padding-bottom: 0px; \"><div class=\"row-bg-wrap\" data-bg-animation=\"none\" data-bg-animation-delay=\"\" data-bg-overlay=\"false\"><div class=\"inner-wrap row-bg-layer\" ><div class=\"row-bg viewport-desktop\"  style=\"\"><\/div><\/div><\/div><div class=\"row_col_wrap_12 col span_12 dark left\">\n\t<div  class=\"vc_col-sm-12 wpb_column column_container vc_column_container col no-extra-padding inherit_tablet inherit_phone\"  data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" >\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t\n<div class=\"wpb_text_column wpb_content_element\" >\n\t<div class=\"wpb_wrapper\">\n\t\t<p>Alors que le projet de loi C-12 est sur le point de faire l'objet d'un examen final au Parlement, le Comit\u00e9 des droits de l'homme des Nations Unies a d\u00e9clar\u00e9 que le projet de loi C-12 n'avait pas \u00e9t\u00e9 adopt\u00e9. <a href=\"https:\/\/tbinternet.ohchr.org\/_layouts\/15\/treatybodyexternal\/Download.aspx?symbolno=CCPR%2FC%2FCAN%2FCO%2F7\">a tir\u00e9 la sonnette d'alarme<\/a> concernant les nouvelles dispositions du projet de loi relatives \u00e0 l'in\u00e9ligibilit\u00e9, qui priveraient les demandeurs d'asile de garanties proc\u00e9durales ad\u00e9quates lors de l'\u00e9valuation de leur demande.<\/p>\n<p>Comme l'a fait l'ACLC <a href=\"https:\/\/ccla.org\/fr\/legalite\/senate-committee-calls-for-removal-of-controversial-assault-on-immigration-rights-from-bill-c-12\/\">not\u00e9e<\/a> dans le domaine parlementaire <a href=\"https:\/\/ccla.org\/wp-content\/uploads\/2025\/11\/2025.10.12-CCLA_SECU_Brief_C-12-1.pdf\">soumissions<\/a> et <a href=\"https:\/\/ccla.org\/wp-content\/uploads\/2026\/02\/2026.02.12-CCLA.C12.SOCI-Opening.Statement.pdf\">t\u00e9moignage<\/a>Le projet de loi C-12 cr\u00e9e de nouvelles cat\u00e9gories d'inadmissibilit\u00e9 qui privent les demandeurs d'asile de leur droit \u00e0 une audience et \u00e0 un appel complet devant la Commission de l'immigration et du statut de r\u00e9fugi\u00e9.<\/p>\n<p>Ces dispositions d'inadmissibilit\u00e9 seront fond\u00e9es sur des crit\u00e8res arbitraires. Toute personne entr\u00e9e au Canada plus d'un an avant de demander le statut de r\u00e9fugi\u00e9 sera interdite de territoire, bien qu'il n'y ait aucune corr\u00e9lation entre la l\u00e9gitimit\u00e9 de la demande d'un r\u00e9fugi\u00e9 et la date d'entr\u00e9e dans le pays.<\/p>\n<p>Un enfant qui a visit\u00e9 le Canada en vacances avec sa famille, un d\u00e9fenseur des droits de l'homme qui est venu parler de son pays d'origine \u00e0 des personnes au Canada, ou une personne fuyant une pers\u00e9cution fond\u00e9e sur le sexe qui a besoin de temps pour surmonter son traumatisme avant de pr\u00e9senter une demande d'asile - tous ces cas seraient vis\u00e9s par les exclusions radicales du projet de loi C-12.<\/p>\n<p>Pire encore, le projet de loi aura une application r\u00e9troactive, affectant toute personne qui est entr\u00e9e pour la premi\u00e8re fois dans le pays apr\u00e8s le 24 juin 2020 et qui n'a pas d\u00e9pos\u00e9 de demande d'asile avant l'introduction initiale du r\u00e9gime l\u00e9gislatif.<\/p>\n<p>Le gouvernement a fait valoir qu'il existait d'autres m\u00e9canismes permettant aux r\u00e9fugi\u00e9s de faire valoir leurs demandes, mais en tant que <a href=\"https:\/\/ccla.org\/wp-content\/uploads\/2025\/11\/2025.10.12-CCLA_SECU_Brief_C-12-1.pdf\">CCLA<\/a> et d'autres (y compris <a href=\"https:\/\/ccla.org\/fr\/legalite\/senate-committee-calls-for-removal-of-controversial-assault-on-immigration-rights-from-bill-c-12\/\">la commission s\u00e9natoriale<\/a> qui ont \u00e9tudi\u00e9 le projet de loi de mani\u00e8re approfondie), ces m\u00e9canismes manquent de garanties proc\u00e9durales essentielles.<\/p>\n<p>Dans ses observations, le Comit\u00e9 des droits de l'homme des Nations unies, qui est charg\u00e9 de superviser et de statuer sur le Pacte international relatif aux droits civils et politiques (<a href=\"https:\/\/ccla.org\/fr\/intimite\/surveillance-et-vie-privee\/resume-pacte-international-relatif-aux-droits-civils-et-politiques-cipr\/\">CCPR)<\/a>La Commission europ\u00e9enne, en collaboration avec la Commission europ\u00e9enne, s'est fait l'\u00e9cho des pr\u00e9occupations de la soci\u00e9t\u00e9 civile concernant l'\u00e9largissement des crit\u00e8res d'in\u00e9ligibilit\u00e9, appelant le gouvernement \u00e0 s'assurer que le projet de loi C-12 donne acc\u00e8s \u00e0 des \"proc\u00e9dures \u00e9quitables et efficaces, avec toutes les garanties proc\u00e9durales n\u00e9cessaires\", conform\u00e9ment au principe de non-refoulement.<\/p>\n<p>Pourtant, le gouvernement a refus\u00e9 tout amendement susceptible d'att\u00e9nuer de mani\u00e8re significative les pr\u00e9judices caus\u00e9s aux demandeurs d'asile par le projet de loi C-12, y compris les amendements propos\u00e9s par le S\u00e9nat qui auraient accord\u00e9 aux demandeurs d'asile le statut de r\u00e9fugi\u00e9. <a href=\"https:\/\/sencanada.ca\/en\/in-the-chamber\/votes\/details\/689285\/45-1\">le droit d'\u00eatre entendu<\/a>a \u00e9tendu la p\u00e9riode d'exclusion arbitraire \u00e0 <a href=\"https:\/\/sencanada.ca\/en\/in-the-chamber\/votes\/details\/689268\/45-1\">deux ans au lieu d'un<\/a>, a limit\u00e9 son caract\u00e8re d\u00e9loyal <a href=\"https:\/\/sencanada.ca\/en\/in-the-chamber\/votes\/details\/689298\/45-1\">application r\u00e9troactive<\/a>, ou <a href=\"https:\/\/sencanada.ca\/en\/in-the-chamber\/votes\/details\/688863\/45-1\">enfants prot\u00e9g\u00e9s<\/a> de son nouveau r\u00e9gime d'interdiction de territoire.<\/p>\n<p>Le fait de priver les demandeurs d'asile de garanties proc\u00e9durales essentielles les expose \u00e0 un risque grave de pers\u00e9cution, de torture ou pire encore. Cela nuit \u00e9galement \u00e0 la cr\u00e9dibilit\u00e9 du Canada sur la sc\u00e8ne internationale en tant que pays engag\u00e9 en faveur des droits de l'homme et de la protection des r\u00e9fugi\u00e9s.<\/p>\n<p>Les conclusions du Comit\u00e9 CCPR, publi\u00e9es dans le cadre de son bilan d\u00e9cennal sur les droits de l'homme au Canada, ne s'arr\u00eatent pas au projet de loi C-12 et dressent un tableau alarmant de l'\u00e9rosion du respect des libert\u00e9s civiles dans le pays.<\/p>\n<p>Le Comit\u00e9 attire l'attention sur les points suivants <a href=\"https:\/\/ccla.org\/fr\/communique-de-presse\/student-protest-movement-ccla-calls-for-an-investigation-into-calgary-polices-recent-conduct\/\">une agression<\/a> sur le droit de <a href=\"https:\/\/ccla.org\/fr\/communique-de-presse\/bill-c-9-was-supposed-to-fight-hate-instead-its-being-rushed-through-parliament-and-threatens-the-rights-of-every-canadian\/\">manifestation pacifique<\/a>y compris par le biais de <a href=\"https:\/\/inclo.net\/wp-content\/uploads\/2025\/12\/INCLO-Submission-for-UNSR-FOAA-62nd-HRC-Session-Report.pdf\">surveillance accrue des voix dissidentes<\/a>une tendance croissante \u00e0 <a href=\"https:\/\/ccla.org\/fr\/principaux-cas-et-rapports\/clause-nonobstant\/\">immuniser la l\u00e9gislation contre l'examen de la Charte<\/a> en invoquant la clause d\u00e9rogatoire avec <a href=\"https:\/\/ccla.org\/fr\/communique-de-presse\/op-ed-why-we-are-challenging-bill-21-in-the-supreme-court\/\">fr\u00e9quence dangereuse<\/a>les lois qui p\u00e9nalisent de mani\u00e8re disproportionn\u00e9e les minorit\u00e9s religieuses en cr\u00e9ant des obstacles \u00e0 leur d\u00e9veloppement. <a href=\"https:\/\/ccla.org\/fr\/principaux-cas-et-rapports\/projet-de-loi-21\/\">la participation \u00e0 l'emploi public<\/a>\u00a0(notamment le projet de loi 21 du Qu\u00e9bec) ; l'incapacit\u00e9 \u00e0 traiter de mani\u00e8re ad\u00e9quate les probl\u00e8mes de sant\u00e9 publique en cours. <a href=\"https:\/\/ccla.org\/fr\/communique-de-presse\/ccla-intervening-in-r-v-cope-to-address-overrepresentation-of-indigenous-people-in-prisons\/\">surrepr\u00e9sentation<\/a> des autochtones et des Noirs dans notre syst\u00e8me de justice p\u00e9nale ; la n\u00e9cessit\u00e9 pour le Canada de reconsid\u00e9rer sa d\u00e9signation des \u00c9tats-Unis comme pays tiers \"s\u00fbr\" pour le retour des r\u00e9fugi\u00e9s, \u00e0 la lumi\u00e8re du risque que cela repr\u00e9sente pour ceux qui transitent par les \u00c9tats-Unis pour se rendre au Canada ; la n\u00e9cessit\u00e9 d'un cadre l\u00e9gislatif et r\u00e9glementaire pour le retour des r\u00e9fugi\u00e9s ; la n\u00e9cessit\u00e9 d'un cadre l\u00e9gislatif et r\u00e9glementaire pour le retour des r\u00e9fugi\u00e9s. <a href=\"https:\/\/ccla.org\/fr\/intimite\/government-cybersecurity-proposal-threatens-privacy-and-security\/\">propositions<\/a> d'adopter <a href=\"https:\/\/ccla.org\/fr\/intimite\/ccla-joins-calls-for-withdrawal-of-bill-c-2\/\">des pouvoirs de surveillance \u00e9tendus<\/a>\u00a0(y compris le projet de loi C-2, r\u00e9cemment r\u00e9introduit en tant que <a href=\"https:\/\/www.theglobeandmail.com\/politics\/article-lawful-access-bill-could-create-vulnerabilities-for-hackers-experts\/\">Projet de loi C-22<\/a>) et bien d'autres choses encore.<\/p>\n<p>Dans l'ensemble, le paysage des droits de l'homme au Canada n'offre pas un bon pronostic.<\/p>\n<p>Les observations finales du Comit\u00e9 devraient \u00eatre un signal d'alarme pour tous les niveaux de gouvernement au Canada.
