Le projet de loi 175, tel que modifi\u00e9 par le comit\u00e9, et tel qu&#039;il a \u00e9t\u00e9 adopt\u00e9 en troisi\u00e8me lecture se trouve\u00a0<a href=\"http:\/\/www.ontla.on.ca\/bills\/bills-files\/41_Parliament\/Session2\/b175rep_e.pdf\" target=\"_blank\" rel=\"noopener\">ici<\/a>.\n<\/p><\/blockquote>\n<p>Hier, le gouvernement provincial de l&#039;Ontario a conclu ses audiences du Comit\u00e9 sur la\u00a0<em>Loi pour un Ontario plus s\u00fbr<\/em>, une loi qui apporterait des changements importants au syst\u00e8me de surveillance et de responsabilisation de la police de l&#039;Ontario. L&#039;ACLC a comparu devant le Comit\u00e9 pour recommander plusieurs modifications n\u00e9cessaires \u00e0 la l\u00e9gislation propos\u00e9e.<\/p>\n<p>L&#039;Association canadienne des libert\u00e9s civiles milite depuis longtemps pour une r\u00e9forme des services de police en Ontario. Pendant des d\u00e9cennies, le maintien de l&#039;ordre dans la province a \u00e9t\u00e9 en proie \u00e0 des d\u00e9ficits de responsabilit\u00e9, de surveillance et de transparence. Une refonte l\u00e9gislative de l&#039;ancienne loi ontarienne\u00a0<em>Loi sur les services policiers<\/em>\u00a0est n\u00e9cessaire pour commencer \u00e0 combler ces d\u00e9ficits.<\/p>\n<p>La\u00a0<em>Loi pour un Ontario plus s\u00fbr<\/em>\u00a0tente principalement de renforcer la responsabilisation, la surveillance et la transparence en Ontario en mettant en \u0153uvre la majorit\u00e9 des recommandations du juge Tulloch dans son\u00a0<a href=\"https:\/\/www.attorneygeneral.jus.gov.on.ca\/english\/about\/pubs\/police_oversight_review\/\" target=\"_blank\" rel=\"noopener\"><em>Rapport de l&#039;examen ind\u00e9pendant de contr\u00f4le de la police<\/em><\/a>. Cependant, les recommandations du juge Tulloch d\u00e9coulent de consultations publiques qui ont r\u00e9v\u00e9l\u00e9 des niveaux alarmants de m\u00e9fiance \u00e0 l&#039;\u00e9gard des services de police de l&#039;Ontario et de leurs organismes de surveillance et de responsabilisation, y compris une pr\u00e9occupation g\u00e9n\u00e9ralis\u00e9e concernant la discrimination syst\u00e9mique dans les services de police de l&#039;Ontario. Alors que bon nombre des\u00a0<em>Loi sur un Ontario plus s\u00fbr<\/em>\u00a0les r\u00e9formes propos\u00e9es pourraient aider \u00e0 s&#039;attaquer \u00e0 ce probl\u00e8me omnipr\u00e9sent de m\u00e9fiance, des efforts substantiels seront n\u00e9cessaires pour garantir que tout nouvel organisme de contr\u00f4le et de responsabilit\u00e9 soit v\u00e9ritablement ind\u00e9pendant des services de police qu&#039;il supervise. Des efforts substantiels seront \u00e9galement n\u00e9cessaires pour s&#039;assurer que tout nouvel organisme de surveillance et de responsabilit\u00e9 est financ\u00e9 de mani\u00e8re ad\u00e9quate et dispos\u00e9 \u00e0 utiliser les pouvoirs qui lui sont conf\u00e9r\u00e9s.<\/p>\n<p>La principale de nos recommandations est que la l\u00e9gislation propos\u00e9e par le gouvernement devrait \u00eatre modifi\u00e9e afin d&#039;accorder des pouvoirs plus solides aux autorit\u00e9s civiles charg\u00e9es de surveiller les services de police. Les agents publics et les conseils de surveillance doivent jouer un r\u00f4le actif et inform\u00e9 sur les questions qui ont un impact significatif sur les r\u00e9sidents\u00a0<em>chartes<\/em>\u00a0et\u00a0<em>Code<\/em>-des droits prot\u00e9g\u00e9s, comme la pratique du carding ou la question g\u00e9n\u00e9rale du profilage racial ou social. Comme nous le soutenons dans nos m\u00e9moires, les autorit\u00e9s civiles sont souvent inutilement entrav\u00e9es dans leurs obligations de surveillance et de reddition de comptes par les services de police qui soutiennent que les tentatives pour r\u00e9gler ces probl\u00e8mes \u00e9quivaudraient \u00e0 une ing\u00e9rence dans leur ind\u00e9pendance op\u00e9rationnelle.
