Les individus sont oblig\u00e9s de fournir \u00e0 leur gouvernement des quantit\u00e9s importantes de donn\u00e9es en tant que sous-produit g\u00e9n\u00e9ral de la vie quotidienne, et ne devraient pas avoir \u00e0 le faire de peur que les informations ne soient ensuite utilis\u00e9es contre eux par leur gouvernement. Le projet de loi C-59 fait un petit pas vers la limitation du partage excessif et largement irresponsable autoris\u00e9 dans le projet de loi C-51, mais doit aller plus loin pour garantir que tout partage est juste, proportionn\u00e9 et tient d\u00fbment compte de la vie priv\u00e9e.<\/p>\n<p>Lorsque le projet de loi C-51 a introduit le nouveau\u00a0<i>Loi sur l&#039;\u00e9change de renseignements sur la s\u00e9curit\u00e9 du Canada<\/i>, il a consid\u00e9rablement \u00e9largi les conditions dans lesquelles 111 minist\u00e8res et organismes gouvernementaux pouvaient divulguer des informations \u00e0 17 organismes diff\u00e9rents ayant des fonctions de s\u00e9curit\u00e9 nationale (<a href=\"https:\/\/ccla.org\/fr\/?p=26571\" target=\"_blank\" rel=\"noopener\">vois ici<\/a>\u00a0pour plus d&#039;informations sur ces changements). L&#039;ACLC s&#039;est \u00e9lev\u00e9e contre la port\u00e9e du partage (et la d\u00e9finition trop large de la \u00ab s\u00e9curit\u00e9 \u00bb qui a guid\u00e9 cette port\u00e9e)\u00a0; le manque de garanties, y compris la protection de la vie priv\u00e9e, et le manque de surveillance dans cette loi. Nous avons \u00e9galement inclus bon nombre de ces probl\u00e8mes dans notre contestation constitutionnelle.<\/p>\n<p>Le projet de loi C-59 modifie le concept de partage d&#039;informations en divulgation d&#039;informations\u2014une distinction visant \u00e0 souligner qu&#039;aucune nouvelle information n&#039;est recueillie par le gouvernement, mais que l&#039;information pr\u00e9c\u00e9demment d\u00e9tenue est divulgu\u00e9e \u00e0 des fins de s\u00e9curit\u00e9. Les nouvelles r\u00e9formes visent \u00e0 assurer une certaine protection de la vie priv\u00e9e en limitant la divulgation de renseignements personnels aux cas qui sont \u00ab\u00a0raisonnablement n\u00e9cessaires\u00a0\u00bb \u00e0 des fins de s\u00e9curit\u00e9. Il essaie \u00e9galement de fournir une d\u00e9finition plus contenue et raisonnable de la \u00ab s\u00e9curit\u00e9 \u00bb et d&#039;ajouter une certaine surveillance qui, selon l&#039;ACLC, \u00e9tait absente du projet de loi C-51. Cependant, les r\u00e9formes ne font pas assez pour limiter la quantit\u00e9 d&#039;informations pouvant \u00eatre transmises aux agences de s\u00e9curit\u00e9, ce qui ne devrait se produire qu&#039;exceptionnellement. De plus, les modifications propos\u00e9es \u00e0 ce qui constitue des \u00ab\u00a0activit\u00e9s qui compromettent la s\u00e9curit\u00e9 du Canada\u00a0\u00bb (le \u00ab\u00a0d\u00e9clencheur\u00a0\u00bb pour le partage d&#039;informations en premier lieu) ne font rien pour dissiper la conviction de l&#039;ACLC que cette disposition reste trop g\u00e9n\u00e9rale.<\/p>\n<p>Tout aussi probl\u00e9matique, l&#039;exemption durement gagn\u00e9e pour le plaidoyer, la protestation, la dissidence ou l&#039;expression artistique est \u00e9dulcor\u00e9e par l&#039;ajout de la phrase \u00ab\u00a0\u00e0 moins qu&#039;elle ne soit exerc\u00e9e en conjonction avec une activit\u00e9 qui compromet la s\u00e9curit\u00e9 du Canada\u00a0\u00bb. \u00c9tant donn\u00e9 que l&#039;une des activit\u00e9s susceptibles de nuire \u00e0 la s\u00e9curit\u00e9 implique une interf\u00e9rence avec les infrastructures, les manifestants anti-pipeline sont-ils toujours sujets \u00e0 la divulgation d&#039;informations ? Un site Web documentant les violations des droits humains d&#039;un alli\u00e9 canadien affecterait-il la s\u00e9curit\u00e9 d&#039;un autre \u00c9tat et justifierait-il donc le partage d&#039;informations sur le cr\u00e9ateur du site avec un gouvernement \u00e9tranger\u00a0? Tel que C-59 est actuellement libell\u00e9, ces exemples sont des cas de protestation et de plaidoyer qui pourraient entrer dans la d\u00e9finition large d&#039;une activit\u00e9 \u00ab qui compromet la s\u00e9curit\u00e9 du Canada \u00bb. En d&#039;autres termes, le\u00a0<i>Loi sur la divulgation de la s\u00e9curit\u00e9 du Canada\u00a0<\/i>(SCIDA) est encore trop large et continue de menacer une participation d\u00e9mocratique significative et vitale.<\/p>\n<p>Que nous l&#039;appelions partage ou divulgation, il reste encore du travail \u00e0 faire pour s&#039;assurer que nous parvenons \u00e0 un r\u00e9gime qui favorise la s\u00e9curit\u00e9 tout en prot\u00e9geant les droits.<\/p>\n<p><strong><a href=\"https:\/\/ccla.org\/fr\/?p=27988\" target=\"_blank\" rel=\"noopener\">VISITEZ NOTRE PROJET DE LOI C-59 : FAITES-LE BIEN !
