Fini les pouvoirs de perquisition sans mandat et l&#039;interdiction g\u00e9n\u00e9rale des activit\u00e9s religieuses. Plusieurs \u00e9l\u00e9ments sont clarifi\u00e9s et une plus grande proportionnalit\u00e9 ajout\u00e9e. Bref, une bonne nouvelle pour les libert\u00e9s civiles au Nunavut!<\/p>\n<p>8 avril 2020<\/p>\n<p>Hon. Jeannie Hakongak Ehaloak,<br \/>\nMinistre de la justice et procureur g\u00e9n\u00e9ral<br \/>\nGouvernement du Nunavut<br \/>\nCase postale 1000 Poste 200<br \/>\nIqualuit, Nunavut X0A0H0<br \/>\nPAR EMAIL<\/p>\n<p><strong>Re: Ordonnance du 20 mars 2020 restreignant les rassemblements de masse<\/strong><\/p>\n<p>Cher Ministre,<\/p>\n<p>L&#039;Association canadienne des libert\u00e9s civiles vous \u00e9crit au sujet de la <a href=\"https:\/\/ccla.org\/wp-content\/uploads\/2021\/06\/order_re_mass_gatherings_final_v2signed.pdf\" target=\"_blank\" rel=\"noopener\">Ordonnance de sant\u00e9 publique du 20 mars 2020 restreignant les rassemblements de masse, dont nous joignons copie<\/a>. Nous craignons s\u00e9rieusement que l&#039;ordonnance ne soit inconstitutionnelle. Bien que nous comprenions que la gestion de la sant\u00e9 publique au Nunavut m\u00e9rite le respect de l&#039;expertise locale, la constitution \u00e9tablit une norme plus \u00e9lev\u00e9e de n\u00e9cessit\u00e9, de clart\u00e9 et de proportionnalit\u00e9 pour les ordonnances que celle que l&#039;on trouve dans celle sign\u00e9e par le Dr Patterson. Cette ordonnance limite les droits et libert\u00e9s constitutionnels des personnes d&#039;une mani\u00e8re trop large, parfois irrationnelle et disproportionn\u00e9e.<\/p>\n<p>Par exemple, il semblerait qu&#039;il interdise un cercle de pri\u00e8re de deux personnes. Il limite sp\u00e9cifiquement et d\u00e9lib\u00e9r\u00e9ment la libert\u00e9 de religion sans aucune exception. C&#039;est une chose de limiter les grandes \u00e9glises ou les rassemblements spirituels parce qu&#039;il s&#039;agit de grands rassemblements de personnes. C&#039;en est une autre de les limiter parce qu&#039;ils sont religieux. Cet ordre fait ce dernier. Il est inconstitutionnel \u00e0 premi\u00e8re vue, m\u00eame s&#039;il pourrait \u00eatre modifi\u00e9 de mani\u00e8re \u00e0 atteindre l&#039;objectif auquel je peux deviner mais que je ne peux pas voir dans l&#039;ordre lui-m\u00eame.<\/p>\n<p>L&#039;interdiction g\u00e9n\u00e9rale de \u00ab\u00a0tous les rassemblements publics\u00a0\u00bb, sans d\u00e9finir ni \u00ab\u00a0publics\u00a0\u00bb (versus priv\u00e9s\u00a0?) ou \u00ab\u00a0rassemblements\u00a0\u00bb (sociaux ou r\u00e9cr\u00e9atifs\u00a0?) Il semble interdire \u00e0 un h\u00f4pital d&#039;exister. Un rassemblement public est-il compos\u00e9 de deux personnes, ou de 20, 50, 100\u00a0? Encore une fois, cette disposition pourrait facilement \u00eatre modifi\u00e9e pour clarifier et pr\u00e9ciser ce qui est vis\u00e9 ici par l&#039;administrateur en chef de la sant\u00e9 publique, car \u00e0 compter d&#039;aujourd&#039;hui, cette ordonnance peut \u00eatre nulle pour cause d&#039;impr\u00e9cision.<\/p>\n<p>Plus pr\u00e9occupantes sont les ordonnances autorisant l&#039;entr\u00e9e sans mandat dans les locaux. Premi\u00e8rement, la loi sous-jacente autorisant cette ordonnance n&#039;est pas assez large pour permettre \u00e0 un agent territorial de la sant\u00e9 publique d&#039;autoriser l&#039;entr\u00e9e sans mandat d&#039;agents de la paix. Bien que nous puissions \u00eatre en d\u00e9saccord sur ce point, il vaut la peine d&#039;y jeter un deuxi\u00e8me coup d&#039;\u0153il, dans notre respectueuse soumission.<\/p>\n<p>Deuxi\u00e8mement, les conditions ne r\u00e9sistent m\u00eame pas \u00e0 un examen respectueux de la Charte. Comme vous le savez, le crit\u00e8re juridique permettant l&#039;entr\u00e9e sans mandat est celui des \u00ab\u00a0circonstances urgentes\u00a0\u00bb, comme un agent qui voit une arme \u00e0 feu sur la t\u00eate de quelqu&#039;un par la fen\u00eatre avant. Le libell\u00e9 des articles 3 et 4 de l&#039;arr\u00eat\u00e9 de sant\u00e9 publique du 20 mars n&#039;est pas analogue \u00e0 un coup de poing sur la t\u00eate.<\/p>\n<p>Le langage employ\u00e9 par l&#039;ordonnance du Dr Patterson sur ce front est tout simplement trop ambigu, peut-\u00eatre m\u00eame incompr\u00e9hensible\u00a0: \u00ab\u00a0le logement, ou quelque chose dans ou uniquement accessible par le logement, est un risque grave et imm\u00e9diat pour la sant\u00e9 publique\u00a0\u00bb. Une habitation en elle-m\u00eame ne peut constituer un risque grave pour la sant\u00e9 publique, \u00e0 moins qu&#039;il n&#039;y ait des preuves de contamination et des preuves que le public va entrer dans cette habitation. Il n&#039;y a aucun moyen pour un agent de la paix de savoir si une propri\u00e9t\u00e9 ou son contenu est contamin\u00e9, sans avoir l&#039;\u00e9quipement d&#039;essai pertinent sur place et sans transmettre ses conclusions \u00e0 l&#039;agent de la paix. De plus, les circonstances de l&#039;entr\u00e9e du grand public dans un logement contamin\u00e9 sont absurdes ou du moins obscures.<\/p>\n<p>De plus, l&#039;expression \u00ab\u00a0risque grave et imm\u00e9diat pour la sant\u00e9 publique\u00a0\u00bb est trop large, incluant tout, de la contamination \u00e0 la grippe \u00e0 la fabrication d&#039;opiac\u00e9s. Des circonstances urgentes impliquent un danger imminent pour les personnes, et non pour les biens. Il n&#039;est pas clair pour nous si une juridiction avec un taux d&#039;infection de COVID19 aussi faible \u00e0 inexistant pourrait jamais justifier une entr\u00e9e sans mandat en raison d&#039;un risque sp\u00e9culatif pour un concept aussi amorphe que \u00ab\u00a0risque pour la sant\u00e9 publique\u00a0\u00bb.<\/p>\n<p>Enfin, la condition de \u00ab\u00a0consentement\u00a0\u00bb relative \u00e0 l&#039;entr\u00e9e sans mandat est formul\u00e9e de mani\u00e8re si g\u00e9n\u00e9rale qu&#039;elle permet \u00e0 un propri\u00e9taire d&#039;autoriser l&#039;entr\u00e9e sans mandat de la police dans l&#039;appartement d&#039;un locataire, ce qui, \u00e0 premi\u00e8re vue, est contraire au droit constitutionnel en vigueur.<\/p>\n<p>Merci d&#039;avoir pris en compte ce qui pr\u00e9c\u00e8de.
