width=\u00a0\u00bb1\/1&Prime; tablet_width_inherit=\u00a0\u00bbdefault\u00a0\u00bb animation_type=\u00a0\u00bbdefault\u00a0\u00bb bg_image_animation=\u00a0\u00bbnone\u00a0\u00bb border_type=\u00a0\u00bbsimple\u00a0\u00bb column_border_width=\u00a0\u00bbnone\u00a0\u00bb column_border_style=\u00a0\u00bbsolid\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb text_direction=\u00a0\u00bbdefault\u00a0\u00bb]Hier, le gouvernement a d\u00e9pos\u00e9 le projet de loi C-36, intitul\u00e9 \u00ab <em>Loi sur la protection de la vie priv\u00e9e et des donn\u00e9es des consommateurs \u00bb<\/em>, qui vise \u00e0 r\u00e9former le cadre f\u00e9d\u00e9ral canadien en mati\u00e8re de protection de la vie priv\u00e9e applicable aux entreprises priv\u00e9es.<\/p>\n<p>Cette proposition \u2014 qui constitue une \u00ab<a href=\"https:\/\/www.canada.ca\/en\/innovation-science-economic-development\/news\/2026\/06\/government-of-canada-tables-new-legislation-to-protect-childrens-data-strengthen-privacy-and-build-trust-in-the-digital-economy.html\">pierre angulaire \u00bb<\/a>de la \u00ab Strat\u00e9gie nationale du Canada en mati\u00e8re d&rsquo;intelligence artificielle : l&rsquo;IA pour tous \u00bb \u2014 vise \u00e0 donner aux Canadiens davantage de contr\u00f4le sur leurs donn\u00e9es personnelles, dans le but d\u00e9clar\u00e9 de renforcer la confiance dans les outils d&rsquo;IA et d&rsquo;en favoriser une adoption plus large.<\/p>\n<p>Bon nombre des <a href=\"https:\/\/www.canada.ca\/en\/innovation-science-economic-development\/news\/2026\/06\/government-of-canada-introduces-legislation-to-protect-canadians-privacy-in-the-digital-age.html\">pr\u00e9tendus avantages du projet de loi en mati\u00e8re de protection de la vie priv\u00e9e<\/a>, notamment le <a href=\"https:\/\/www.canlii.org\/en\/ca\/pcc\/doc\/2022\/2022canlii91035\/2022canlii91035.html#par57\">droit \u00e0 l\u2019effacement<\/a>, <a href=\"https:\/\/www.canlii.org\/en\/ca\/pcc\/doc\/2021\/2021canlii43998\/2021canlii43998.html#par112\">le renforcement de la protection<\/a>de la vie priv\u00e9e des enfants et l\u2019interdiction de <a href=\"https:\/\/www.priv.gc.ca\/en\/privacy-topics\/business-privacy\/collecting-personal-information\/consent\/gd_53_201805\/\">pratiques inappropri\u00e9es en mati\u00e8re de donn\u00e9es<\/a> telles que certains types de tarification li\u00e9e \u00e0 la surveillance, ne font que r\u00e9affirmer des mesures qui font partie du cadre f\u00e9d\u00e9ral canadien de protection de la vie priv\u00e9e <a href=\"https:\/\/www.canlii.org\/en\/ca\/fct\/doc\/2004\/2004fc852\/2004fc852.html\">depuis son adoption, il y a<\/a> plus de vingt-cinq ans. D\u2019autres avantages apparents, tels que la reconnaissance suppos\u00e9e par la loi de la vie priv\u00e9e en tant que \u00ab droit fondamental \u00bb, sont de nature purement rh\u00e9torique et sont compromis par d\u2019autres dispositions qui cr\u00e9eraient une nouvelle obligation visant \u00e0 faciliter la marchandisation des donn\u00e9es \u00e0 caract\u00e8re personnel dans tous les aspects de la loi. <\/p>\n<p>Ce projet de loi apporte effectivement certaines am\u00e9liorations \u00e0 la l\u00e9gislation canadienne actuelle en mati\u00e8re de protection de la vie priv\u00e9e, notamment des m\u00e9canismes d\u2019application qui se faisaient attendre depuis longtemps et une mesure de transparence concernant la prise de d\u00e9cision algorithmique. Toutefois, celles-ci sont affaiblies par de vastes exceptions concernant les activit\u00e9s commerciales, un cadre trop permissif pour les donn\u00e9es \u00e0 caract\u00e8re personnel qui sont <a href=\"https:\/\/www.ipc.on.ca\/en\/media-centre\/news-releases\/ipc-updates-its-de-identification-guidelines-setting-new-standard-responsible-data-use\">d\u00e9personnalis\u00e9es mais non anonymis\u00e9es<\/a>, ainsi que par l\u2019affaiblissement du r\u00f4le du Commissaire \u00e0 la protection de la vie priv\u00e9e du Canada en tant que garant de la protection de la vie priv\u00e9e dans le domaine commercial. <\/p>\n<p>Le nouveau r\u00e9gime perp\u00e9tue \u00e9galement l\u2019incapacit\u00e9 du gouvernement \u00e0 <a href=\"https:\/\/voterprivacy.ca\/\">soumettre les partis politiques f\u00e9d\u00e9raux \u00e0 des lois efficaces en mati\u00e8re de protection de la vie priv\u00e9e<\/a> et souffre d\u2019une absence flagrante de toute protection efficace contre les syst\u00e8mes d\u2019intelligence artificielle, malgr\u00e9 les <a href=\"https:\/\/ccla.org\/press-release\/civil-society-innitiative-announces-public-consultation-on-ai\/\">pr\u00e9judices bien document\u00e9s<\/a> que cet ensemble de technologies \u00e9mergentes cause d\u00e9j\u00e0. Il manque tout autant <a href=\"https:\/\/www.ourcommons.ca\/Content\/Committee\/441\/INDU\/Brief\/BR12605754\/br-external\/RobertsonKate-Combined-e.pdf\">de mesures de transparence ou de contr\u00f4le visant \u00e0<\/a>rem\u00e9dier \u00e0 la d\u00e9pendance sans cesse croissante de la police vis-\u00e0-vis des vastes bases de donn\u00e9es d\u00e9tenues par des entreprises priv\u00e9es. <\/p>\n<p>Tamir Israel, directeur du programme \u00ab\u00a0Vie priv\u00e9e, surveillance et technologie\u00a0\u00bb de l&rsquo;ACLC, a fait la d\u00e9claration suivante :<\/p>\n<p>\u00ab Si le projet de loi C-36 offre certaines nouvelles protections en mati\u00e8re de vie priv\u00e9e, il accorde \u00e9galement aux entreprises la possibilit\u00e9 de contourner les exigences en mati\u00e8re de consentement et de conserver ind\u00e9finiment des donn\u00e9es \u00e0 caract\u00e8re personnel si celles-ci ont fait l\u2019objet d\u2019une anonymisation superficielle. Le projet n\u2019impose que de maigres contraintes \u00e0 l\u2019intelligence artificielle, malgr\u00e9 les d\u00e9fis croissants que ces technologies posent \u00e0 la soci\u00e9t\u00e9, et int\u00e8gre les int\u00e9r\u00eats commerciaux et les obligations commerciales comme consid\u00e9rations fondamentales dans l\u2019application de la loi propos\u00e9e. Face \u00e0 l\u2019exploitation croissante des donn\u00e9es, le Canada m\u00e9rite des garanties significatives, et non illusoires, en mati\u00e8re de protection des donn\u00e9es.
