C-59 EST UN NOUVEAU PROJET DE LOI SUR LA S\u00c9CURIT\u00c9 NATIONALE AU CANADA. IL \u00c9TAIT CENS\u00c9 R\u00c9SOUDRE LES PROBL\u00c8MES CAUS\u00c9S PAR C-51, MAIS AU LIEU, IL R\u00c9SOLU CERTAINS PROBL\u00c8MES, IGNORE D'AUTRES ET EN CR\u00c9AIT ENTI\u00c8REMENT DE NOUVEAUX.\u00a0<\/b><\/span><\/p>\n

C-59 \u00e9tait cens\u00e9 corriger les changements inconstitutionnels introduits dans le projet de loi C-51, la loi antiterroriste notoire de l'ancien gouvernement (la\u00a0Loi antiterroriste, 2015).<\/i>\u00a0\u00a0Alors que le gouvernement actuel a promis qu'il r\u00e9glerait les aspects \u00ab probl\u00e9matiques \u00bb du projet de loi C-51, le C-59 est une r\u00e9invention beaucoup plus compl\u00e8te du paysage de la s\u00e9curit\u00e9 nationale au Canada. C'est long, compliqu\u00e9 et contient un m\u00e9lange de probl\u00e8mes : certains sont des am\u00e9liorations, et d'autres qui sont extr\u00eamement pr\u00e9occupants.<\/p>\n

Son pr\u00e9d\u00e9cesseur, le projet de loi C-51, \u00e9tait si probl\u00e9matique que l'ACLC a d\u00e9pos\u00e9\u00a0une contestation devant la Cour constitutionnelle<\/a>, demandant que des dispositions violant de mani\u00e8re injustifi\u00e9e la\u00a0Charte des droits et libert\u00e9s<\/i>\u00a0\u00eatre jug\u00e9 inconstitutionnel. C-59 essaie de r\u00e9gler certains, mais pas tous, les probl\u00e8mes que l'ACLC a identifi\u00e9s dans notre contestation constitutionnelle. Il am\u00e9liore la surveillance et la responsabilisation de nos agences d'espionnage, ce qui constituait une grave lacune dans C-51. Mais cela cr\u00e9e \u00e9galement une gamme de nouveaux pouvoirs troublants pour nos agences de renseignement et ne r\u00e9sout pas les probl\u00e8mes \u00e0 long terme de la loi canadienne sur la s\u00e9curit\u00e9 nationale, comme s'assurer qu'un processus de d\u00e9fense de base est disponible pour les personnes impliqu\u00e9es dans des proc\u00e9dures de s\u00e9curit\u00e9 nationale.
