Certaines des exceptions propos\u00e9es s'appliqueront m\u00eame r\u00e9troactivement, ce qui permettra au gouvernement de se soustraire aux ordonnances d'acc\u00e8s \u00e0 l'information et aux d\u00e9cisions judiciaires existantes.<\/p>\n<p>Le droit d'obtenir des informations sur des questions d'importance publique est prot\u00e9g\u00e9 par la Constitution et constitue une pierre angulaire de la d\u00e9mocratie. Il sous-tend le principe selon lequel les gouvernements doivent \u00eatre transparents et responsables devant le public.<\/p>\n<p>Dans la pratique, ce droit d'acc\u00e8s \u00e0 l'information - et les cadres juridiques qui le soutiennent - permettent aux journalistes, aux chercheurs et aux organisations de surveillance de d\u00e9noncer les actes r\u00e9pr\u00e9hensibles et la mauvaise gouvernance.<\/p>\n<p>D'autres changements propos\u00e9s supprimeraient des outils publics essentiels utilis\u00e9s pour v\u00e9rifier si le gouvernement respecte ses obligations en mati\u00e8re de protection de la vie priv\u00e9e et de cybers\u00e9curit\u00e9, et soustrairaient le processus d\u00e9cisionnel du gouvernement \u00e0 l'examen ind\u00e9pendant de l'autorit\u00e9 ontarienne de r\u00e9gulation de la protection de la vie priv\u00e9e.<\/p>\n<p>Tamir Israel, directeur du programme \"Vie priv\u00e9e, surveillance et technologie\" de l'ACLC, a fait la d\u00e9claration suivante :<\/p>\n<p>\"Le projet de loi 97 repr\u00e9sente un recul important du r\u00e9gime ontarien en mati\u00e8re de transparence et de protection de la vie priv\u00e9e. Malgr\u00e9 son nom, les seules personnes que la \"Loi sur le plan de protection de l'Ontario\" prot\u00e9gera sont les fonctionnaires du gouvernement qui tentent d'esquiver la responsabilit\u00e9 publique de leurs processus de prise de d\u00e9cision. L'\u00e9rosion de la protection de la vie priv\u00e9e et de la cybers\u00e9curit\u00e9 expose les informations personnelles de tous les habitants de l'Ontario \u00e0 des risques d'abus.<\/p>\n<p><span style=\"color: #1e5799;\"><strong>Fond<\/strong><\/span><\/p>\n<p>Le r\u00e9gime du droit \u00e0 l'information de l'Ontario - d\u00e9fini dans la <em>Loi sur l&#039;acc\u00e8s \u00e0 l&#039;information et la protection de la vie priv\u00e9e<\/em> (FIPPA) et son \u00e9quivalent municipal, MFIPPA, donnent au public le droit l\u00e9gal d'obtenir des documents gouvernementaux et prot\u00e8gent les informations personnelles. Ces lois sont supervis\u00e9es par le commissaire \u00e0 l'information et \u00e0 la protection de la vie priv\u00e9e de l'Ontario, qui est ind\u00e9pendant.<\/p>\n<p>Le projet de loi 97 portera atteinte \u00e0 ce droit l\u00e9gal d'obtenir des documents gouvernementaux ainsi qu'aux protections de la vie priv\u00e9e dans ce r\u00e9gime.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Blocage de l'acc\u00e8s au site minist\u00e9riel &amp; <span style=\"color: #1e5799;\">Policiers<\/span> Dossiers du personnel<\/em><\/span><\/p>\n<p>L'un des \u00e9l\u00e9ments les plus troublants du projet de loi 97 est sa proposition d'exclure tous les documents d\u00e9tenus par le premier ministre, les ministres, les \u00e9lus et leur personnel politique des lois sur l'acc\u00e8s \u00e0 l'information.<\/p>\n<p>Le gouvernement de l'Ontario a sugg\u00e9r\u00e9 que le retrait de ces cat\u00e9gories de documents des lois sur l'acc\u00e8s \u00e0 l'information est une pratique courante dans tout le Canada, mais cette caract\u00e9risation est trompeuse. S'il est raisonnable de prot\u00e9ger les informations v\u00e9ritablement personnelles, confidentielles ou li\u00e9es \u00e0 la circonscription, la FIPPA contient d\u00e9j\u00e0 des dispositions qui r\u00e9pondent \u00e0 ces pr\u00e9occupations sans restreindre l'acc\u00e8s de mani\u00e8re g\u00e9n\u00e9rale.<\/p>\n<p>Les exceptions propos\u00e9es ne sont pas non plus limit\u00e9es aux documents qui auraient un impact sur les activit\u00e9s li\u00e9es \u00e0 la circonscription ou sur la vie priv\u00e9e de tiers. Les exceptions sont de nature g\u00e9n\u00e9rale - les ministres et leur personnel ne seront pas exempt\u00e9s de divulguer quelque document que ce soit dont ils ont la garde.<\/p>\n<p>L'Ontario applique \u00e9galement son exclusion des documents minist\u00e9riels de mani\u00e8re r\u00e9troactive, ce qui signifie que les demandes d'acc\u00e8s \u00e0 l'information, les ordres de divulgation et m\u00eame les d\u00e9cisions des tribunaux seront invalid\u00e9s et que les documents gouvernementaux d\u00e9j\u00e0 soumis \u00e0 divulgation \u00e9chapperont \u00e0 l'examen du public.<\/p>\n<p>Comme l'a fait remarquer la commissaire \u00e0 l'information et \u00e0 la protection de la vie priv\u00e9e de l'Ontario dans son \u00e9valuation des changements, ces r\u00e9formes ne visent pas \u00e0 prot\u00e9ger les informations des \u00e9lecteurs, mais \u00e0 <a href=\"https:\/\/www.ipc.on.ca\/en\/media-centre\/news-releases\/statement-commissioner-patricia-kosseim-proposed-changes-ontarios-freedom-information-and-protection\">se soustraire \u00e0 la responsabilit\u00e9 publique<\/a>.<\/p>\n<p>Le projet de loi 97 introduit \u00e9galement des modifications qui porteraient atteinte \u00e0 la vie priv\u00e9e et limiteraient le contr\u00f4le de l'utilisation des technologies par les pouvoirs publics.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Permettre aux fonctionnaires de conserver les documents num\u00e9riques dont ils n'ont plus besoin<\/em><\/span><\/p>\n<p>Un autre amendement permettrait aux fonctionnaires d'emporter avec eux leurs courriels, documents \u00e9lectroniques, messages instantan\u00e9s et autres lorsqu'ils changent de fonction. Cette proposition ne porte pas seulement atteinte \u00e0 la vie priv\u00e9e en permettant aux fonctionnaires d'acc\u00e9der \u00e0 des informations dont ils n'ont plus besoin dans le cadre de leur travail, mais elle compromet \u00e9galement de mani\u00e8re significative l'acc\u00e8s \u00e0 l'information.<\/p>\n<p>Les demandes d'acc\u00e8s \u00e0 l'information sont g\u00e9n\u00e9ralement adress\u00e9es \u00e0 des services sp\u00e9cifiques, qui recherchent ensuite les documents pertinents dont ils ont la charge. En autorisant les fonctionnaires \u00e0 emporter avec eux les documents du minist\u00e8re lorsqu'ils partent, on les soustrait au contr\u00f4le du minist\u00e8re, ce qui a pour effet de les soustraire aux recherches effectu\u00e9es dans le cadre du droit \u00e0 l'information et dirig\u00e9es vers le minist\u00e8re en question.<\/p>\n<p><span style=\"color: #1e5799;\"><i>Prot\u00e9ger les entreprises qui ont acc\u00e8s aux informations sur les \u00e9tudiants<\/i><\/span><\/p>\n<p>Un amendement inqui\u00e9tant permettrait au gouvernement de cacher les entreprises priv\u00e9es qui ont eu acc\u00e8s aux informations personnelles des \u00e9tudiants de l'Ontario lorsqu'elles r\u00e9pondent \u00e0 des demandes d'archives.<\/p>\n<p>L'adoption rapide et inconsid\u00e9r\u00e9e des <a href=\"https:\/\/www.ipc.on.ca\/en\/media-centre\/blog\/use-edtech-schools-children-should-not-have-swap-their-privacy-education\">Plates-formes EdTech<\/a> a expos\u00e9 les informations personnelles sensibles de millions d'\u00e9tudiants dans le monde entier. <a href=\"https:\/\/norma.lexum.com\/ipc-cipvp\/privacy\/en\/item\/522177\/index.do\">Canada<\/a> et <a href=\"https:\/\/www.hrw.org\/news\/2022\/05\/25\/governments-harm-childrens-rights-online-learning\">autour du monde<\/a> \u00e0 de graves atteintes \u00e0 la vie priv\u00e9e. Il est essentiel de savoir quelles entreprises ont acc\u00e8s aux donn\u00e9es personnelles de nos \u00e9tudiants pour \u00e9valuer les risques qui en d\u00e9coulent pour la vie priv\u00e9e et la cybers\u00e9curit\u00e9, ainsi que pour la protection de la vie priv\u00e9e de mani\u00e8re plus g\u00e9n\u00e9rale. <a href=\"https:\/\/themarkup.org\/the-breakdown\/2023\/04\/27\/takeaways-from-our-investigation-into-wisconsins-racially-inequitable-dropout-algorithm\">\u00e9valuer l'\u00e9quit\u00e9 des outils d'IA adopt\u00e9s par les gouvernements<\/a> \u00e0 l'intention de nos \u00e9tudiants.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Exempter le gouvernement <span style=\"color: #1e5799;\">cybers\u00e9curit\u00e9<\/span> \u00e9valuations de la divulgation<\/em><\/span><\/p>\n<p>Un autre amendement vise \u00e0 exempter cat\u00e9goriquement les \u00e9valuations de cybers\u00e9curit\u00e9 du secteur public de l'obligation de divulgation. Alors qu'il serait l\u00e9gitime de ne pas divulguer les d\u00e9tails susceptibles de compromettre la s\u00e9curit\u00e9, cette proposition d'exemption s'applique aux \u00e9valuations qui ne repr\u00e9sentent aucune menace pour la cybers\u00e9curit\u00e9.<\/p>\n<p>Par exemple, \u00e0 la suite d'une faille de s\u00e9curit\u00e9, <a href=\"https:\/\/www.cbc.ca\/news\/politics\/cyber-defences-ag-cse-9.6946646\">des plans documentant le fait que le gouvernement n'a pas adopt\u00e9 de mesures de sauvegarde essentielles<\/a> seraient exempt\u00e9s m\u00eame si les lacunes en mati\u00e8re de s\u00e9curit\u00e9 qu'ils d\u00e9crivent ont \u00e9t\u00e9 combl\u00e9es il y a des ann\u00e9es. Il en r\u00e9sulterait une perte de responsabilit\u00e9 et une r\u00e9duction des incitations \u00e0 adopter des approches plus robustes en mati\u00e8re de cybers\u00e9curit\u00e9.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Moins de contr\u00f4le et de transparence dans la protection de la vie priv\u00e9e <\/em><\/span><\/p>\n<p>Une derni\u00e8re s\u00e9rie d'amendements prot\u00e9gerait le gouvernement <a href=\"https:\/\/www.hrw.org\/news\/2025\/04\/17\/doges-growing-reach-personal-data-what-it-means-human-rights\">partage d'informations<\/a> de la surveillance du commissaire \u00e0 la protection de la vie priv\u00e9e et de mettre fin \u00e0 l'obligation du gouvernement de l'Ontario de publier des informations d\u00e9taill\u00e9es sur les types de donn\u00e9es personnelles qu'il traite et sur les raisons de ce traitement.<\/p>\n<p>Collectivement, ces mesures cr\u00e9eraient de graves lacunes dans le cadre de protection de la vie priv\u00e9e et de responsabilit\u00e9 publique de l'Ontario.
