Nous notons \u00e9galement que le Comit\u00e9 aura le pouvoir de surveiller les actions de l&#039;Agence des services frontaliers du Canada (ASFC). Contrairement \u00e0 la GRC, au SCRS et au CST, l&#039;ASFC n&#039;a jusqu&#039;\u00e0 pr\u00e9sent fait l&#039;objet d&#039;aucune surveillance malgr\u00e9 le fait que 14 personnes sont d\u00e9c\u00e9d\u00e9es sous sa garde (et celle de ses organismes pr\u00e9d\u00e9cesseurs).\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Cependant, nous croyons que des \u00e9l\u00e9ments cl\u00e9s du projet de loi C-22 doivent \u00eatre examin\u00e9s attentivement et \u00e9ventuellement modifi\u00e9s. Premi\u00e8rement, nous sommes pr\u00e9occup\u00e9s par le pouvoir du gouvernement d&#039;arr\u00eater une enqu\u00eate du Comit\u00e9, ou de refuser de fournir des informations, lorsqu&#039;elles sont jug\u00e9es \u00ab\u00a0nuisibles \u00e0 la s\u00e9curit\u00e9 nationale\u00a0\u00bb. Bien que nous reconnaissions que le plus grand secret est parfois requis, cela est particuli\u00e8rement inqui\u00e9tant car ces d\u00e9cisions sont finales et ne font pas l&#039;objet d&#039;un contr\u00f4le judiciaire ou de tout autre processus de r\u00e8glement des diff\u00e9rends. Le pouvoir du Premier ministre d&#039;expurger les rapports de la commission (sans aucune preuve que des expurgations ont \u00e9t\u00e9 faites) est \u00e9galement pr\u00e9occupant, ainsi que les nombreuses cat\u00e9gories d&#039;informations auxquelles la commission n&#039;a pas acc\u00e8s. De plus, ce devraient \u00eatre les membres du comit\u00e9 eux-m\u00eames, et non le premier ministre, qui choisissent le pr\u00e9sident du comit\u00e9.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Surtout, il est important de noter que ce m\u00e9canisme \u00e0 lui seul \u2014 ainsi que d&#039;autres promesses du programme \u00e9lectoral du Parti lib\u00e9ral \u2014 ne r\u00e9pare pas enti\u00e8rement les dommages caus\u00e9s par le projet de loi C-51. Notamment, il n&#039;y a toujours pas d&#039;intention d\u00e9clar\u00e9e d&#039;\u00e9liminer les nouveaux pouvoirs \u00e9tendus de partage d&#039;informations du gouvernement, ni les changements inqui\u00e9tants apport\u00e9s \u00e0 la\u00a0<i>Loi sur l&#039;immigration et la protection des r\u00e9fugi\u00e9s \u2014\u00a0<\/i>que nous contestons tous les deux devant les tribunaux.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Des m\u00e9canismes de responsabilit\u00e9 solides et significatifs sont essentiels pour les agences de s\u00e9curit\u00e9 et de renseignement. Sans de tels m\u00e9canismes, ces agences peuvent porter atteinte aux droits et libert\u00e9s des individus au Canada, entra\u00eenant de graves violations des droits et mena\u00e7ant simultan\u00e9ment les fondements tr\u00e8s d\u00e9mocratiques du Canada. L&#039;ACLC s&#039;est battue pour la responsabilit\u00e9 en mati\u00e8re de s\u00e9curit\u00e9 nationale dans\u00a0<strong><a href=\"https:\/\/ccla.org\/wp-content\/uploads\/2021\/06\/CCLA-Senate-Committee-20-04-15.pdf\" target=\"_blank\" rel=\"noopener\">soumissions \u00e9crites au Comit\u00e9 s\u00e9natorial de la s\u00e9curit\u00e9 nationale et de la d\u00e9fense<\/a><\/strong>,<strong>\u00a0<\/strong><\/span><span class=\"s1\">et dans notre\u00a0<strong><a href=\"https:\/\/ccla.org\/wp-content\/uploads\/2021\/06\/Issued-Notice-of-Application-Bill-C-51-C1383715xA0E3A-1.pdf\" target=\"_blank\" rel=\"noopener\">Contestation fond\u00e9e sur la Charte contre le projet de loi C-51<\/a><\/strong>.
