Dans notre contestation constitutionnelle, l&#039;ACLC soutient qu&#039;il n&#039;y a pas suffisamment de protection pour une proc\u00e9dure r\u00e9guli\u00e8re int\u00e9gr\u00e9e dans le\u00a0<i>Acte.\u00a0<\/i>Compte tenu des cons\u00e9quences tr\u00e8s graves qu&#039;une incapacit\u00e9 de voyager peut avoir sur une personne, il s&#039;agit d&#039;un probl\u00e8me important qui doit \u00eatre r\u00e9solu.<\/p>\n<p>C-59 apporte quelques ajustements au\u00a0<i>Acte<\/i>, mais il est loin de le r\u00e9parer.<\/p>\n<p>Dans ses documents d&#039;information, le gouvernement a d\u00e9clar\u00e9 que les modifications apport\u00e9es \u00e0 SATA sont des mesures palliatives et a laiss\u00e9 entendre que des remaniements plus substantiels sont \u00e0 venir. Cependant, SATA est la loi que nous avons, et elle affecte les gens en ce moment, donc les solutions sont \u00e9galement n\u00e9cessaires maintenant.<\/p>\n<p>L&#039;ACLC estime que les seuils de suspicion qui permettent au ministre de la S\u00e9curit\u00e9 publique d&#039;inscrire quelqu&#039;un sur la liste sont trop bas, que l&#039;incapacit\u00e9 pour une personne de savoir qu&#039;elle est sur la liste est injuste et d\u00e9raisonnable, et que le processus d&#039;appel qui permet d&#039;avoir des preuves secr\u00e8tes consid\u00e9r\u00e9, sans avocat sp\u00e9cial pour prot\u00e9ger les droits de la personne concern\u00e9e, nie d&#039;importants droits \u00e0 une proc\u00e9dure r\u00e9guli\u00e8re.<\/p>\n<p>C-59 apporte deux petites corrections \u00e0 la loi sur l&#039;interdiction de vol. En vertu de la l\u00e9gislation propos\u00e9e, les parents pourront \u00eatre inform\u00e9s si leur enfant ou pupille est\u00a0<i>ne pas\u00a0<\/i>sur la liste, ce qui est un changement bienvenu mais ne r\u00e9sout gu\u00e8re le probl\u00e8me des enfants plac\u00e9s \u00e0 tort sur la liste d&#039;interdiction de vol. Le processus d&#039;appel est \u00e9galement l\u00e9g\u00e8rement am\u00e9lior\u00e9. La loi actuelle dit qu&#039;en cas d&#039;appel, si le ministre ne r\u00e9pond pas \u00e0 une demande de radiation de la liste dans les 90 jours, il est r\u00e9put\u00e9 avoir refus\u00e9 de radier cette personne. Dans la nouvelle loi, s&#039;il ne r\u00e9pond pas dans les 120 jours, il est r\u00e9put\u00e9 avoir accept\u00e9 la demande.<\/p>\n<p><strong><a href=\"https:\/\/ccla.org\/fr\/?p=27988\" target=\"_blank\" rel=\"noopener\">VISITEZ NOTRE PROJET DE LOI C-59 : FAITES-LE BIEN !
