements interprovinciaux des Canadiens \u00e9tait inconnue.<\/p>\n<p>Les Canadiens ont des droits constitutionnels \u00e0 la mobilit\u00e9 et les limites de ces droits doivent \u00eatre raisonnables et manifestement justifi\u00e9es. Bien que nous ne contestions pas le fait que les lignes directrices en mati\u00e8re de sant\u00e9 publique puissent \u00e9tablir une distinction entre ceux qui ont \u00e9t\u00e9 vaccin\u00e9s et ceux qui ne l&#039;ont pas \u00e9t\u00e9, nous contestons les tentatives de la province de surveiller ses \u00ab fronti\u00e8res \u00bb provinciales d&#039;une mani\u00e8re qui est incompatible avec un D\u00e9mocratie lib\u00e9rale. De plus, la mosa\u00efque actuelle de restrictions de mobilit\u00e9 \u00e0 travers le pays n&#039;est pas durable. Nous vous exhortons \u00e0 travailler avec vos homologues f\u00e9d\u00e9raux, provinciaux et territoriaux pour adopter une approche plus conforme au statut de f\u00e9d\u00e9ration du Canada.<\/p>\n<p>Nous avons examin\u00e9 les plus r\u00e9centes ordonnances d&#039;auto-isolement pour les personnes entrant au Manitoba, dat\u00e9es du 10 juin 2021. Ces ordonnances ne semblent pas mandater ou autoriser la collecte de renseignements personnels ni exiger la divulgation de son statut vaccinal \u00e0 une autorit\u00e9 provinciale ou autre. Nous vous serions reconnaissants de bien vouloir pr\u00e9ciser s&#039;il existe des exigences l\u00e9gales en place, ou qui seront mises en place, pour montrer une preuve de vaccination dans certaines circonstances et, le cas \u00e9ch\u00e9ant, quand et comment une telle preuve sera requise. Nous exhortons \u00e9galement la province \u00e0 examiner si et comment ses nouvelles r\u00e8gles auront un impact sur les personnes qui ne peuvent pas ou ne seront pas vaccin\u00e9es pour des raisons m\u00e9dicales ou des raisons autrement prot\u00e9g\u00e9es par le Code des droits de la personne du Manitoba. \u00c0 notre avis, le gouvernement devrait prendre des mesures pour fournir \u00e0 ces personnes un am\u00e9nagement raisonnable.<\/p>\n<p><strong>Autres \u00ab\u00a0avantages\u00a0\u00bb conf\u00e9r\u00e9s aux titulaires d&#039;un \u00ab\u00a0passeport vaccin\u00a0\u00bb\u00a0\u00a0<\/strong><\/p>\n<p>L&#039;ACLC appr\u00e9cie que le Manitoba, comme les juridictions du monde entier, essaie de trouver des moyens de sortir de l&#039;ann\u00e9e difficile que COVID-19 nous a impos\u00e9e. Bien qu&#039;il soit appropri\u00e9 que les ordonnances de sant\u00e9 publique tiennent compte de l&#039;\u00e9volution des taux de vaccination, il ne s&#039;ensuit pas que les certificats de vaccination devraient devenir des \u00ab\u00a0passeports de vaccination\u00a0\u00bb nationaux pour \u00eatre utilis\u00e9s comme preuve d&#039;admissibilit\u00e9 \u00e0 certains \u00ab\u00a0avantages\u00a0\u00bb. En effet, tout programme qui exige des individus qu&#039;ils prouvent qu&#039;ils ont fait un choix socialement acceptable concernant leur sant\u00e9 en partageant la preuve d&#039;une d\u00e9cision m\u00e9dicale personnelle soul\u00e8ve des pr\u00e9occupations en mati\u00e8re de droits humains et de libert\u00e9s civiles.<\/p>\n<p>Premi\u00e8rement, un tel plan punirait les citoyens pour un d\u00e9s\u00e9quilibre offre-demande de votre propre conception. Dans un avenir pr\u00e9visible, le moment de la vaccination n&#039;est pas strictement sous contr\u00f4le individuel. Le gouvernement contr\u00f4le le d\u00e9ploiement du vaccin et, raisonnablement, prend des d\u00e9cisions bas\u00e9es sur des orientations scientifiques qui donnent la priorit\u00e9 aux personnes les plus \u00e0 risque de maladie grave ou de d\u00e9c\u00e8s pour la vaccination. L&#039;id\u00e9e que des individus pourraient se voir refuser l&#039;acc\u00e8s \u00e0 des services ou \u00e0 des exp\u00e9riences parce qu&#039;ils ne sont pas encore \u00e9ligibles pour leur deuxi\u00e8me dose de vaccin en raison de la politique du gouvernement est intrins\u00e8quement injuste. Les donn\u00e9es rapport\u00e9es par CBC indiquent que le 10 juin, seulement 14,2 pour cent des Manitobains ont re\u00e7u leur deuxi\u00e8me dose.<\/p>\n<p>Deuxi\u00e8mement, la fronti\u00e8re juridique entre la promotion des vaccins et son obligation doit \u00eatre \u00e9tablie pour respecter nos libert\u00e9s fondamentales. Les politiques et pratiques visant \u00e0 consid\u00e9rer le statut vaccinal comme une condition pr\u00e9alable \u00e0 la pleine participation \u00e0 la vie publique risquent de rendre de facto obligatoire un r\u00e9gime de vaccination volontaire. Nous ne contestons pas l&#039;efficacit\u00e9 des vaccins ni le b\u00e9n\u00e9fice de sant\u00e9 publique que conf\u00e8re la vaccination, mais les individus ont n\u00e9anmoins l\u00e9galement le droit de faire leurs propres choix concernant leur sant\u00e9. Un gouvernement ne devrait pas reconna\u00eetre le droit de choisir tout en limitant le choix. Chaque avantage suppl\u00e9mentaire li\u00e9 \u00e0 un passeport vaccinal ajoutera \u00e0 l&#039;effet coercitif sur le processus d\u00e9cisionnel auquel les individus doivent s&#039;engager lorsqu&#039;ils envisagent de se faire vacciner. Un consentement significatif est requis pour que le volontariat soit authentique, et le consentement forc\u00e9 et sanctionn\u00e9 par l&#039;\u00c9tat n&#039;atteint pas ce seuil.<\/p>\n<p>Troisi\u00e8mement, exiger une preuve de vaccination pour permettre aux individus d&#039;acc\u00e9der \u00e0 certaines prestations entra\u00eene de graves risques de discrimination \u00e0 l&#039;encontre des individus sur la base du handicap, de la sant\u00e9 et des motifs religieux. De plus, si les prestations d\u00e9pendent du statut vaccinal, on ne sait toujours pas si ou comment le gouvernement se conformera aux interdictions l\u00e9gales de discrimination et au devoir d&#039;accommodement. Selon qui est autoris\u00e9 \u00e0 administrer les \u00ab\u00a0avantages\u00a0\u00bb conf\u00e9r\u00e9s aux personnes enti\u00e8rement vaccin\u00e9es, il peut s&#039;agir d&#039;un large \u00e9ventail d&#039;acteurs du secteur public ou priv\u00e9 qui sont charg\u00e9s de d\u00e9terminer l&#039;acc\u00e8s \u00e0 ces avantages (comme les compagnies a\u00e9riennes, les cin\u00e9mas, les restaurants), mais lorsque le gouvernement autorise ces acteurs \u00e0 collecter les informations, il est ultimement responsable de tout impact discriminatoire qui en d\u00e9coule.<\/p>\n<p>Enfin, dans la mesure o\u00f9 votre gouvernement d\u00e9cide d&#039;autoriser les acteurs du secteur public ou priv\u00e9 \u00e0 v\u00e9rifier le statut vaccinal sur la base du passeport vaccinal, il existe des implications importantes en mati\u00e8re de confidentialit\u00e9 associ\u00e9es au fait de permettre \u00e0 un \u00e9ventail d&#039;entit\u00e9s encore \u00e0 identifier de collecter des informations personnelles sur la sant\u00e9. Bien que ce risque soit att\u00e9nu\u00e9 lorsque la quantit\u00e9 d&#039;informations est limit\u00e9e, il n&#039;est pas \u00e9limin\u00e9. Le choix de ne pas se faire vacciner est d\u00e9j\u00e0 stigmatis\u00e9 socialement aujourd&#039;hui, donc imposer sa divulgation est une violation importante de la vie priv\u00e9e. Cela signifie que m\u00eame une petite quantit\u00e9 d&#039;informations sur la carte de vaccination du Manitoba, le nom et le statut vaccinal, est sensible. Le gouvernement peut, par inadvertance, inviter le public \u00e0 faire honte et risquer des confrontations publiques \u00e0 un moment de grande anxi\u00e9t\u00e9 publique. De plus, on ne sait toujours pas qui serait autoris\u00e9 \u00e0 scanner la carte, dans quelles circonstances, si les enregistrements des scans seraient conserv\u00e9s et comment les accommodements pour les non vaccin\u00e9s pourraient \u00eatre trait\u00e9s. Si la carte doit \u00e9galement \u00eatre num\u00e9rique, d&#039;autres probl\u00e8mes techniques de confidentialit\u00e9 se posent.<\/p>\n<p>L&#039;ACLC invite le gouvernement du Manitoba \u00e0 r\u00e9pondre aux questions pos\u00e9es ci-dessus et vous exhorte fortement \u00e0 reconsid\u00e9rer votre projet d&#039;accorder des prestations sp\u00e9ciales aux personnes vaccin\u00e9es et \u00e0 exiger une preuve de vaccination afin d&#039;acc\u00e9der \u00e0 ces prestations.
