A1B 4J6<br \/>\nT\u00e9l\u00e9copieur : (709) 729-0469<br \/>\njustice@gov.nl.ca<\/p>\n<p><u> Objet : Droits de mobilit\u00e9 et pouvoirs de police extraordinaires \u00a0 <\/u><\/p>\n<p>Cher Monsieur le Procureur,<\/p>\n<p>Nous vous \u00e9crivons au sujet des r\u00e9centes d\u00e9cisions de votre gouvernement concernant la pand\u00e9mie de COVID-19. La mesure sp\u00e9ciale et les modifications l\u00e9gislatives peuvent m\u00e9riter une mise \u00e0 jour et une modification, compte tenu des risques constitutionnels d\u00e9coulant \u00e0 la fois de la\u00a0 <em>Charte des droits<\/em> \u00a0et le partage des pouvoirs. En tant que surintendant de la primaut\u00e9 du droit dans la province, nous vous exhortons \u00e0 consid\u00e9rer ce qui suit.<\/p>\n<p>En vertu d&#039;une mesure sp\u00e9ciale \u00e9mise par le m\u00e9decin-hygi\u00e9niste en chef (ordonnance sur les mesures sp\u00e9ciales, modification n\u00b0 11), votre gouvernement a pr\u00e9tendu interdire aux non-r\u00e9sidents d&#039;entrer dans la province, \u00e0 quelques exceptions pr\u00e8s. Sous pr\u00e9texte d&#039;\u00e9tablir des m\u00e9canismes pour faire respecter cette interdiction, votre gouvernement a introduit des changements au\u00a0 <em>Loi sur la protection et la promotion de la sant\u00e9\u00a0<\/em> qui autorise la police \u00e0 effectuer des perquisitions sans mandat et le pouvoir d&#039;expulser des individus \u2013 apparemment des r\u00e9sidents et des non-r\u00e9sidents \u2013 de la juridiction. Notamment, ces mesures n&#039;ont pas \u00e9t\u00e9 prises au d\u00e9but de la pand\u00e9mie, mais ont plut\u00f4t abouti sept semaines apr\u00e8s que la province a initialement d\u00e9clar\u00e9 l&#039;\u00e9tat d&#039;urgence, et malgr\u00e9 le fait que le nombre de cas actifs de COVID-19 dans la province s&#039;\u00e9l\u00e8ve actuellement \u00e0 1 7 et , mais pour une petite augmentation v\u00e9cue le 7 mai 2020, est en baisse depuis un mois.<\/p>\n<p>Lorsque cela est n\u00e9cessaire et proportionn\u00e9, la pand\u00e9mie actuelle a exig\u00e9 des mesures temporaires qui limitent les droits et libert\u00e9s des Canadiens. D&#039;autres provinces ont r\u00e9ussi \u00e0 le faire d&#039;une mani\u00e8re conforme \u00e0 la\u00a0 <em>Charte canadienne des droits et libert\u00e9s\u00a0<\/em> \u2014 La loi supr\u00eame du Canada s&#039;appliquant dans tout le pays, toujours. Toutes les mesures prises qui restreignent les droits des Canadiens doivent \u00eatre \u00e0 la fois raisonnables et\u00a0 <em>manifestement<\/em> \u00a0justifi\u00e9. Comme vous le savez, cela signifie que les restrictions aux droits doivent \u00eatre fond\u00e9es sur\u00a0 <em>preuve<\/em> \u00a0de n\u00e9cessit\u00e9 et de proportionnalit\u00e9 ; la peur et la sp\u00e9culation ne suffisent pas.<\/p>\n<p>De plus, la conf\u00e9d\u00e9ration du Canada a longtemps b\u00e9n\u00e9fici\u00e9 de fronti\u00e8res ouvertes et de la libre circulation des personnes \u00e0 l&#039;int\u00e9rieur de celle-ci. Interdire aux \u00ab\u00a0\u00e9trangers\u00a0\u00bb de quitter une province, d&#039;entrer dans une autre, ne rel\u00e8ve probablement pas de la comp\u00e9tence d&#039;une province, en vertu de la\u00a0 <em>Loi constitutionnelle de 1867<\/em>.<\/p>\n<p>En ce qui concerne les droits de mobilit\u00e9, conform\u00e9ment \u00e0 l&#039;article 6(2) de la\u00a0 <em>chartes<\/em> , les particuliers peuvent \u00e9lire domicile dans n&#039;importe quelle province et ont le droit de gagner leur vie dans n&#039;importe quelle province. Les droits de mobilit\u00e9 des Canadiens sont sacro-saints; pas m\u00eame la clause nonobstant de la\u00a0 <em>Loi constitutionnelle de 1982<\/em> peuvent \u00e9carter leur candidature. Les seules d\u00e9rogations \u00e0 l&#039;article 6 autoris\u00e9es sont celles qui peuvent \u00eatre justifi\u00e9es en vertu de l&#039;article 1 de la\u00a0 <em>chartes<\/em> , \u00e0 savoir ceux qui sont \u00e0 la fois raisonnables et manifestement justifi\u00e9s. \u00c0 notre avis, l&#039;interdiction de voyager impos\u00e9e par la province n&#039;est ni l&#039;un ni l&#039;autre. Nous esp\u00e9rons que votre gouvernement prendra des mesures pour annuler l&#039;interdiction afin d&#039;\u00e9viter une contestation judiciaire.<\/p>\n<p>Sur un autre front, les modifications apport\u00e9es pour \u00e9tendre les pouvoirs de la police au-del\u00e0 de leurs limites constitutionnelles violent le droit de ne pas \u00eatre soumis \u00e0 des fouilles, perquisitions et saisies abusives en vertu de l&#039;art. 8 du\u00a0 <em>chartes<\/em> , et le droit de ne pas \u00eatre arr\u00eat\u00e9 et d\u00e9tenu arbitrairement en vertu de l&#039;art. 9 du\u00a0 <em>chartes<\/em>. L&#039;article 50(1) de la\u00a0 <em>Loi sur la protection et la promotion de la sant\u00e9\u00a0<\/em> \u00e0 premi\u00e8re vue, autoriser l&#039;entr\u00e9e sans mandat dans n&#039;importe quel local, contrairement \u00e0 la jurisprudence constitutionnelle bien \u00e9tablie.<\/p>\n<p>De plus, le fait qu&#039;une telle entr\u00e9e sans mandat semble \u00eatre ouverte aux \u00ab inspecteurs \u00bb en vertu de la Loi et non aux \u00ab agents de la paix \u00bb est peu rassurant puisque la d\u00e9finition d&#039;\u00ab inspecteur \u00bb peut \u00eatre \u00e9largie par simple d\u00e9signation minist\u00e9rielle. Quoi qu&#039;il en soit, l&#039;article 28.1 de la Loi peut maintenant \u00eatre invoqu\u00e9 pour autoriser les agents de la paix \u00e0 fournir \u00ab l&#039;aide n\u00e9cessaire \u00bb pour assurer le respect d&#039;une mesure prise par le m\u00e9decin-hygi\u00e9niste en chef. Nonobstant l&#039;art. 28(3), nous sommes d&#039;avis que la loi n&#039;exclut pas clairement la possibilit\u00e9 que le ministre de la S\u00e9curit\u00e9 publique autorise des agents de la paix \u00e0 entrer dans une r\u00e9sidence priv\u00e9e sans mandat en vertu de la disposition relative \u00e0 l&#039;\u00ab\u00a0assistance n\u00e9cessaire\u00a0\u00bb contenue \u00e0 l&#039;art. 28.1(1)d). Ces dispositions l\u00e9gislatives manquent tout simplement le but et n\u00e9cessitent une modification soigneuse.<\/p>\n<p>Les nouvelles dispositions autorisent \u00e9galement la d\u00e9tention sans mandat et le renvoi d&#039;individus vers un lieu sp\u00e9cifi\u00e9, y compris un point d&#039;entr\u00e9e, faisant vraisemblablement r\u00e9f\u00e9rence \u00e0 un a\u00e9roport ou \u00e0 un terminal de ferry. En effet, la loi autorise le bannissement, sans proc\u00e9dure r\u00e9guli\u00e8re, pour une pr\u00e9tendue contravention aux ordonnances de sant\u00e9 publique. Bien que nous comprenions que les modifications apport\u00e9es \u00e0 la loi ont \u00e9t\u00e9 motiv\u00e9es en grande partie par la soi-disant \u00ab\u00a0interdiction de voyager\u00a0\u00bb \u00e9nonc\u00e9e dans le D\u00e9cret sur les mesures sp\u00e9ciales (modification n\u00a011), il convient de noter que rien dans la loi ne limite le pouvoir de renvoi aux non-r\u00e9sidents. De plus, la province est peut-\u00eatre entr\u00e9e dans le domaine f\u00e9d\u00e9ral sur ce front. Exer\u00e7ant le pouvoir provincial d&#039;\u00e9loigner des \u00ab\u00a0points d&#039;entr\u00e9e\u00a0\u00bb, conform\u00e9ment \u00e0 l&#039;art. 91(13) de la\u00a0 <i> Loi constitutionnelle de 1867,\u00a0 <\/i> interf\u00e8re avec la comp\u00e9tence f\u00e9d\u00e9rale sur les traversiers entre deux provinces.<\/p>\n<p>\u00c0 notre avis, les nouvelles mesures que votre gouvernement a mises en place ne survivront pas au contr\u00f4le judiciaire. Avant d&#039;instaurer l&#039;interdiction de voyager, la province a exig\u00e9 que tous ceux qui entrent s&#039;auto-isolent pendant 14 jours. Il n&#039;y a aucune preuve d\u00e9montrant que cette exigence \u00e9tait inefficace ou insuffisante. Au contraire, votre province a r\u00e9ussi \u00e0 maintenir ses chiffres de COVID-19 bas, indiquant qu&#039;il y a un respect strict des mesures de sant\u00e9 publique, y compris l&#039;exigence que les visiteurs s&#039;auto-isolent. Instituer des restrictions encore plus s\u00e9v\u00e8res \u00e0 la mobilit\u00e9 et autoriser des pouvoirs de police trop \u00e9tendus \u2013 m\u00eame au nom de la sant\u00e9 et de la s\u00e9curit\u00e9 publiques \u2013 exigerait des preuves de n\u00e9cessit\u00e9 et de proportionnalit\u00e9 qui n&#039;existent pas.<\/p>\n<p>Bien que nous comprenions que votre gouvernement a offert une interpr\u00e9tation de la loi en faisant valoir qu&#039;elle est constitutionnelle, la loi parle d&#039;elle-m\u00eame. C&#039;est le l\u00e9gislateur qui d\u00e9termine le contenu des lois, pas votre avis juridique. Le moyen le plus simple d&#039;aligner votre interpr\u00e9tation sur le risque constitutionnel soulev\u00e9 par le libell\u00e9 actuel de la loi est de modifier la loi pour la rendre plus clairement dans les limites constitutionnelles. Vous ne seriez pas la premi\u00e8re province \u00e0 devoir clarifier ses lois lors de la gestion des urgences de COVID-19, et ce ne sera probablement pas la derni\u00e8re.<\/p>\n<p>Nous notons que l&#039;Ordonnance sur les mesures sp\u00e9ciales (Amendement n\u00b0 11) exige que le m\u00e9decin-hygi\u00e9niste en chef r\u00e9vise l&#039;Ordonnance tous les cinq jours. Nous vous exhortons \u00e0 assumer vos fonctions quasi judiciaires en tant que conseiller juridique en chef du Cabinet. Nous exhortons votre minist\u00e8re \u00e0 aviser le m\u00e9decin-chef de l&#039;insuffisance constitutionnelle de l&#039;Ordre, afin de lever l&#039;interdiction de voyager. Nous exhortons en outre votre gouvernement \u00e0 pr\u00e9senter des amendements pour amener le\u00a0 <em>Loi sur la protection et la promotion de la sant\u00e9 publique\u00a0<\/em> en conformit\u00e9 avec la Constitution.<\/p>\n<p>Rien de ce qui pr\u00e9c\u00e8de ne sugg\u00e8re qu&#039;il existe une solution unique \u00e0 la gestion des urgences au Canada. Il va sans dire que votre province envisage particuli\u00e8rement des actions propres \u00e0 Terre-Neuve-et-Labrador. Chaque province et territoire a adopt\u00e9 une approche de gestion des urgences qui correspond \u00e0 la sant\u00e9 publique particuli\u00e8re et aux circonstances particuli\u00e8res de la r\u00e9gion. Mais tous doivent le faire dans les limites de la Constitution.<\/p>\n<p>L&#039;ACLC est une ONG ind\u00e9pendante \u00e0 but non lucratif, qui s&#039;oppose au pouvoir et d\u00e9fend la libert\u00e9 au Canada depuis 1964.\u00a0 \u00a0<a href=\"https:\/\/ccla.org\/fr\/principaux-cas-et-rapports\/coronavirus\/\">Nous avons comparu devant les tribunaux \u00e0 travers le Canada des centaines de fois et avons entam\u00e9 des poursuites contre des gouvernements pendant COVID-19 dans d&#039;autres juridictions<\/a>.
