Bedford<\/i>.<\/span><span class=\"s2\">\u00a0Dans\u00a0<i>Bedford<\/i>, la Cour a d\u00e9clar\u00e9 que les trois dispositions de la\u00a0<i>Code criminel<\/i>\u00a0concernant les activit\u00e9s li\u00e9es \u00e0 la prostitution \u00e9taient inconstitutionnelles. Le Parlement s&#039;est vu accorder un an pour pr\u00e9senter une nouvelle l\u00e9gislation concernant la prostitution, puis a pr\u00e9sent\u00e9 le projet de loi C-36 (le projet de loi). Le projet de loi est devenu loi le 6 d\u00e9cembre 2014.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\" style=\"color: #1e5799;\"><b>Qu&#039;y a-t-il dans le projet de loi?<\/b><\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">Les pr\u00e9occupations et les objectifs du Parlement<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s2\">Le pr\u00e9ambule du projet de loi identifie les pr\u00e9occupations du Parlement \u00e0 l&#039;\u00e9gard de la prostitution. Ces pr\u00e9occupations comprennent, sans s&#039;y limiter, l&#039;exploitation et le risque de violence pour ceux qui se livrent \u00e0 la prostitution, et le pr\u00e9judice social caus\u00e9 par l&#039;objectivation du corps humain et la marchandisation de l&#039;activit\u00e9 sexuelle. Le pr\u00e9ambule indique \u00e9galement que le Parlement cherche \u00e0 d\u00e9courager la prostitution, car elle a un effet n\u00e9gatif sur la dignit\u00e9 humaine et l&#039;\u00e9galit\u00e9, et un impact disproportionn\u00e9 sur les femmes et les enfants.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Le pr\u00e9ambule identifie \u00e9galement les objectifs du projet de loi, qui comprennent la d\u00e9nonciation et l&#039;interdiction de l&#039;achat de services sexuels, l&#039;encouragement de ceux qui se livrent \u00e0 la prostitution \u00e0 signaler les incidents de violence et \u00e0 quitter la prostitution, et \u00e0 prot\u00e9ger les communaut\u00e9s contre les m\u00e9faits associ\u00e9s \u00e0 la prostitution .<\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">Nouvelles infractions<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s2\">Le projet de loi introduit 4 infractions, dont certaines n&#039;ont jamais figur\u00e9 en droit canadien, et dont certaines repr\u00e9sentent des modifications aux dispositions de la\u00a0<i>Code criminel<\/i>\u00a0qui ont \u00e9t\u00e9 abattus en\u00a0<i>Bedford<\/i>.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Infraction pour achat de services sexuels et communication \u00e0 cette fin<\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">Le projet de loi \u00e9rige en infraction l&#039;achat de services sexuels ainsi que toute communication \u00e0 cette fin. C&#039;est la premi\u00e8re fois que l&#039;achat de services sexuels est rendu ill\u00e9gal au Canada.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Infraction pour communication \u00e0 des fins de prestation de services sexuels<\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">Le projet de loi \u00e9rige en infraction le fait de communiquer avec toute personne dans le but d&#039;offrir ou de fournir des services sexuels dans un lieu public ou \u00e0 la vue du public qui se trouve \u00e0 c\u00f4t\u00e9 d&#039;une cour d&#039;\u00e9cole, d&#039;un terrain de jeu ou d&#039;une garderie.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Infraction pour publicit\u00e9 de services sexuels<\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">Le projet de loi \u00e9rige en infraction la publicit\u00e9 pour des services sexuels. Il existe une exemption de cette infraction pour ceux qui font la publicit\u00e9 de leurs propres services sexuels, cependant, cette disposition affecterait toute organisation qui h\u00e9berge ou publie une publicit\u00e9 pour une prostitu\u00e9e. \u00ab\u00a0Publicit\u00e9 de services sexuels\u00a0\u00bb comprend tout mat\u00e9riel, y compris des photos, des films, des enregistrements vid\u00e9o, audio ou autres, une repr\u00e9sentation visuelle ou tout mat\u00e9riel \u00e9crit utilis\u00e9 pour faire la publicit\u00e9 de services sexuels.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Infraction pour avoir sciemment re\u00e7u un avantage mat\u00e9riel de services sexuels<\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">Le projet de loi \u00e9rige en infraction le fait de recevoir un avantage financier ou un autre avantage mat\u00e9riel, sachant qu&#039;il est obtenu par ou d\u00e9riv\u00e9 directement ou indirectement de la prostitution.<\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">Il existe quatre exceptions \u00e0 cette infraction, notamment lorsque la personne re\u00e7oit l&#039;avantage dans le cadre d&#039;un mode de vie l\u00e9gitime avec la prostitu\u00e9e, en raison d&#039;une obligation morale ou l\u00e9gale de la prostitu\u00e9e, ou en paiement d&#039;un service ou d&#039;un bien qu&#039;elle offrir \u00e0 la prostitu\u00e9e. Cela signifie que les individus tels que les conjoints ou les gardes du corps d&#039;une prostitu\u00e9e seraient exempt\u00e9s de l&#039;infraction.<\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">Ces exceptions ne s&#039;appliqueront pas lorsque la personne b\u00e9n\u00e9ficiaire de la prestation a utilis\u00e9 ou menac\u00e9 la violence, l&#039;intimidation ou la coercition, abus\u00e9 d&#039;une position de confiance ou fourni une drogue, de l&#039;alcool ou d&#039;autres substances intoxicantes \u00e0 la prostitu\u00e9e. Plus particuli\u00e8rement, les exceptions ne s&#039;appliqueront pas \u00e0 une personne qui a tir\u00e9 un avantage mat\u00e9riel dans le cadre d&#039;une entreprise commerciale qui offre des services sexuels contre r\u00e9mun\u00e9ration.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span style=\"color: #1e5799;\"><strong><span class=\"s1\">D\u00e9finitions<\/span><\/strong><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Le projet de loi modifie \u00e9galement la d\u00e9finition de \u00ab maison de d\u00e9bauche \u00bb pour supprimer la r\u00e9f\u00e9rence \u00e0 la prostitution. Avec cet amendement, la prostitution \u00e0 l&#039;int\u00e9rieur n&#039;est plus un d\u00e9lit, \u00e0 moins que les activit\u00e9s se d\u00e9roulant \u00e0 l&#039;int\u00e9rieur de la maison ne constituent des actes d&#039;ind\u00e9cence.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\" style=\"color: #1e5799;\"><b>PROBL\u00c8MES<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\" style=\"color: #1e5799;\"><b>Questions de libert\u00e9s civiles d\u00e9coulant du projet de loi C-36<\/b><\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">La d\u00e9cision de la Cour supr\u00eame du Canada dans Bedford<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s2\">Dans\u00a0<i>Bedford<\/i>, la Cour supr\u00eame du Canada a d\u00e9clar\u00e9 que la prostitution, ou la vente de services sexuels, est toujours l\u00e9gale.<\/span><span class=\"s2\">\u00a0La Cour a constat\u00e9 que le<i>\u00a0<\/i>les dispositions qui criminalisaient certaines activit\u00e9s li\u00e9es \u00e0 la prostitution \u2013 les infractions consistant \u00e0 tenir une maison de d\u00e9bauche, \u00e0 vivre des produits de la prostitution et \u00e0 communiquer en public \u00e0 des fins de prostitution \u2013 \u00e9taient inconstitutionnelles. La Cour a conclu que ces infractions violaient l&#039;article 7 de la\u00a0<i>Charte canadienne des droits et libert\u00e9s<\/i>, qui prot\u00e8ge le droit \u00e0 la s\u00e9curit\u00e9 de la personne, puisqu&#039;elles ont emp\u00each\u00e9 les prostitu\u00e9es se livrant \u00e0 l&#039;activit\u00e9 l\u00e9gale de prostitution de prendre des mesures pour se prot\u00e9ger des risques caract\u00e9ristiques de cette activit\u00e9.<\/span><span class=\"s2\">\u00a0Bon nombre des questions soulev\u00e9es par les dispositions qui ont \u00e9t\u00e9 annul\u00e9es dans\u00a0<i>Bedford<\/i>\u00a0sont toujours pr\u00e9sentes dans le projet de loi C-36, et certaines des nouvelles dispositions du projet de loi g\u00e9n\u00e8rent des probl\u00e8mes de libert\u00e9s civiles suppl\u00e9mentaires.<\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">Infraction pour achat de services sexuels et communication \u00e0 cette fin<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s2\">L&#039;infraction d&#039;achat de services sexuels est nouvelle dans le projet de loi et n&#039;a pas \u00e9t\u00e9 abord\u00e9e dans le\u00a0<i>Bedford<\/i>\u00a0Cas. Cependant, interdire l&#039;achat de services sexuels et la communication en public concernant cet achat peut mettre en danger la s\u00e9curit\u00e9 des prostitu\u00e9es, car ceux qui cherchent \u00e0 acheter des services sexuels peuvent \u00eatre motiv\u00e9s \u00e0 se rencontrer dans des zones plus isol\u00e9es pour \u00e9viter des sanctions p\u00e9nales. Cette disposition peut mettre en p\u00e9ril la s\u00e9curit\u00e9 des prostitu\u00e9es et violer l&#039;article 7 de la\u00a0<i>chartes<\/i>.<\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">Infraction pour communication \u00e0 des fins de prestation de services sexuels<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s2\">\u00c0 Bedford, la Cour a d\u00e9clar\u00e9 que l&#039;interdiction totale de communiquer en public \u00e0 des fins de prestation de services sexuels rendait plus difficile pour les prostitu\u00e9es le filtrage de leurs clients, ce qui mettait en p\u00e9ril leur s\u00e9curit\u00e9. Comme la Cour l&#039;a d\u00e9clar\u00e9 dans\u00a0<i>Bedford<\/i>, la communication en face-\u00e0-face est un outil essentiel pour prot\u00e9ger les prostitu\u00e9es, car elle leur permet de d\u00e9pister les clients pour des \u00e9l\u00e9ments tels que l&#039;intoxication et la pr\u00e9disposition \u00e0 la violence, et leur permet de d\u00e9finir les conditions de pratiques sexuelles s\u00fbres telles que l&#039;utilisation de pr\u00e9servatifs ou maisons s\u00fbres.<\/span><span class=\"s2\">\u00a0L&#039;infraction du projet de loi C-36, qui rend ill\u00e9gale la communication \u00e0 des fins de vente de services sexuels dans ou \u00e0 c\u00f4t\u00e9 d&#039;une cour d&#039;\u00e9cole, d&#039;un terrain de jeu ou d&#039;une garderie, g\u00e9n\u00e8re toujours ces pr\u00e9occupations en mati\u00e8re de s\u00e9curit\u00e9, m\u00eame si c&#039;est dans une moindre mesure. Cette infraction peut \u00e9galement enfreindre l&#039;article 2(b) de la\u00a0<i>chartes<\/i>, qui prot\u00e8ge la libert\u00e9 d&#039;expression.<\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">Infraction pour publicit\u00e9 de services sexuels\u00a0<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s2\">Comme indiqu\u00e9 ci-dessus, les prostitu\u00e9es sont exempt\u00e9es de l&#039;interdiction de faire de la publicit\u00e9 dans le but d&#039;offrir ou de fournir des services sexuels contre r\u00e9mun\u00e9ration. Cette infraction peut \u00e9galement constituer une atteinte \u00e0 la libert\u00e9 d&#039;expression des prostitu\u00e9es.<\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">Infraction pour avoir obtenu sciemment un avantage mat\u00e9riel de services sexuels<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s2\">Dans\u00a0<i>Bedford<\/i>, la Cour a jug\u00e9 invalide la disposition criminalisant le fait de vivre des produits de la prostitution, car elle ne faisait pas de distinction entre ceux qui exploitent les prostitu\u00e9es et ceux qui contribuent \u00e0 assurer la s\u00e9curit\u00e9 des prostitu\u00e9es, tels que les chauffeurs, les gestionnaires, les gardes du corps, les infirmi\u00e8res ou les assistants .<\/span><span class=\"s2\"><span class=\"Apple-converted-space\">\u00a0\u00a0<\/span>Les m\u00eames pr\u00e9occupations sont pr\u00e9sentes dans le nouveau r\u00e9gime d&#039;avantages mat\u00e9riels, car les exceptions \u00e0 l&#039;infraction ne s&#039;appliquent pas aux personnes recevant l&#039;avantage dans le cadre d&#039;une entreprise commerciale.
