Le projet de loi modifiait principalement la\u00a0<i>Loi sur le Service canadien du renseignement de s\u00e9curit\u00e9<\/i>\u00a0(les &quot;<b>Acte<\/b>\u00bb), qui traite du cadre juridique entourant le Service canadien du renseignement de s\u00e9curit\u00e9 (<b>SCRS<\/b>). Pour les publications officielles, les rapports cl\u00e9s, les prises de position, la documentation juridique et les derni\u00e8res nouvelles sur le travail de l&#039;ACLC\u00a0<a href=\"https:\/\/ccla.org\/fr\/?page_id=27\" target=\"_blank\" rel=\"noopener\">consultez la section In Focus de notre site Web.<\/a><\/span><\/em><\/p>\n<h3 class=\"p2\"><span class=\"s1\" style=\"color: #1e5799;\"><b>Qu&#039;y a-t-il dans le projet de loi?<\/b><\/span><\/h3>\n<p class=\"p2\"><span class=\"s1\">Le projet de loi a apport\u00e9 trois changements majeurs, de sorte que la loi maintenant :<\/span><\/p>\n<ul>\n<li class=\"p2\"><span class=\"s1\">autorise express\u00e9ment le SCRS \u00e0 exercer ses fonctions \u00e0 l&#039;ext\u00e9rieur du Canada;<\/span><\/li>\n<li class=\"p2\"><span class=\"s1\">permet \u00e0 un tribunal de d\u00e9livrer un mandat autorisant des activit\u00e9s \u00e0 l&#039;ext\u00e9rieur du Canada, m\u00eame si cela violerait la loi d&#039;un \u00c9tat \u00e9tranger; et<\/span><\/li>\n<li class=\"p2\"><span class=\"s1\">emp\u00eache la divulgation de l&#039;identit\u00e9 des sources humaines du SCRS, sauf dans des circonstances particuli\u00e8res.<\/span><\/li>\n<\/ul>\n<h3 class=\"p2\"><span class=\"s1\" style=\"color: #1e5799;\"><b>Quelles sont les critiques du projet de loi du point de vue des libert\u00e9s civiles ?<\/b><\/span><\/h3>\n<p class=\"p2\"><span class=\"s2\">Ex\u00e9cution de t\u00e2ches \u00e0 l&#039;ext\u00e9rieur du Canada et mandats enfreignant la loi d&#039;un \u00c9tat \u00e9tranger<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Les critiques du premier et du deuxi\u00e8me changement majeur \u00e0 la Loi sont li\u00e9es. Voici les principales critiques de ces deux changements.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(1) Les m\u00e9canismes de surveillance et d&#039;examen n&#039;ont pas accompagn\u00e9 l&#039;augmentation significative des pouvoirs du SCRS<\/i><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">C&#039;est peut-\u00eatre la critique la plus importante du projet de loi. Contrairement aux \u00c9tats-Unis et au Royaume-Uni, les parlementaires au Canada n&#039;ont pas un acc\u00e8s r\u00e9gulier aux informations n\u00e9cessaires pour savoir comment l&#039;agence d&#039;espionnage du pays fait son travail. De plus, en 2012, le gouvernement a aboli le bureau de l&#039;inspecteur g\u00e9n\u00e9ral, qui \u00e9tait charg\u00e9 de veiller \u00e0 ce que le ministre demeure ad\u00e9quatement inform\u00e9 des activit\u00e9s du SCRS. N\u00e9anmoins, le projet de loi a ignor\u00e9 les recommandations visant \u00e0 accro\u00eetre la surveillance de plusieurs commissions d&#039;enqu\u00eate sur les questions de s\u00e9curit\u00e9 nationale. La commission Air India, par exemple, a propos\u00e9 de renforcer le r\u00f4le du conseiller \u00e0 la s\u00e9curit\u00e9 nationale au Bureau du Conseil priv\u00e9 pour qu&#039;il agisse en tant qu&#039;organisme int\u00e9gr\u00e9 de surveillance de la s\u00e9curit\u00e9 nationale.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">L&#039;organe d&#039;examen actuel du SCRS, le Comit\u00e9 de surveillance des activit\u00e9s de renseignement de s\u00e9curit\u00e9 (<b>CSARS<\/b>), n&#039;est pas un organe de surveillance ad\u00e9quat et a reconnu qu&#039;il \u00ab lutte pour fonctionner efficacement \u00bb. De plus, de nombreuses actions du SCRS exigent d\u00e9j\u00e0 une surveillance accrue. Le SCRS n&#039;a pas syst\u00e9matiquement signal\u00e9 au ministre les actions sensibles et potentiellement controvers\u00e9es, a manqu\u00e9 \u00e0 son obligation de franchise dans les proc\u00e9dures judiciaires et n&#039;a pas coop\u00e9r\u00e9 de mani\u00e8re appropri\u00e9e avec le CSARS. Le CSARS a m\u00eame constat\u00e9 que le SCRS ne confirme pas correctement la valeur et la fiabilit\u00e9 des renseignements qu&#039;il obtient \u00e0 l&#039;\u00e9tranger. Tous ces probl\u00e8mes soulignent d\u00e9j\u00e0 la n\u00e9cessit\u00e9 d&#039;un examen et d&#039;une surveillance solides. Des pouvoirs suppl\u00e9mentaires ne font que renforcer ce besoin, car ils augmentent le nombre d&#039;activit\u00e9s qui doivent faire l&#039;objet d&#039;un examen.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(2) Partager des renseignements avec des agences \u00e9trang\u00e8res et le Centre de la s\u00e9curit\u00e9 des t\u00e9l\u00e9communications Canada et solliciter leur aide (<\/i><b><i>CSE<\/i><\/b><i>) en op\u00e9rant \u00e0 l&#039;\u00e9tranger peut mettre les Canadiens en danger<\/i><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Dans l&#039;exercice de ses fonctions \u00e0 l&#039;ext\u00e9rieur du Canada, y compris l&#039;interception des communications et l&#039;acc\u00e8s aux t\u00e9l\u00e9phones cellulaires ou aux ordinateurs de personnes, le SCRS s&#039;appuiera sur l&#039;aide du CST et des agences de renseignement \u00e9trang\u00e8res. La d\u00e9pendance \u00e0 l&#039;\u00e9gard du renseignement \u00e9tranger exige un partage et une confiance en l&#039;information, ce qui comporte de graves risques et pourrait entra\u00eener des cons\u00e9quences tragiques pour les Canadiens. Le SCRS peut continuer \u00e0 confirmer ind\u00fbment la valeur et la fiabilit\u00e9 des renseignements recueillis \u00e0 l&#039;\u00e9tranger ou se fier \u00e0 des renseignements inexacts de partenaires \u00e9trangers. De plus, une fois que le SCRS partage des informations avec un service de renseignement \u00e9tranger, les pays \u00e9trangers peuvent en faire ce qu&#039;ils veulent. Le cas de Maher Arar met en \u00e9vidence les dangers du partage de l&#039;information pour les Canadiens en des termes particuli\u00e8rement crus. Cela pourrait m\u00eame conduire \u00e0 la complicit\u00e9 du SCRS dans des violations des droits de la personne, comme dans les mauvais traitements inflig\u00e9s \u00e0 Omar Khadr lors de sa d\u00e9tention \u00e0 Guantanamo Bay.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(3) Demander aux tribunaux canadiens d&#039;autoriser les violations du droit \u00e9tranger encourage une conduite r\u00e9ciproque et \u00e9rode la r\u00e9putation du Canada de respecter la primaut\u00e9 du droit<\/i><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Inviter d&#039;autres pays \u00e0 espionner r\u00e9ciproquement ill\u00e9galement des r\u00e9sidents canadiens ou des citoyens au Canada pourrait porter atteinte \u00e0 leur vie priv\u00e9e et \u00e0 ceux avec qui ils interagissent. Cela pourrait m\u00eame conduire \u00e0 la d\u00e9tention ou \u00e0 l&#039;arrestation lors d&#039;un voyage \u00e0 l&#039;\u00e9tranger. De plus, la r\u00e9putation du Canada de respecter la primaut\u00e9 du droit affecte sa capacit\u00e9 \u00e0 s&#039;exprimer \u00e0 l&#039;\u00e9chelle internationale sur de nombreuses questions et est \u00e9galement importante sur le plan diplomatique.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(4) Le SCRS peut violer les droits garantis par la Charte des Canadiens \u00e0 l&#039;\u00e9tranger<\/i><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">La Cour supr\u00eame du Canada a express\u00e9ment conclu que le\u00a0<i>Charte des droits et libert\u00e9s<\/i>\u00a0ne s&#039;applique pas aux actions des fonctionnaires canadiens dans un autre pays. Cependant, les \u00e9l\u00e9ments de preuve obtenus dans le cadre d&#039;une enqu\u00eate \u00e9trang\u00e8re men\u00e9e par des fonctionnaires canadiens peuvent toujours \u00eatre exclus parce que leur utilisation rendrait un proc\u00e8s in\u00e9quitable. Il n&#039;est pas clair si la m\u00eame possibilit\u00e9 d&#039;exclusion s&#039;appliquerait en dehors du contexte criminel \u00e0 d&#039;autres proc\u00e9dures o\u00f9 les renseignements du SCRS pourraient \u00eatre utilis\u00e9s. Quoi qu&#039;il en soit, il est inqui\u00e9tant que le SCRS ne soit pas tenu de respecter les\u00a0<i>chartes<\/i>\u00a0droits des Canadiens tout en utilisant ses nouveaux pouvoirs pour surveiller \u00e0 l&#039;\u00e9tranger.<\/span><\/p>\n<h3 class=\"p2\"><span class=\"s2\" style=\"color: #1e5799;\">Prot\u00e9ger les sources humaines du SCRS<\/span><\/h3>\n<p class=\"p2\"><span class=\"s1\">La Cour supr\u00eame du Canada a explicitement refus\u00e9 de prot\u00e9ger les informateurs du SCRS avec la m\u00eame protection d&#039;identit\u00e9 que celle accord\u00e9e aux sources polici\u00e8res. Le projet de loi a renvers\u00e9 cette d\u00e9cision en interdisant la divulgation de l&#039;identit\u00e9 d&#039;une source humaine du SCRS, sauf (1) si la source et le directeur du SCRS y consentent ou (2) pour \u00e9tablir l&#039;innocence d&#039;un accus\u00e9 accus\u00e9 d&#039;une infraction.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Voici des critiques du privil\u00e8ge des indicateurs du SCRS cr\u00e9\u00e9 par le projet de loi.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(1) La transparence d&#039;une proc\u00e9dure est r\u00e9duite<\/i><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Comme l&#039;a not\u00e9 la Cour supr\u00eame du Canada, le gouvernement a tendance \u00e0 exag\u00e9rer les all\u00e9gations de confidentialit\u00e9 en mati\u00e8re de s\u00e9curit\u00e9 nationale. Les r\u00e9gimes de s\u00e9curit\u00e9 nationale ont tendance \u00e0 \u00eatre d\u00e9j\u00e0 enclins au secret, mais un privil\u00e8ge de classe encourage le secret r\u00e9flexif en cr\u00e9ant une pr\u00e9somption de confidentialit\u00e9. Ce secret r\u00e9flexif exacerbera les probl\u00e8mes de transparence et de proc\u00e9dure qui accompagnent in\u00e9vitablement les proc\u00e9dures impliquant la s\u00e9curit\u00e9 nationale.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(2) Il incombe \u00e0 l&#039;individu de faire valoir une exception au privil\u00e8ge<\/i><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">En vertu de l&#039;ancienne approche au cas par cas du privil\u00e8ge relatif aux indicateurs du SCRS, il incombait au gouvernement de justifier la confidentialit\u00e9 dans chaque cas. En vertu de l&#039;approche du privil\u00e8ge collectif nouvellement cr\u00e9\u00e9e par le projet de loi, c&#039;est \u00e0 l&#039;individu qu&#039;il incombe de plaider en faveur d&#039;une exception au privil\u00e8ge. Cependant, dans les cas impliquant la s\u00e9curit\u00e9 nationale, une grande partie des preuves peuvent d\u00e9j\u00e0 \u00eatre secr\u00e8tes ou expurg\u00e9es. Il peut donc \u00eatre difficile pour l&#039;individu de lutter contre les revendications ill\u00e9gitimes de privil\u00e8ge. De plus, le privil\u00e8ge de l&#039;indicateur ajoute un autre niveau de complexit\u00e9 que l&#039;individu doit naviguer.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(3) L&#039;exception de \u00ab\u00a0l&#039;innocence en jeu\u00a0\u00bb ne s&#039;applique pas aux proc\u00e9dures non p\u00e9nales<\/i><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">La possibilit\u00e9 de contester le privil\u00e8ge relatif \u00e0 l&#039;indicateur n&#039;est disponible que si l&#039;instance concerne la poursuite d&#039;une infraction. Cependant, l&#039;utilisation des sources humaines du SCRS ne se limite pas aux poursuites p\u00e9nales \u2013 elles sont \u00e9galement utilis\u00e9es dans les proc\u00e9dures d&#039;immigration et peuvent jouer un r\u00f4le dans la justification de la d\u00e9tention pr\u00e9ventive, de la r\u00e9vocation du passeport et de la d\u00e9pouillement de la citoyennet\u00e9. Par cons\u00e9quent, le projet de loi aurait d\u00fb garantir que l&#039;identit\u00e9 d&#039;une source humaine pourrait \u00eatre divulgu\u00e9e dans tous les cas o\u00f9 la vie, la libert\u00e9 et la s\u00e9curit\u00e9 de la personne sont en jeu.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><i>(4) Le privil\u00e8ge rend plus difficile la poursuite des affaires de terrorisme<\/i><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Comme l&#039;a not\u00e9 la commission Air India, le fait d&#039;accorder aux sources humaines du SCRS le privil\u00e8ge de l&#039;indicateur donne en fait \u00e0 l&#039;indicateur un droit de veto virtuel sur le fait qu&#039;il t\u00e9moignera ou non. Cela peut rendre difficile, voire impossible, de poursuivre avec succ\u00e8s les affaires de terrorisme.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Il convient de noter que la Cour supr\u00eame du Canada a r\u00e9cemment accord\u00e9 l&#039;autorisation d&#039;en appeler d&#039;une d\u00e9cision de la Cour d&#039;appel f\u00e9d\u00e9rale, \u00e0 la suite de laquelle elle se penchera sur la l\u00e9galit\u00e9 de l&#039;espionnage \u00e0 l&#039;\u00e9tranger par le SCRS.
