Archie Campbell, Commission du SRAS, 2007.<\/p>\n<p><span data-contrast=\"auto\">Il existe deux types de lois sur la gestion des urgences : celles qui\u00a0<\/span><em><span data-contrast=\"auto\">apr\u00e8s<\/span><\/em><span data-contrast=\"auto\">\u00a0une crise est termin\u00e9e, et ceux qui ont l\u00e9gif\u00e9r\u00e9 au milieu de la crise elle-m\u00eame.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Les autorit\u00e9s ont fait le premier apr\u00e8s la crise d&#039;octobre de 1970. La Colombie-Britannique \u00e9tait en train de mettre \u00e0 jour sa l\u00e9gislation de 1993 avant COVID, et\u00a0<\/span><span data-contrast=\"auto\">Ontario\u00a0<\/span><span data-contrast=\"auto\">aussi mis \u00e0 jour leurs lois d&#039;urgence<\/span><span data-contrast=\"auto\">, plusieurs fois apr\u00e8s le SRAS, entre 2006 et 2019<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">On assiste, aujourd&#039;hui, au Canada, \u00e0 l&#039;autre genre<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0 Alberta\u00a0<\/span><span data-contrast=\"auto\">et Manitoba\u00a0<\/span><span data-contrast=\"auto\">l&#039;a fait\u00a0<\/span><span data-contrast=\"auto\">le mois dernier<\/span><span data-contrast=\"auto\">, alors\u00a0<\/span><span data-contrast=\"auto\">Terre-Neuve et maintenant l&#039;\u00cele-du-Prince-\u00c9douard ont mis en ligne leur propre projet de loi sur la gestion des urgences.\u00a0\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">La<\/span><span data-contrast=\"auto\">\u00a0probl\u00e8me<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">de l\u00e9gif\u00e9rer pendant une crise, lorsque cette l\u00e9gislation implique la cr\u00e9ation de nouveaux pouvoirs gouvernementaux, c&#039;est que tout finit par ressembler \u00e0 la\u00a0<\/span><span data-contrast=\"auto\">c\u00e9l\u00e8bre\u00a0<\/span><span data-contrast=\"auto\">Patriot Act am\u00e9ricain. En d&#039;autres termes, c&#039;est toujours une mauvaise nouvelle pour vos droits humains.<\/span><span data-contrast=\"auto\">\u00a0 Les gouvernements s&#039;arrogent de nouveaux pouvoirs pour porter atteinte aux droits individuels au nom de la crise ; les plus vuln\u00e9rables paient toujours le plus lourd tribut, et l&#039;histoire n&#039;enregistre que des regrets.\u00a0\u00a0\u00a0<\/span><span data-contrast=\"auto\">L&#039;\u00e9galit\u00e9, la libert\u00e9 d&#039;expression, une proc\u00e9dure r\u00e9guli\u00e8re et la libert\u00e9 passent tous au second plan par rapport \u00e0 la volont\u00e9 collective de repousser\u00a0<\/span><span data-contrast=\"auto\">un agrandi<\/span><span data-contrast=\"auto\">\u00a0ennemi, qu&#039;il soit humain ou viral. C&#039;est comme changer les r\u00e8gles au milieu des s\u00e9ries \u00e9liminatoires \u2013 ce n&#039;est jamais une bonne id\u00e9e.<\/span><\/p>\n<p><span data-contrast=\"auto\">Ceci pour plusieurs raisons, mais la plus \u00e9vidente est que les gouvernements\u00a0<\/span><span data-contrast=\"auto\">r\u00e9diger un tel projet de loi\u00a0<\/span><span data-contrast=\"auto\">le faire avec des informations terriblement inad\u00e9quates<\/span><span data-contrast=\"auto\">, et sous d&#039;\u00e9normes pressions personnelles et politiques<\/span><span data-contrast=\"auto\">. Ils sont litt\u00e9ralement dans l&#039;\u0153il du cyclone, et cela affecte \u00e9videmment tout dans la l\u00e9gislation.\u00a0\u00a0<\/span><span data-contrast=\"auto\">L&#039;information\u00a0<\/span><span data-contrast=\"auto\">se r\u00e9v\u00e8le \u00eatre<\/span><span data-contrast=\"auto\">\u00a0incomplet\u00a0<\/span><span data-contrast=\"auto\">et<\/span><span data-contrast=\"auto\">\u00a0Incorrect. Si l&#039;Ontario avait r\u00e9dig\u00e9 un\u00a0<\/span><span data-contrast=\"auto\">Nouveau\u00a0<\/span><span data-contrast=\"auto\">loi en mars,\u00a0<\/span><span data-contrast=\"auto\">par exemple,\u00a0<\/span><span data-contrast=\"auto\">les masques chirurgicaux auraient \u00e9t\u00e9 interdits pour tous, sauf pour les travailleurs de la sant\u00e9. Le papier toilette aurait \u00e9t\u00e9 rationn\u00e9, par la loi. Aujourd&#039;hui, tout est diff\u00e9rent<\/span><span data-contrast=\"auto\">, le gouvernement a donc \u00e9t\u00e9 intelligent de ne pas modifier ses lois.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Outre le d\u00e9ficit d&#039;information,\u00a0<\/span><span data-contrast=\"auto\">il y a\u00a0<\/span><span data-contrast=\"auto\">une<\/span><span data-contrast=\"auto\">\u00a0d\u00e9ficit de sagesse.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Les lois sont<\/span><span data-contrast=\"auto\">\u00a0r\u00e9dig\u00e9s par des \u00eatres humains, apr\u00e8s tout<\/span><span data-contrast=\"auto\">,\u00a0<\/span><span data-contrast=\"auto\">qui sont extr\u00eamement inquiets de la crise qu&#039;ils essaient de g\u00e9rer, en tant que gouverneurs d\u00e9mocrates. C&#039;est ce qu&#039;on appelle le \u00ab\u00a0brouillard de la guerre\u00a0\u00bb, un terme invent\u00e9 par Robert McNamara, comme une autocritique de ce que lui et deux pr\u00e9sidents ont fait pour mal g\u00e9rer la guerre du Vietnam.\u00a0\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">La sagesse exige du temps et de la perspective ; s\u00e9r\u00e9nit\u00e9 et patience; intelligence et d\u00e9bat.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Le brouillard de la guerre\u00a0<\/span><span data-contrast=\"auto\">enveloppes les l\u00e9gislateurs avec<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">peur<\/span><span data-contrast=\"auto\">\u00a0et l&#039;incertitude<\/span><span data-contrast=\"auto\">. La l\u00e9gislation, en revanche, exige de la certitude. Si c&#039;est brumeux ou vague, alors c&#039;est une mauvaise loi, susceptible d&#039;un contr\u00f4le judiciaire par\u00a0<\/span><span data-contrast=\"auto\">int\u00e9r\u00eat public\u00a0<\/span><span data-contrast=\"auto\">organisations comme la n\u00f4tre, l&#039;Association canadienne des libert\u00e9s civiles.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Sachant cela, les gouvernements r\u00e9digent des lois avec une certitude absolue, m\u00eame si elles sont bas\u00e9es sur des faits flous.\u00a0\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Ensuite, les projets de loi du gouvernement vont \u00e0 l&#039;Assembl\u00e9e l\u00e9gislative, o\u00f9 ils sont cens\u00e9s \u00eatre\u00a0<\/span><span data-contrast=\"auto\">am\u00e9lior\u00e9 par le d\u00e9bat d\u00e9mocratique, la dissidence et un examen minutieux.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Maintenant, que pensez-vous qu&#039;il arrive \u00e0\u00a0<\/span><span data-contrast=\"auto\">tel\u00a0<\/span><span data-contrast=\"auto\">d\u00e9bat en situation d&#039;urgence<\/span><span data-contrast=\"auto\">?<\/span><span data-contrast=\"auto\">\u00a0 Imaginez que vous \u00eates dans votre cuisine, en famille\u00a0<\/span><span data-contrast=\"auto\">et amis<\/span><span data-contrast=\"auto\">, d\u00e9battre de ce qu&#039;il faut faire \u00e0 propos de la fum\u00e9e\u00a0<\/span><span data-contrast=\"auto\">flairer\u00a0<\/span><span data-contrast=\"auto\">c&#039;est partout mais ne sort pas du four. Dans quelle mesure ce d\u00e9bat est-il sain\u00a0?\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Ce genre de pens\u00e9e \u00e9loigne l&#039;homo sapiens du danger. Mais \u00e7a ne fait pas de bien\u00a0<\/span><span data-contrast=\"auto\">l\u00e9gif\u00e9rer<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Il s&#039;est av\u00e9r\u00e9 que j&#039;\u00e9tais\u00a0<\/span><span data-contrast=\"auto\">un\u00a0<\/span><span data-contrast=\"auto\">Ontario\u00a0<\/span><span data-contrast=\"auto\">D\u00e9put\u00e9 et ministre du Cabinet<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">en 2006\u00a0<\/span><span data-contrast=\"auto\">lorsque le gouvernement lib\u00e9ral a suivi la\u00a0<\/span><span data-contrast=\"auto\">recommandations de la Commission SRAS d&#039;Archie Campbell<\/span><span data-contrast=\"auto\">. Il a \u00e9t\u00e9<\/span><span data-contrast=\"auto\">\u00a0appel\u00e9 par le premier ministre Ernie\u00a0<\/span><span data-contrast=\"auto\">les veilles\u00a0<\/span><span data-contrast=\"auto\">en 2003 apr\u00e8s\u00a0<\/span><span data-contrast=\"auto\">L&#039;Ontario a travers\u00e9 le SRAS sans aucun pouvoir juridique d&#039;urgence explicite<\/span><span data-contrast=\"auto\">. Donc\u00a0<\/span><span data-contrast=\"auto\">Ontario\u00a0<\/span><span data-contrast=\"auto\">plus tard\u00a0<\/span><span data-contrast=\"auto\">mis \u00e0 jour ces lois dans l&#039;\u00e9tat o\u00f9 elles se trouvent aujourd&#039;hui - toujours imparfaites, manquant de la capacit\u00e9 de pr\u00e9voir ce qui est n\u00e9cessaire pour COVID, mais ayant tir\u00e9 les le\u00e7ons du pass\u00e9. Le d\u00e9bat n&#039;a pas \u00e9t\u00e9 pr\u00e9cipit\u00e9 et a inclus des amendements propos\u00e9s par le NPD et les conservateurs.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Le fait est que cela n&#039;a pas \u00e9t\u00e9 fait dans le brouillard d&#039;une crise,\u00a0<\/span><span data-contrast=\"auto\">mais avec le luxe fortuit du temps<\/span><span data-contrast=\"auto\">\u00a0pour y r\u00e9fl\u00e9chir<\/span><span data-contrast=\"auto\">, d\u00e9battre et amender les lois<\/span><span data-contrast=\"auto\">\u00a0au meilleur des cas\u00a0<\/span><span data-contrast=\"auto\">une<\/span><span data-contrast=\"auto\">\u00a0pourrait.\u00a0\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Les chances d&#039;un d\u00e9bat d\u00e9mocratique sain en p\u00e9riode de crise sont pratiquement nulles \u2013 en particulier aujourd&#039;hui o\u00f9 les l\u00e9gislatures ont une fraction de ses membres si\u00e9geant, afin de cr\u00e9er une saine distance physique entre les \u00e9lus. La dissidence ou, Dieu nous en pr\u00e9serve, retarder l&#039;adoption d&#039;un tel projet de loi est une trahison.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Mieux vaut que les gouvernements gouvernent avec les pouvoirs dont ils disposaient au d\u00e9but d&#039;une crise, que de remanier les lois de gestion des urgences dans le brouillard.
