L'une des dispositions les plus clairement inconstitutionnelles de C-51 \u00e9tait une\u00a0Code criminel\u00a0<\/i>amendement qui a cr\u00e9\u00e9 une nouvelle infraction consistant \u00e0 sciemment \u00ab pr\u00e9coniser ou promouvoir la commission d'infractions terroristes en g\u00e9n\u00e9ral \u00bb et une d\u00e9finition large correspondante de la \u00ab propagande terroriste \u00bb. La nouvelle infraction, passible d'une peine pouvant aller jusqu'\u00e0 cinq ans de prison, n'exige m\u00eame pas que l'orateur ait l'intention que tout acte terroriste r\u00e9sulte du discours en question. Il exige seulement que le discours soit prononc\u00e9 avec insouciance quant \u00e0 savoir si une infraction de terrorisme pourrait en r\u00e9sulter (ce qui est une norme juridique tr\u00e8s faible). En outre, le terme \u00ab\u00a0infractions de terrorisme en g\u00e9n\u00e9ral\u00a0\u00bb n'est d\u00e9fini nulle part dans le\u00a0Code criminel,\u00a0<\/i>laissant cette phrase ouverte \u00e0 un certain nombre d'interpr\u00e9tations.<\/p>\n

L'ACLC croit<\/a>\u00a0que celles-ci\u00a0Code criminel\u00a0<\/i>dispositions constituent une limite injustifiable \u00e0 la\u00a0chartes<\/i>la garantie de la libert\u00e9 d'expression. En effet, le discours interdit \u2013 englobant potentiellement toutes les d\u00e9clarations priv\u00e9es ou publiques concernant les \u00ab infractions terroristes en g\u00e9n\u00e9ral \u00bb \u2013 a une port\u00e9e exceptionnellement large et est beaucoup trop vague pour \u00eatre une cat\u00e9gorie d\u00e9finissable. L'ACLC craignait que cela ne cr\u00e9e un crit\u00e8re hautement subjectif \u00e0 appliquer par les tribunaux pour d\u00e9terminer si le discours d'un individu faisait la promotion d'infractions terroristes \u00ab en g\u00e9n\u00e9ral \u00bb \u2014 les journalistes, par exemple, craignaient que la diffusion d'un extrait de film comme la vid\u00e9o r\u00e9alis\u00e9e par la Colline du Parlement tireur en 2015 enfreindrait la loi. Des inqui\u00e9tudes ont \u00e9galement \u00e9t\u00e9 exprim\u00e9es quant \u00e0 savoir si ces dispositions auraient un effet dissuasif sur les personnes engag\u00e9es dans des tentatives de pr\u00e9vention et de lutte contre le terrorisme, telles que les efforts de d\u00e9radicalisation communautaire.<\/p>\n

C-59 supprime compl\u00e8tement l'expression \u00ab\u00a0infractions de terrorisme en g\u00e9n\u00e9ral\u00a0\u00bb et remplace l'infraction pour ne s'appliquer que lorsqu'une personne \u00ab\u00a0conseille sp\u00e9cifiquement \u00e0 une autre personne de commettre une infraction de terrorisme\u00a0\u00bb. Les d\u00e9lits de conseil existent \u00e0 d'autres endroits dans la loi - il existe une structure juridique plus claire et plus appropri\u00e9e qui les entoure, et ce changement limite le risque d'incertitude, de port\u00e9e excessive ou d'effet paralysant sur le discours prot\u00e9g\u00e9. Dans ce seul domaine du C-59, les changements qui devaient \u00eatre apport\u00e9s ont \u00e9t\u00e9 int\u00e9gr\u00e9s au nouveau projet de loi.
