Suite \u00e0 la d\u00e9cision de la Commission\u00a0<a href=\"http:\/\/epe.lac-bac.gc.ca\/100\/200\/301\/pco-bcp\/commissions-ef\/mcdonald1979-81-eng\/mcdonald1979-81-eng.htm\" target=\"_blank\" rel=\"noopener\">recommandations<\/a>, le Canada a s\u00e9par\u00e9 les organismes responsables des activit\u00e9s de collecte de renseignements de ceux responsables de l&#039;application de la loi, de la collecte de preuves et de la pr\u00e9vention des crimes. Cette division des responsabilit\u00e9s a reconnu que les deux objectifs sont parfois en conflit, et que faire les deux met beaucoup de pouvoir et de fortes incitations aux abus entre les mains d&#039;une agence potentiellement faillible.<\/p>\n<p>En 2015, cette ligne s&#039;est \u00e0 nouveau brouill\u00e9e lorsque le SCRS s&#039;est vu conf\u00e9rer un nouvel ensemble de \u00ab\u00a0pouvoirs contre les menaces\u00a0\u00bb en vertu du projet de loi C-51, lui permettant non seulement de recueillir des renseignements, mais d&#039;agir en cons\u00e9quence, permettant soudainement aux agents du SCRS, par exemple, d&#039;interrompre une transfert d&#039;argent, ou planter un faux document. Seules limites impos\u00e9es au SCRS : il leur \u00e9tait interdit de tuer ; entraver ou pervertir le cours de la justice ; ou de porter atteinte \u00e0 l&#039;int\u00e9grit\u00e9 sexuelle d&#039;une personne. C-51 a \u00e9galement permis au SCRS de demander au tribunal une\u00a0<a href=\"https:\/\/ccla.org\/fr\/natsecglossary\/\" target=\"_blank\" rel=\"noopener\">garantir<\/a>\u00a0leur permettre de violer\u00a0<i>chartes<\/i>\u00a0droits. L&#039;ACLC a identifi\u00e9 ces\u00a0<i>chartes<\/i>-les mandats de violation en tant que probl\u00e8me majeur dans notre contestation C-51 - au cours d&#039;un processus normal de mandat, le travail d&#039;un juge est de s&#039;assurer que les actions du gouvernement respectent, et non violent, la\u00a0<i>chartes<\/i>.<\/p>\n<p>Malheureusement, C-59 ne supprime pas ces nouveaux pouvoirs, mais il pr\u00e9cise ce que le SCRS ne peut pas faire de sa propre initiative ainsi que ce qu&#039;il peut faire avec une autorisation judiciaire. Il est d\u00e9sormais express\u00e9ment interdit au SCRS de se livrer \u00e0 la torture (ce qu&#039;il lui \u00e9tait d\u00e9j\u00e0 interdit de faire en vertu du droit international), de d\u00e9tenir qui que ce soit et de mettre en danger la s\u00e9curit\u00e9 d&#039;un individu en causant la perte ou la destruction grave de biens.<\/p>\n<p>De plus, il est interdit au SCRS d&#039;entreprendre de sa propre initiative toute action qui imposerait une limite \u00e0 un droit prot\u00e9g\u00e9 par le\u00a0<i>chartes<\/i>. Bien qu&#039;il s&#039;agisse d&#039;interdictions raisonnables, elles laissent une grande latitude au SCRS pour agir de mani\u00e8re \u00e0 porter atteinte aux droits. Le SCRS peut-il se faire passer pour un journaliste pour gagner en cr\u00e9dibilit\u00e9 aupr\u00e8s d&#039;une cible? Peuvent-ils falsifier un profil en ligne pour saper la r\u00e9putation d&#039;un individu ? Probablement, \u00e9tant donn\u00e9 que de telles choses ne sont clairement interdites par aucune exception dans C-59, et elles ne seraient pas non plus clairement consid\u00e9r\u00e9es comme un\u00a0<i>chartes<\/i>\u00a0violation. Le SCRS peut m\u00eame faire\u00a0<i>Suite<\/i>\u00a0s&#039;ils convainquent un juge qu&#039;une activit\u00e9 particuli\u00e8re est raisonnable, proportionn\u00e9e,\u00a0<i>chartes<\/i>-coh\u00e9rent et n\u00e9cessaire pour r\u00e9duire une menace pour la s\u00e9curit\u00e9. Le projet de loi C-51 a laiss\u00e9 la liste des activit\u00e9s possibles qui pourraient \u00eatre entreprises avec l&#039;approbation judiciaire ouverte \u00e0 l&#039;imagination des agents du SCRS cherchant \u00e0 les mener. Le projet de loi C-59, en revanche, tente de limiter cette \u00e9volutivit\u00e9 en fournissant une liste sp\u00e9cifique de mesures de perturbation des menaces, mais la nouvelle liste reste assez large et pourrait m\u00eame inclure des activit\u00e9s probl\u00e9matiques telles que la perturbation d&#039;une \u00e9lection \u00e9trang\u00e8re. Ces demandes de mandat du SCRS se produisent toutes en secret, sans processus accusatoire ni examen public.<\/p>\n<p>Lorsque ces pouvoirs ont \u00e9t\u00e9 introduits dans le projet de loi C-51, le gouvernement n&#039;a jamais vraiment justifi\u00e9 publiquement pourquoi ils \u00e9taient n\u00e9cessaires. C-59 offre au public une occasion importante de discuter si nous pensons que notre agence de renseignement a r\u00e9ellement besoin de ces pouvoirs, et pour le gouvernement d&#039;expliquer pourquoi il pense que les pouvoirs de perturbation sont n\u00e9cessaires et proportionn\u00e9s.<\/p>\n<p><strong><a href=\"https:\/\/ccla.org\/fr\/?p=27988\">VISITEZ NOTRE PROJET DE LOI C-59 : FAITES-LE BIEN !
