Le projet de loi C-46 \u00e9tait une recette pour le profilage racial et un affront \u00e0 notre libert\u00e9 fondamentale \u2014 le droit de ne pas subir de test sanguin\/urine\/haleine sans motif.\n<\/p><\/blockquote>\n<p><strong>Dans les nouvelles<\/strong>:\u00a0<a href=\"https:\/\/ipolitics.ca\/2018\/05\/24\/senators-drop-mandatory-alcohol-screening-from-impaired-driving-bill\/\" target=\"_blank\" rel=\"noopener\">Les s\u00e9nateurs abandonnent le d\u00e9pistage obligatoire de l&#039;alcool dans le projet de loi sur la conduite avec facult\u00e9s affaiblies<\/a><\/p>\n<p>La police devrait-elle avoir le pouvoir d&#039;exiger un alcootest sans motif ni soup\u00e7on d&#039;acte r\u00e9pr\u00e9hensible\u00a0?<\/p>\n<p>Le 18 septembre 2017, le directeur de la s\u00e9curit\u00e9 publique de l&#039;ACLC, Rob De Luca, a pr\u00e9sent\u00e9 des m\u00e9moires au nom de l&#039;ACLC au Comit\u00e9 permanent de la justice et des droits de la personne de la Chambre des communes afin d&#039;aborder plusieurs sujets de pr\u00e9occupation concernant le nouveau projet de loi du gouvernement sur la conduite avec facult\u00e9s affaiblies, notamment les pr\u00e9occupations concernant la dispositions du projet de loi qui autoriseraient les tests d&#039;haleine al\u00e9atoires, augmenteraient les amendes minimales obligatoires et les peines maximales admissibles, et fourniraient \u00e0 la Couronne des \u00ab raccourcis \u00bb pour prouver qu&#039;un accus\u00e9 a commis une infraction de conduite avec facult\u00e9s affaiblies par la drogue.<\/p>\n<p>Bien que l&#039;Association canadienne des libert\u00e9s civiles appuie l&#039;objectif primordial du projet de loi C-46, nous consid\u00e9rons que bon nombre des changements sugg\u00e9r\u00e9s s&#039;inscrivent dans la continuit\u00e9 des pr\u00e9c\u00e9dentes r\u00e9formes de la justice p\u00e9nale malavis\u00e9es, et parfois inconstitutionnelles, \u00ab s\u00e9v\u00e8res \u00e0 l&#039;\u00e9gard du crime \u00bb qui ne feraient pas grand-chose ou rien pour lutter contre la conduite avec facult\u00e9s affaiblies. Nous avons exprim\u00e9 une inqui\u00e9tude particuli\u00e8re quant \u00e0 l&#039;impact que les tests d&#039;haleine al\u00e9atoires auront sur les personnes issues des communaut\u00e9s minoritaires. La proposition actuelle ne limiterait pas les alcootests al\u00e9atoires \u2013 c&#039;est-\u00e0-dire les alcootests qui pourraient \u00eatre exig\u00e9s par la police sans raison \u2013 aux points de contr\u00f4le fixes, o\u00f9 le pouvoir discr\u00e9tionnaire est restreint et donc le risque de profilage racial ou d&#039;autres exercices inappropri\u00e9s des pouvoirs de la police est r\u00e9duit.
