E3B 5H1<br \/>\nHugh.Flemming@gnb.ca<\/p>\n<h3><span style=\"color: #1e5799;\">Objet\u00a0: Restrictions de voyage provinciales<\/span><\/h3>\n<p>Cher premier ministre Higgs et ministre Flemming,<\/p>\n<p>Je vous \u00e9cris au nom de l&#039;Association canadienne des libert\u00e9s civiles (ACLC) concernant les restrictions de voyage en cours au Nouveau-Brunswick. \u00c0 notre avis, les r\u00e8gles actuelles restreignent d\u00e9raisonnablement les droits de mobilit\u00e9 garantis aux Canadiens par la Constitution. Votre gouvernement n&#039;a pas, et ne peut probablement pas, d\u00e9montrer que ces mesures sont l\u00e9galement justifi\u00e9es. Ils devraient \u00eatre annul\u00e9s.<\/p>\n<p>Les restrictions de voyage provinciales actuelles emp\u00eachent tout Canadien d&#039;entrer dans la province, \u00e0 l&#039;exception des r\u00e9sidents du Nouveau-Brunswick et des travailleurs essentiels, avec quelques exceptions limit\u00e9es et \u00e9troites. Il s&#039;agit d&#039;un changement important par rapport aux r\u00e8gles qui \u00e9taient en place auparavant. Ces r\u00e8gles exigeaient que les personnes entrant dans la province s&#039;enregistrent et s&#039;isolent, mais elles n&#039;interdisent g\u00e9n\u00e9ralement pas de grandes cat\u00e9gories de Canadiens de la province.<\/p>\n<p>Nous comprenons que ces mesures visent \u00e0 prot\u00e9ger la sant\u00e9 publique et \u00e0 donner la priorit\u00e9 \u00e0 la s\u00e9curit\u00e9 des r\u00e9sidents du Nouveau-Brunswick. Mais ces restrictions ont \u00e9galement des implications tr\u00e8s importantes pour les personnes \u00e0 l&#039;int\u00e9rieur et \u00e0 l&#039;ext\u00e9rieur de la province. L&#039;ACLC a entendu des personnes qui cherchent \u00e0 entrer dans la province pour des raisons imp\u00e9rieuses et qui sont pr\u00eates \u00e0 prendre les mesures de pr\u00e9caution recommand\u00e9es par la sant\u00e9 publique. Dans un cas, une femme avec un parent \u00e2g\u00e9 malade au Nouveau-Brunswick doit prendre des d\u00e9cisions s\u00e9rieuses au sujet de ses soins futurs. Elle d\u00e9tient une procuration l\u00e9gale et a besoin de le voir \u2013 en personne \u2013 afin de faire des choix \u00e9clair\u00e9s sur les soins dont il aura besoin \u00e0 l&#039;avenir. Elle a d\u00e9j\u00e0 re\u00e7u une dose de vaccin et est pr\u00eate \u00e0 se soumettre aux exigences de test et d&#039;isolement d\u00e8s son entr\u00e9e dans la province. Quel objectif de sant\u00e9 publique peut-on atteindre en lui refusant, ou \u00e0 d&#039;autres comme elle, l&#039;entr\u00e9e\u00a0?<\/p>\n<p>Dans un autre cas, un r\u00e9sident saisonnier qui est dans la province depuis des mois a d\u00fb choisir entre rester dans la province et renoncer ou retarder consid\u00e9rablement la vaccination, ou partir pour se faire vacciner dans sa province d&#039;origine et se voir refuser ind\u00e9finiment le retour. Il est pr\u00eat \u00e0 s&#039;isoler et poss\u00e8de une r\u00e9sidence dans une zone peu peupl\u00e9e pour le faire. Comment justifier une interdiction totale de son entr\u00e9e ?<\/p>\n<p>Nous notons \u00e9galement \u2013 avec une certaine ironie \u2013 que la province s&#039;est associ\u00e9e \u00e0 plusieurs agences de d\u00e9veloppement \u00e9conomique pour s&#039;engager dans une campagne publique encourageant les Canadiens \u00e0 d\u00e9m\u00e9nager au Nouveau-Brunswick (www.liveforthemomentnb.ca). Le site Web dit aux visiteurs \u00ab\u00a0Maintenant que vous pouvez travailler de n&#039;importe o\u00f9\u2026 votre meilleure vie est ici, au Nouveau-Brunswick.\u00a0\u00bb Les personnes qui envisagent de s&#039;installer dans la province sont autoris\u00e9es \u00e0 entrer en vertu des restrictions de voyage actuelles \u2013 bien qu&#039;elles doivent vraisemblablement d\u00e9cider de d\u00e9m\u00e9nager sans visiter la province au pr\u00e9alable pour prendre des dispositions. Si les tests et\/ou l&#039;auto-isolement sont une strat\u00e9gie d&#039;att\u00e9nuation des risques suffisante pour ces personnes, pourquoi est-ce insuffisant pour les autres\u00a0?<\/p>\n<p>La pand\u00e9mie a certainement pr\u00e9sent\u00e9 aux gouvernements de tout le pays des d\u00e9fis s\u00e9rieux et sans pr\u00e9c\u00e9dent. Mais les actions ill\u00e9gales et inconstitutionnelles ne peuvent pas et ne doivent pas \u00eatre soutenues, de peur qu&#039;elles ne deviennent des pr\u00e9c\u00e9dents sur lesquels les gouvernements cherchent de plus en plus \u00e0 s&#039;appuyer. La province a eu plus d&#039;un an pour r\u00e9fl\u00e9chir \u00e0 la meilleure fa\u00e7on de prot\u00e9ger la sant\u00e9 et la s\u00e9curit\u00e9 des r\u00e9sidents sans imposer de restrictions arbitraires et d\u00e9raisonnables aux droits individuels. L&#039;auto-isolement peut \u00eatre associ\u00e9 \u00e0 des exigences de test pour att\u00e9nuer les risques. Exclure compl\u00e8tement les Canadiens de la province n&#039;est ni n\u00e9cessaire ni proportionn\u00e9.<\/p>\n<p>Nous croyons que les mesures que vous avez mises en place sont inconstitutionnelles et que vos d\u00e9cisions d&#039;exclure certains Canadiens de la province seraient jug\u00e9es d\u00e9raisonnables par un tribunal.
