A l&#039;inverse, la proposition\u00a0<i>Loi sur le CST\u00a0<\/i>d\u00e9crit les activit\u00e9s sp\u00e9cifiques que le CST entreprendra et int\u00e8gre de meilleurs processus de surveillance et d&#039;examen dans les m\u00e9canismes d&#039;autorisation du CST. Le fait d&#039;avoir plus d&#039;informations sur le fonctionnement du CSE dans le droit public est une am\u00e9lioration notable par rapport \u00e0 un syst\u00e8me de directives minist\u00e9rielles secr\u00e8tes. Cependant, le projet de loi C-59 ne devrait pas \u00eatre un tampon pour la conduite pass\u00e9e du CST. Le Canada a besoin d&#039;un d\u00e9bat constructif sur l&#039;\u00e9tendue et les limites des pouvoirs du CST. Dans certains cas, on ne sait pas dans quelle mesure le\u00a0<i>Loi sur le CST<\/i>\u00a0donne au CST de nouveaux pouvoirs et dans quelle mesure il ne fait que lui donner un pouvoir statutaire pour des activit\u00e9s dans lesquelles il est d\u00e9j\u00e0 engag\u00e9. Ce qui est clair, cependant, c&#039;est que C-59 est une occasion pour les Canadiens d&#039;examiner tous ces pouvoirs et de discuter de ceux qui sont n\u00e9cessaires et de ceux qui vont trop loin.<\/p>\n<p>En plus de maintenir les trois mandats traditionnels du CST (renseignements sur les signaux, cybers\u00e9curit\u00e9 et assistance aux autres organismes de s\u00e9curit\u00e9 nationale et d&#039;application de la loi), le\u00a0<i>Loi sur le CST\u00a0<\/i>ajoute des sections sur les cyberop\u00e9rations actives (offensives) et d\u00e9fensives.<\/p>\n<p>Alors que d&#039;autres juridictions se demandent s&#039;il est logique de confier aux m\u00eames personnes charg\u00e9es de trouver et de corriger les vuln\u00e9rabilit\u00e9s dangereuses dans l&#039;infrastructure num\u00e9rique (op\u00e9rations d\u00e9fensives) le r\u00f4le concurrent d&#039;exploiter ces vuln\u00e9rabilit\u00e9s \u00e0 des fins strat\u00e9giques (op\u00e9rations actives), la\u00a0<i>Loi sur le CST\u00a0<\/i>donne aux cyberespions du Canada la responsabilit\u00e9 de faire les deux, sans directives claires sur la fa\u00e7on de d\u00e9cider quel r\u00f4le prioriser dans diff\u00e9rentes situations. Cela inclut les pouvoirs d&#039;acc\u00e9der aux syst\u00e8mes informatiques\u00a0; acqu\u00e9rir, modifier ou supprimer des informations\u00a0; maintenir le secret des activit\u00e9s; et introduire de nouvelles vuln\u00e9rabilit\u00e9s dans les r\u00e9seaux. En d&#039;autres termes, le\u00a0<i>Loi sur le CST\u00a0<\/i>est une approbation du piratage parrain\u00e9 par l&#039;\u00c9tat, avec une surveillance minimale des activit\u00e9s qui ont la capacit\u00e9 d&#039;interf\u00e9rer profond\u00e9ment avec la s\u00e9curit\u00e9 des r\u00e9seaux et\u00a0<i>chartes<\/i>-droits prot\u00e9g\u00e9s.<\/p>\n<p>Les dispositions de la\u00a0<i>Loi sur le CST<\/i>\u00a0qui exigent que le CST agisse de mani\u00e8re \u00e0 prot\u00e9ger la vie priv\u00e9e ne s&#039;appliquent pas aux mandats de cyberop\u00e9rations actives et d\u00e9fensives. Les dispositions sur le piratage du projet de loi C-59 ont \u00e9galement des implications troublantes pour la libert\u00e9 d&#039;expression et d&#039;autres droits, permettant au CST d&#039;interf\u00e9rer avec les outils de communication (tels que les logiciels de cryptage et d&#039;anonymat) qui sont essentiels \u00e0 la protection des droits de l&#039;homme \u00e0 l&#039;\u00e8re num\u00e9rique.<\/p>\n<p>La\u00a0<i>Loi sur le CST<\/i>\u00a0pr\u00e9voit que les activit\u00e9s ne doivent pas \u00eatre \u00ab dirig\u00e9es vers \u00bb des Canadiens ou des personnes au Canada (sauf si elles fournissent une assistance technique et op\u00e9rationnelle \u00e0 d&#039;autres organismes). Cependant, en se concentrant sur l&#039;intention derri\u00e8re l&#039;activit\u00e9 (qui a \u00e9t\u00e9 cibl\u00e9) plut\u00f4t que sur le r\u00e9sultat de cette activit\u00e9 (qui a \u00e9t\u00e9 touch\u00e9), le\u00a0<i>Acte<\/i>\u00a0laisse la place aux Canadiens ou aux personnes au Canada d&#039;\u00eatre des dommages collat\u00e9raux dans les op\u00e9rations du CST. Les\u00a0<i>Loi sur le CST\u00a0<\/i>comprend \u00e9galement de nouvelles exceptions troublantes facilitant la collecte sans mandat de soi-disant \u00abinformations accessibles au public\u00bb, dont nous discutons ci-dessous, et qui ont des implications importantes pour les droits \u00e0 la vie priv\u00e9e des Canadiens et des personnes au Canada.
