{"id":12258,"date":"2026-06-16T11:56:49","date_gmt":"2026-06-16T15:56:49","guid":{"rendered":"https:\/\/ccla.org\/?p=12258"},"modified":"2026-06-16T14:43:14","modified_gmt":"2026-06-16T18:43:14","slug":"proposed-bill-c-36-protecting-privacy-and-consumer-data-act-erodes-federal-privacy-rights-and-fails-to-meaningfully-address-well-documented-ai-harms","status":"publish","type":"post","link":"https:\/\/ccla.org\/fr\/press-release\/proposed-bill-c-36-protecting-privacy-and-consumer-data-act-erodes-federal-privacy-rights-and-fails-to-meaningfully-address-well-documented-ai-harms\/","title":{"rendered":"Bill C-36 proposes empty privacy protections, broad exceptions for corporate data exploitation, and little to address AI harms"},"content":{"rendered":"<p>Yesterday, the government tabled Bill C-36, the <em>Protecting Privacy and Consumer Data Act<\/em>, which seeks to overhaul Canada\u2019s federal privacy framework for private companies.<\/p>\n<p>The proposal\u2014a \u201c<a href=\"https:\/\/www.canada.ca\/en\/innovation-science-economic-development\/news\/2026\/06\/government-of-canada-tables-new-legislation-to-protect-childrens-data-strengthen-privacy-and-build-trust-in-the-digital-economy.html\">cornerstone<\/a>\u201d of Canada\u2019s \u201cNational Artificial Intelligence Strategy: AI for All\u201d\u2014is intended to provide Canadians with more control over their personal data with the stated objective of providing confidence in, and higher adoption of AI tools.<\/p>\n<p>Many of the bill\u2019s <a href=\"https:\/\/www.canada.ca\/en\/innovation-science-economic-development\/news\/2026\/06\/government-of-canada-introduces-legislation-to-protect-canadians-privacy-in-the-digital-age.html\">supposed privacy benefits<\/a>, including the <a href=\"https:\/\/www.canlii.org\/en\/ca\/pcc\/doc\/2022\/2022canlii91035\/2022canlii91035.html#par57\">right of deletion<\/a>, <a href=\"https:\/\/www.canlii.org\/en\/ca\/pcc\/doc\/2021\/2021canlii43998\/2021canlii43998.html#par112\">heightened protection<\/a>s for children\u2019s privacy, and banning of <a href=\"https:\/\/www.priv.gc.ca\/en\/privacy-topics\/business-privacy\/collecting-personal-information\/consent\/gd_53_201805\/\">pratiques de donn\u00e9es inappropri\u00e9es<\/a> such as surveillance pricing, simply re-state measures that have been part of Canada\u2019s federal privacy framework since it was first adopted over twenty-five years ago. Other ostensible benefits, such as the law\u2019s claimed recognition of privacy as a \u201cfundamental right\u201d, are purely rhetorical in nature and undermined by other provisions that would create a new imperative to facilitate personal data commodification across all elements of the law.<\/p>\n<p>The bill does offer some improvements to Canada\u2019s existing privacy law, including much over-due enforcement mechanisms and a transparency measure for algorithmic decision-making. But these are weakened by broad exceptions for business activities, an overly permissive framework for personal data that is <a href=\"https:\/\/www.ipc.on.ca\/en\/media-centre\/news-releases\/ipc-updates-its-de-identification-guidelines-setting-new-standard-responsible-data-use\">de-identified but not anonymized<\/a>, and dilution of the Privacy Commissioner of Canada\u2019s role as steward of commercial privacy protections.<\/p>\n<p>The new regime also continues the government\u2019s failure to make federal pollical parties <a href=\"https:\/\/voterprivacy.ca\/\">subject to meaningful privacy laws<\/a> and suffers from a marked absence of any effective protections against AI systems despite the <a href=\"https:\/\/ccla.org\/fr\/communique-de-presse\/civil-society-innitiative-announces-public-consultation-on-ai\/\">well-documented harms<\/a> this emerging suite of technologies is already causing. Equally absent are <a href=\"https:\/\/www.ourcommons.ca\/Content\/Committee\/441\/INDU\/Brief\/BR12605754\/br-external\/RobertsonKate-Combined-e.pdf\">any transparency or oversight measures<\/a> to address the ever-growing reliance of police on the vast data troves held by private companies.<\/p>\n<p>Tamir Israel, directeur du programme \"Vie priv\u00e9e, surveillance et technologie\" de l'ACLC, a fait la d\u00e9claration suivante :<\/p>\n<p>\u201cWhile Bill C-36 offers some new protections for our privacy, it also grants businesses the ability to ignore consent requirements and retain personal data indefinitely if superficially de-identified.
