This has undoubtedly increased our privacy interest in our cell-phones, particularly from unwanted searches from the police. In this article, I present some leading and other recent Canadian cases regarding one\u2019s reasonable expectation of privacy in their cell phone and the police\u2019s ability to search one\u2019s cell phones without a warrant.<\/p>\n<h3><span style=\"color: #1e5799;\"><strong><u>LEGAL FRAMEWORK<\/u><\/strong><\/span><\/h3>\n<p>Section 8 of the\u00a0<em>Canadian Charter of Rights and Freedoms<\/em>\u00a0provides that:\u00a0\u201cEveryone has the right to be secure against unreasonable search or seizure.\u201d<\/p>\n<p>The s. 8 guarantee, however, is not an absolute right against all searches\u2014 s. 8 protects an individual from only those searches deemed to be \u201cunreasonable\u201d. In\u00a0<em>R v Edwards<\/em>, the Supreme Court of Canada offered the following two-part framework to determine whether s. 8 of the\u00a0<em>Charter<\/em>\u00a0has been violated in a search conducted by the police:<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<ol>\n<li>First, does the individual have a reasonable expectation of privacy with respect to the item in question under the totality of circumstances?<\/li>\n<li>Second, if the individual has a reasonable expectation of privacy, did the police conduct the search reasonably?<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #1e5799;\"><strong><u>CELL PHONES AND A REASONABLE EXPECTATION OF PRIVACY<\/u><\/strong><\/span><\/h3>\n<p>The Canadian jurisprudence has typically found that users of cell-phones containing private and personal information have a reasonable expectation of privacy. That said, it is important to note that a determination of whether an individual has a reasonable expectation of privacy proceeds on a case-by-case basis with regard to the totality of circumstances.<\/p>\n<ul>\n<li>In\u00a0<em>\u00a0v. Polius<\/em>\u00a0(2009), the court found that an individual has a\u00a0reasonable\u00a0expectation\u00a0of privacy\u00a0in the contents of his or her\u00a0cell\u00a0phone since\u00a0\u201c[t]he information in a\u00a0cell\u00a0phone\u00a0\u2026 may relate to aspects of life that are deeply personal.\u201d The information includes photographs, videos, text messages, E-mail messages, call logs, etc.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/li>\n<li><em>v. O. (T.)<\/em>\u00a0(2010) involved an accused who left his cell phone unattended to charge in the stairwell of an apartment building. The phone was subsequently searched by the superintendent of the building and handed to the police for incriminating evidence. The court found that the fact that the phone was in charging and contained private information indicated that the accused intended to retrieve the phone and therefore the phone was not considered abandoned. The court concluded that the accused had a reasonable expectation of privacy in the cell phone based on the fact that it contained highly personal information.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/li>\n<li>In<em>\u00a0v. Artis\u00a0<\/em>(2016), the court noted that exclusive access to one\u2019s cell phone is not required to establish a reasonable\u00a0expectation\u00a0of\u00a0privacy. Accordingly, the fact that the accused shared his cell phone with another person did not itself preclude the accused from maintaining a reasonable expectation of privacy in the content of his or her cell phone.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/li>\n<\/ul>\n<p>Although one has a reasonable expectation to privacy to his or her own cellphone, it was until recently an open question whether one\u2019s reasonable expectation of privacy could extend to the text messages that are sent to a recipient and contained on the recipient\u2019s phone.<\/p>\n<ul>\n<li>In\u00a0<em>R v. Marakah<\/em>\u00a0(2017), the Supreme Court of Canada\u00a0 ruled that an individual may have a reasonable expectation of privacy in an electronic conversation in some cases, and that text messages that have been sent and received may therefore be protected against unreasonable search and seizure\u201d<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/li>\n<li>In\u00a0<em>R. v. Jones<\/em>\u00a0(2017), heard as a companion case to<em>\u00a0Marakah<\/em>, the court considered\u00a0whether the sender of a text message has a reasonable expectation of privacy in records of that message stored in the service provider\u2019s infrastructure. The decision was that there is such an expectation.\u00a0<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #1e5799;\"><strong><u>CELL PHONE AND POLICE SEARCH INCIDENTAL TO ARREST<\/u><\/strong><\/span><\/h3>\n<p>In\u00a0<em>R. v. Fearon<\/em>\u00a0(2014), the Supreme Court of Canada maintained that there is a lower expectation of privacy during times of\u00a0<em>lawful<\/em>\u00a0arrest.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn7\" name=\"_ftnref7\">[7]<\/a>\u00a0Accordingly, the Court found that a police officer may search a cell-phone incidental to an arrest where:<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<ul>\n<li>The arrest was lawful;<\/li>\n<li>[T]he police have a reason based on a valid law enforcement purpose to conduct the search, and that reason is objectively reasonable. The valid law enforcement purposes in this context are:\n<ol>\n<li>Protecting the police, the accused, or the public;<\/li>\n<li>Preserving evidence; or<\/li>\n<li>Discovering evidence, including locating additional suspects, in situations in which the investigation will be stymied or significantly hampered absent the ability to promptly search the\u00a0cellphone\u00a0incident to arrest;<\/li>\n<\/ol>\n<\/li>\n<li>The nature and the extent of the search are tailored to the purpose of the search; and<\/li>\n<li>The police take detailed notes of what they have examined on the device and how it was searched.<\/li>\n<\/ul>\n<p>The Court in\u00a0<em>Fearon<\/em>\u00a0cautioned that the police power to search a cell phone incident to arrest is not a \u201clicense to rummage around in the device at will.\u201d<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn9\" name=\"_ftnref9\">[9]<\/a>\u00a0The Court also held that one\u2019s decision not to protect his or her cell phone with a password does not \u201cindicate any sort of abandonment of the significant privacy interests one generally will have in the contents of the phone.\u201d<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n<p>In\u00a0<em>v. Hiscoe<\/em>\u00a0(2013), the Nova Scotia Court of Appeal upheld a trial judge\u2019s finding that, given the near month-long delay between the initial arrest and the cell-phone search, a complete \u201cdata dump\u201d of all the information contained on the accused cell-phone went\u00a0beyond the scope of a search incident to arrest. The court upheld the trial judge\u2019s finding of a s. 8 violation.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p><em>Hiscoe<\/em>\u00a0was decided prior to\u00a0<em>Fearson<\/em>. Nevertheless, under similar circumstances, the court in\u00a0<em>v. Powell<\/em>\u00a0(2017) also found that the complete \u201cdata dump\u201d of all the information contained on the accused cell-phone conducted thirteen days after the initial arrest\u00a0was beyond the scope of a search incident to arrest.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/p>\n<p>In<em>\u00a0v. Hiscock<\/em>\u00a0(2016),\u00a0the court suggested that although a police officer may seize one\u2019s cell-phone incidental to arrest, the accused is not required to reveal the passcode and any detail about the password must be obtained voluntarily and consensually.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn13\" name=\"_ftnref13\">[13]<\/a><\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #1e5799;\"><strong><u>OTHER<\/u><\/strong><\/span><\/h3>\n<p><em>\u00a0<\/em>In\u00a0<em>R. v. Rogers Communications Partnership\u00a0<\/em>(2016), the court held that Canadians have a reasonable expectation\u00a0of\u00a0privacy\u00a0in the records of their\u00a0cell\u00a0phone\u00a0activity. Accordingly, the court held that the Crown\u2019s production orders (POs) compelling cell phone providers to provide personal information of cell phone users that have used the cell tower nearby 21 addresses given by the police for investigative purposes was overly broad and infringed s. 8 of the\u00a0<em>Charter<\/em>.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n<p><em>\u00a0<\/em>In addition to criminal search powers incident to arrest and search powers authorized by warrants, the Canadian Border Service Agency believe they may also search one\u2019s cell phone upon an exit or entry at the border pursuant to the\u00a0<strong><em>Customs Act<\/em><\/strong><strong>.<\/strong><a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn15\" name=\"_ftnref15\">[15]<\/a><strong>\u00a0\u00a0<\/strong>They base this on an interpretation of\u00a0 s. 99(1)(a) of the\u00a0<em>Customs Act<\/em>\u00a0which states that an officer may<strong>:<\/strong><\/p>\n<p><em>\u00a0<\/em><em>(a) at any time up to the time of release, examine any goods that have been imported and open or cause to be opened any package or container of imported goods and take samples of imported goods in reasonable amounts.<\/em><a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn16\" name=\"_ftnref16\">[16]<\/a><\/p>\n<p>In\u00a0<em>R. v. Gibson<\/em>\u00a0(2017), the court held that the definition of \u201cgoods\u201d included, for the purpose of s. 99(1)(a) of the\u00a0<em>Customs Act<\/em>, data stored in any electronic device, including cell-phones, that is in \u201cactual possession of or in accompanying baggage of traveller at time they arrive at border and commence dealings with customs officers.\u201d<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn17\" name=\"_ftnref17\">[17]<\/a>\u00a0However, \u201cgoods\u201d did not include data that is stored on the cloud or stored remotely on devices that are not in possession of traveller.<a href=\"https:\/\/ccla.org\/cell-phones-canadian-courts-recent-cases\/#_ftn18\" name=\"_ftnref18\">[18]<\/a>\u00a0This definition of a cell phone as a \u201cgood\u201d is challenged by the\u00a0<a href=\"https:\/\/ccla.org\/?p=28747\" target=\"_blank\" rel=\"noopener\">Canadian Civil Liberties Association and others<\/a>.<\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<h3><span style=\"color: #1e5799;\"><strong><u>CELL PHONES AND A REASONABLE EXPECTATION OF PRIVACY<\/u><\/strong><\/span><\/h3>\n<p><strong><u>\u00a0<\/u><\/strong><\/p>\n<ol>\n<li><em>v.
