Le C-59 envisage deux cadres distincts mais li\u00e9s pour la collecte de renseignements : un pour le SCRS et un pour le CST. Les deux permettent l&#039;accumulation et l&#039;analyse non cibl\u00e9es et quasi illimit\u00e9es de millions de donn\u00e9es, la d\u00e9finition m\u00eame de la collecte en masse et de la surveillance de masse.<\/p>\n<p>Des changements au\u00a0<i>Loi sur le SCRS<\/i>\u00a0cr\u00e9er un cadre complexe pour la collecte, l&#039;utilisation, la conservation, l&#039;analyse et la gestion des \u00ab\u00a0ensembles de donn\u00e9es\u00a0\u00bb, avec certaines garanties, notamment l&#039;exigence d&#039;une approbation minist\u00e9rielle et judiciaire pour certains types de donn\u00e9es canadiennes. Cependant, l&#039;une des parties les plus troublantes des nouvelles dispositions relatives aux ensembles de donn\u00e9es est une exception aux protections g\u00e9n\u00e9rales des ensembles de donn\u00e9es concernant principalement les Canadiens ou les personnes au Canada\u00a0: si les donn\u00e9es sont consid\u00e9r\u00e9es comme \u00ab\u00a0disponibles publiquement\u00a0\u00bb, alors leur collecte est \u00e9quitable, sans mandat. Dans certains cas, cette collecte doit \u00eatre \u00ab strictement n\u00e9cessaire \u00bb \u2014 mais dans d&#039;autres, elle doit seulement \u00eatre jug\u00e9e \u00ab pertinente \u00bb aux devoirs et fonctions du SCRS. Le terme \u00ab\u00a0ensemble de donn\u00e9es accessibles au public\u00a0\u00bb est un terme d\u00e9fini de mani\u00e8re quelque peu circulaire dans la Loi, ce qui donne au SCRS une tr\u00e8s large occasion de s&#039;engager dans la collecte inutile et disproportionn\u00e9e de renseignements sur des individus innocents.<\/p>\n<p>La r\u00e9tention est un tout autre probl\u00e8me. Dans un r\u00e9cent\u00a0<a href=\"http:\/\/cas-cdc-www02.cas-satj.gc.ca\/rss\/DES%20(warrant)%20nov-3-2016%20public%20judgment%20FINAL%20(ENG).pdf\" target=\"_blank\" rel=\"noopener\">Tribunal f\u00e9d\u00e9ral<\/a>\u00a0Dans cette affaire, le SCRS a \u00e9t\u00e9 reconnu coupable d&#039;avoir gard\u00e9 ill\u00e9galement des renseignements sur des milliers de Canadiens innocents longtemps apr\u00e8s que cela \u00e9tait n\u00e9cessaire, et d&#039;avoir manqu\u00e9 \u00e0 son obligation de franchise envers la Cour en retenant ce fait. Les dispositions sur les ensembles de donn\u00e9es dans C-59 semblent rendre exactement ce type de collecte et de conservation de donn\u00e9es l\u00e9gal.<\/p>\n<p>La\u00a0<i>Loi sur le CST<\/i>\u00a0les changements sont complexes. D&#039;une part, le CST est tenu d&#039;agir de mani\u00e8re proportionn\u00e9e (et sous r\u00e9serve de l&#039;approbation du ministre et du commissaire au renseignement nouvellement cr\u00e9\u00e9) dans bon nombre de ses pratiques de collecte d&#039;informations. D&#039;autre part, le\u00a0<i>Loi sur le CST<\/i>\u00a0semble consid\u00e9rer l&#039;acquisition en masse de donn\u00e9es - \u00ab\u00a0non s\u00e9lectionn\u00e9es\u00a0\u00bb dans la terminologie du\u00a0<i>Acte<\/i>\u2014 aussi raisonnables et proportionn\u00e9s que si ces activit\u00e9s ne sont pas dirig\u00e9es contre des Canadiens et des personnes au Canada. Ce m\u00e9pris de la vie priv\u00e9e de tous les non-Canadiens \u00e0 l&#039;\u00e9tranger est incompatible avec le droit international des droits de la personne. Les\u00a0<i>Loi sur le CST<\/i>Les tentatives de prot\u00e9ger la vie priv\u00e9e des Canadiens ne sont pas non plus une raison de rassurer. Le nouveau r\u00e9gime laisse intacte la capacit\u00e9 de l&#039;\u00c9tablissement de recueillir et d&#039;utiliser des donn\u00e9es canadiennes tant que ses activit\u00e9s sont \u00ab dirig\u00e9es \u00bb ailleurs, et cette protection ne s&#039;applique qu&#039;\u00e0 deux des cinq mandats propos\u00e9s par le CST. La capacit\u00e9 du CST \u00e0 recueillir des millions de points de donn\u00e9es sur les Canadiens sous ce genre de r\u00e9gime est d\u00e9j\u00e0 bien document\u00e9e, en particulier \u00e0 la suite des r\u00e9v\u00e9lations de Snowden.<\/p>\n<p>Plus pr\u00e9occupant encore, le\u00a0<i>Loi sur le CST<\/i>\u00a0introduit de nouvelles exceptions qui permettent \u00e0 l&#039;agence de percevoir m\u00eame\u00a0<i>Suite\u00a0<\/i>donn\u00e9es canadiennes. Tout comme les dispositions sur les ensembles de donn\u00e9es de la Loi sur le SCRS, la nouvelle Loi sur le CST cr\u00e9erait \u00e9galement une exception lui permettant de diriger ses activit\u00e9s vers les Canadiens ou les personnes au Canada en ce qui concerne la collecte de \u00ab\u00a0renseignements accessibles au public\u00a0\u00bb. La port\u00e9e de ces informations est largement d\u00e9finie, y compris les informations \u00ab\u00a0qui ont \u00e9t\u00e9 publi\u00e9es ou diffus\u00e9es pour la consommation publique, sont accessibles au public sur l&#039;infrastructure mondiale de l&#039;information ou autrement ou sont disponibles au public sur demande, par abonnement ou par achat\u00a0\u00bb. Pour une agence qui n&#039;est pas cens\u00e9e diriger ses activit\u00e9s vers les Canadiens ou les personnes au Canada pour commencer, la cr\u00e9ation d&#039;une exception qui facilite la collecte de chaque \u00e9l\u00e9ment d&#039;information canadienne en ligne qui peut \u00eatre trouv\u00e9, demand\u00e9 ou achet\u00e9 (dans presque n&#039;importe quel format , de presque n&#039;importe quelle source, \u00e0 travers tous les aspects de l&#039;infrastructure mondiale de l&#039;information) est profond\u00e9ment troublant.<\/p>\n<p>Le gouvernement f\u00e9d\u00e9ral n&#039;a pas encore fait valoir que ce type de pratiques de collecte de donn\u00e9es en masse est soit n\u00e9cessaire, soit proportionn\u00e9, et l&#039;exp\u00e9rience nous a appris qu&#039;en mati\u00e8re de terrorisme et de s\u00e9curit\u00e9 nationale, de plus grosses meules de foin ne sont pas synonymes de meilleurs aimants pour localiser cette \u00e9pingle emb\u00eatante. De plus, l&#039;ACLC craint que l&#039;inclusion d&#039;informations disponibles \u00ab\u00a0par achat\u00a0\u00bb dans la d\u00e9finition de \u00ab\u00a0accessible au public\u00a0\u00bb puisse encourager la cr\u00e9ation de march\u00e9s gris douteux pour les donn\u00e9es ou \u00e9tablir des incitations probl\u00e9matiques pour rendre plus d&#039;informations personnelles sur les Canadiens et les personnes au Canada achetables dans le premi\u00e8re place.<\/p>\n<p><strong><a href=\"https:\/\/ccla.org\/fr\/?p=27988\" target=\"_blank\" rel=\"noopener\">VISITEZ NOTRE PROJET DE LOI C-59 : FAITES-LE BIEN !
