Cuthbert et chef de la police Palmer,<\/p>\n<p>Je vous \u00e9cris pour exhorter l&#039;Association canadienne des chefs de police \u00e0 jouer un r\u00f4le actif en veillant \u00e0 ce que le public dispose d&#039;informations claires et exactes concernant la port\u00e9e l\u00e9gale des pouvoirs de police d&#039;urgence, ainsi que la transparence dans la fa\u00e7on dont ces pouvoirs sont utilis\u00e9s.<\/p>\n<p>Nous vivons tous une \u00e9poque sans pr\u00e9c\u00e9dent. Les autorit\u00e9s juridiques \u00e9voluent rapidement et les gouvernements ont commenc\u00e9 \u00e0 accorder \u00e0 la police des pouvoirs suppl\u00e9mentaires qui modifient consid\u00e9rablement la port\u00e9e des droits des individus. Ces pouvoirs d&#039;urgence sont complexes et varient selon la juridiction. La clart\u00e9 et la transparence sont primordiales tant pour le public canadien que pour les agents de premi\u00e8re ligne.<\/p>\n<p>Les services de police locaux et le grand public doivent comprendre l&#039;\u00e9tendue et les limites des pouvoirs de la police en cette p\u00e9riode d&#039;urgence. Un manque de clart\u00e9 concernant les r\u00f4les, les autorit\u00e9s et les pouvoirs l\u00e9gaux peut conduire \u00e0 des confrontations inutiles et \u00e0 des abus d&#039;autorit\u00e9 involontaires.<\/p>\n<p>Le public a \u00e9galement besoin de transparence sur la fa\u00e7on dont ces pouvoirs sont utilis\u00e9s pour s&#039;assurer qu&#039;ils continuent d&#039;\u00eatre justifiables, proportionn\u00e9s et exerc\u00e9s l\u00e9galement dans une situation en \u00e9volution rapide.<\/p>\n<p>En tant que voix nationale des services de police canadiens, l&#039;ACCP est particuli\u00e8rement bien plac\u00e9e pour jouer un r\u00f4le central dans cette situation d&#039;urgence. Au Royaume-Uni, le National Police Chiefs Council (NPCC) et le College of Policing s&#039;empressent de donner des conseils aux policiers sur l&#039;\u00e9tendue de leurs pouvoirs apr\u00e8s de nombreux rapports faisant \u00e9tat d&#039;un abus de la police1. Nous demandons respectueusement que l&#039;ACCP aide \u00e0 la fois le public canadien et la police en fournissant des conseils et de la transparence de mani\u00e8re proactive. Plus pr\u00e9cis\u00e9ment, l&#039;ACCP devrait :<\/p>\n<p>Diffuser des directives au public et aux agents de premi\u00e8re ligne clarifiant la port\u00e9e l\u00e9gale des pouvoirs de police d&#039;urgence dans diverses juridictions canadiennes, ainsi que l&#039;utilisation et le stockage licites des renseignements recueillis par la police ou les agents charg\u00e9s de l&#039;application des r\u00e8glements d&#039;urgence aux fins de l&#039;ex\u00e9cution des ordonnances d&#039;urgence\u00a0; Par exemple, garder les renseignements sur les contr\u00f4les de rue COVID s\u00e9par\u00e9s des autres informations collect\u00e9es pour les enqu\u00eates non-COVID\u00a0;<\/p>\n<p>\u00c9tablir des directives sur le stockage et la destruction de ces donn\u00e9es lorsque les commandes d&#039;urgence expirent\u00a0; et<\/p>\n<p>Recueillir et publier des donn\u00e9es sur les avertissements, les amendes, les arrestations et\/ou les accusations de la police et d&#039;autres forces de l&#039;ordre \u00e9mis en vertu de ces pouvoirs d&#039;urgence.<\/p>\n<p>L&#039;ACLC serait heureuse de collaborer \u00e0 ces initiatives de quelque mani\u00e8re que ce soit qui pourrait \u00eatre utile.
