Bien que le projet de loi C-59 apporte des am\u00e9liorations notables au paysage canadien de la s\u00e9curit\u00e9 nationale, il ne r\u00e9sout pas non plus un certain nombre de probl\u00e8mes graves cr\u00e9\u00e9s ou exacerb\u00e9s par la\u00a0<a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/AnnualStatutes\/2015_20\/\" target=\"_blank\" rel=\"noopener\"><em>Loi antiterroriste de 2015<\/em><\/a>. En outre, il introduit de nouvelles dispositions qui peuvent mettre en p\u00e9ril ou miner les protections constitutionnelles garanties dans le\u00a0<em>canadien<\/em>\u00a0<em>Charte des droits et libert\u00e9s<\/em>.<\/p>\n<p>\u00c0 notre avis, de nombreux aspects du projet de loi C-59 n\u00e9cessitent des modifications substantielles, afin \u00e0 la fois de r\u00e9sister \u00e0 un examen constitutionnel et de prot\u00e9ger ad\u00e9quatement les droits et la s\u00e9curit\u00e9 de toutes les personnes au Canada. Le projet de loi est la tentative la plus compl\u00e8te de modernisation de la loi canadienne sur la s\u00e9curit\u00e9 nationale au cours des trente derni\u00e8res ann\u00e9es. Ne pas r\u00e9soudre des probl\u00e8mes critiques de longue date est une occasion que le Canada ne peut pas se permettre de manquer.<\/p>\n<p>Le nouveau propos\u00e9\u00a0<em>Loi sur l&#039;Agence de surveillance de la s\u00e9curit\u00e9 nationale et du renseignement<\/em>\u00a0et la Loi sur le commissaire au renseignement visent toutes deux \u00e0 cr\u00e9er de nouvelles mesures de responsabilisation pour assurer l&#039;examen et la surveillance des agences impliqu\u00e9es dans la s\u00e9curit\u00e9 nationale. Nos recommandations visent \u00e0 renforcer ces nouveaux organes et \u00e0 combler les lacunes importantes du cadre propos\u00e9.<\/p>\n<p>La proposition\u00a0<em>Loi sur le Centre de la s\u00e9curit\u00e9 des t\u00e9l\u00e9communications<\/em>\u2014une nouvelle loi habilitante pour le CST\u2014 est la bienvenue. Nos recommandations se concentrent sur les pr\u00e9occupations concernant le nouvel aspect des cyberop\u00e9rations actives du mandat du CST, la d\u00e9finition large des \u00ab informations accessibles au public \u00bb et les lacunes en mati\u00e8re de surveillance et de d\u00e9claration des activit\u00e9s du CST.<\/p>\n<p>Le projet de loi C-59 maintient les pouvoirs de r\u00e9duction de la menace dans le\u00a0<em>Loi sur le Service canadien du renseignement de s\u00e9curit\u00e9<\/em>, tout en cr\u00e9ant un nouveau r\u00e9gime d&#039;ensembles de donn\u00e9es pour le SCRS. Nos recommandations visent \u00e0 assurer<br \/>\nque des ensembles de donn\u00e9es sont recueillis dans le cadre du mandat du SCRS et qu&#039;il existe des m\u00e9canismes ad\u00e9quats de tenue de dossiers et de reddition de comptes. L&#039;ACLC continue de se demander si la n\u00e9cessit\u00e9 de<br \/>\nles pouvoirs de r\u00e9duction de la menace ont \u00e9t\u00e9 d\u00e9montr\u00e9s, mais reconnaissent les am\u00e9liorations apport\u00e9es au r\u00e9gime \u00e9tabli initialement par le projet de loi C-51.<\/p>\n<p>Le projet de loi C-59 propose des modifications substantielles \u00e0 la\u00a0<em>Loi sur l&#039;\u00e9change de renseignements sur la s\u00e9curit\u00e9 du Canada<\/em>\u00a0(LCISC), mais ceux-ci ne r\u00e9solvent pas les probl\u00e8mes identifi\u00e9s lors de la pr\u00e9sentation du projet de loi C-51 et dans l&#039;\u00e9tude subs\u00e9quente. Nos recommandations proposent des changements au d\u00e9clencheur de divulgation et aux seuils de divulgation et de conservation. Nous abordons \u00e9galement<br \/>\nles lacunes dans les mesures de responsabilisation et le besoin de clart\u00e9 concernant l&#039;interaction de la LCISC avec la Loi sur la protection des renseignements personnels.<\/p>\n<p>Les manquements proc\u00e9duraux importants de la\u00a0<em>Loi sur la s\u00e9curit\u00e9 du transport a\u00e9rien<\/em>, qui peuvent avoir des effets d\u00e9vastateurs sur la vie d&#039;innocents, n&#039;ont pas \u00e9t\u00e9 corrig\u00e9s de mani\u00e8re ad\u00e9quate. Notre<br \/>\nles recommandations augmenteraient le seuil d&#039;inscription et am\u00e9lioreraient le cadre d&#039;appel disponible pour ceux qui souhaitent contester leur statut d&#039;inscription.<\/p>\n<p>En relation avec le\u00a0<em>Code criminel<\/em>\u00a0amendements, nous formulons des recommandations sur des questions allant de la liste des entit\u00e9s terroristes aux dispositions relatives aux discours et \u00e0 la propagande terroristes en passant par les obligations de ne pas troubler l&#039;ordre public et les dispositions relatives aux arrestations sans mandat. Dans chaque cas, notre souci est de veiller \u00e0 ce que le droit p\u00e9nal soit d\u00e9ploy\u00e9 de mani\u00e8re \u00e0 pr\u00e9venir les menaces terroristes, tout en respectant<br \/>\ndroits fondamentaux de la Charte.<\/p>\n<p>Enfin, \u00e9tant donn\u00e9 que le Comit\u00e9 peut proposer des modifications hors de la port\u00e9e actuelle du projet de loi, nous recommandons que les modifications apport\u00e9es \u00e0 la Loi sur l&#039;immigration et la protection des r\u00e9fugi\u00e9s<br \/>\npar le projet de loi C-51 devrait \u00eatre abrog\u00e9.
