padding-bottom: calc(100vw * 0.04); \"><div class=\"row-bg-wrap\" data-bg-animation=\"none\" data-bg-animation-delay=\"\" data-bg-overlay=\"false\"><div class=\"inner-wrap row-bg-layer\" ><div class=\"row-bg viewport-desktop\"  style=\"\"><\/div><\/div><\/div><div class=\"row_col_wrap_12 col span_12 dark left\">\n\t<div  class=\"vc_col-sm-12 wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone \"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t<div class=\"divider-wrap\" data-alignment=\"default\"><div style=\"height: 30px;\" class=\"divider\"><\/div><\/div>\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<div class=\"wpb_wrapper\">\n\t\t<p>On 18<sup>th<\/sup>\u00a0March 2020, Newfoundland Health Minister John Haggie,\u00a0<a href=\"https:\/\/www.ctvnews.ca\/health\/coronavirus\/n-l-announces-strict-measures-including-jail-time-to-halt-the-spread-of-covid-19-1.4858499\" target=\"_blank\" rel=\"noopener\">held a press conference<\/a>\u00a0to announce that he had authorized a\u00a0<a href=\"https:\/\/www.gov.nl.ca\/covid-19\/files\/Special-Measures-Order-March-18-2020.pdf\" target=\"_blank\" rel=\"noopener\">Special Measures Order<\/a>\u00a0using the\u00a0<em>Public Health and Promotion Act<\/em>\u00a0to<\/p>\n<ul>\n<li>ban gatherings of more than 50 people;<\/li>\n<li>close facilities (bingo halls, gyms, fitness clubs, bars, cinemas, performance spaces, arenas) and those restaurants that cannot accommodate social distancing; and<\/li>\n<li>require any returning traveller to self-isolate for 14 days.<\/li>\n<\/ul>\n<p>Minister Haggie said that anyone who violated these bans faced \u201csignificant penalties,\u201d which include fines of $2,500 or 6-month jail terms for individuals and up to $50,000 for corporations:\u00a0 \u201cWe hope we never have to use [these penalties], but they exist, and if necessary we will use them.\u201d<\/p>\n<p>On the one hand, it is true that those penalties exist under the law.\u00a0 Nothing new here.\u00a0 However, enforcement and penalizing people are measures of last resort.\u00a0 Moreover, proportionality is important when it comes to enforcement.\u00a0 Rather than threaten people with penalties, de-escalation is always preferable to escalation of anxiety and confrontation.\u00a0 Governments ought to be mindful of the constitutional rights to liberty and freedom of assembly \u2013 these rights may be limited during a public health emergency, but they must always answer the questions:\u00a0 why, when and how will these limitations be put into place, and for how long?\u00a0 Communication and conversation are always going to work better than blanket threats of incarceration, which can only arise if innocent people have been proven guilty pursuant to a fair trial.\u00a0\u00a0<strong>Other First Ministers and Ministers have spoken to the public about emergency orders without going down the rabbit hole of enforcement by arrest, trial and detention.<\/strong>\u00a0 Given the severity of these penalties \u2013 including incarceration, the ultimate deprivation of liberty \u2013 CCLA will monitor the situation to ensure that enforcement of the bans is minimally invasive and not arbitrary.<\/p>\n<p>Furthermore, the province should consider and identify exceptions to the ban on gatherings of more than 50 people. \u00a0Reducing large gatherings is key to slowing the coronavirus, which we have learned from Canada\u2019s excellent public health officers.\u00a0 But there could be exigent circumstances where it may not be appropriate to violate freedom of assembly \u2013 either because it\u2019s bad public health or because it\u2019s a disproportionate violation of civil liberties.<\/p>\n<p>For example, this ban on large gatherings ought not cause people to go hungry.\u00a0 Soup kitchens or food banks are often the only options for the homeless, addicted, or mentally ill to have a meal.
