\nL'ACLC demande au gouvernement de l'Alberta de faire respecter l'\u00c9tat de droit, de respecter les droits constitutionnels de tous les Albertains et de retirer imm\u00e9diatement sa proposition de loi invoquant la clause d\u00e9rogatoire.<\/strong>\n<\/p><\/blockquote>\n

TORONTO<\/strong> \u2013 <\/strong>L'Association canadienne des libert\u00e9s civiles (ACLC) condamne fermement l'introduction par le gouvernement de l'Alberta d'une l\u00e9gislation invoquant la clause d\u00e9rogatoire pour prot\u00e9ger trois lois qui menacent directement les droits des personnes transgenres et de la diversit\u00e9 de genre dans la province.<\/p>\n

Cette action marque une escalade profond\u00e9ment troublante dans l'utilisation abusive par le gouvernement de la clause d\u00e9rogatoire - un outil constitutionnel qui n'a jamais \u00e9t\u00e9 destin\u00e9 \u00e0 isoler les gouvernements de la responsabilit\u00e9 ou \u00e0 refuser aux Albertains vuln\u00e9rables l'acc\u00e8s \u00e0 la justice.<\/p>\n

Il est particuli\u00e8rement honteux que le gouvernement ait pris cette mesure \u00e0 la veille de la journ\u00e9e du souvenir des transgenres, une journ\u00e9e destin\u00e9e \u00e0 rendre hommage aux personnes transgenres qui ont perdu la vie \u00e0 cause de la violence et de la discrimination.<\/p>\n

\"Chacun m\u00e9rite que ses droits constitutionnels soient prot\u00e9g\u00e9s contre les atteintes du gouvernement et qu'il ait la possibilit\u00e9 de d\u00e9fendre ces droits devant les tribunaux\", a d\u00e9clar\u00e9 le pr\u00e9sident de la Commission europ\u00e9enne. \"La clause d\u00e9rogatoire n'a jamais \u00e9t\u00e9 con\u00e7ue comme un outil politique de routine ou un moyen pour les gouvernements d'\u00e9viter l'examen de la constitution\", a ajout\u00e9 le pr\u00e9sident de la Commission europ\u00e9enne. En invoquant la clause d\u00e9rogatoire, le gouvernement de l'Alberta tente de soustraire ses actions \u00e0 l'examen judiciaire, privant ainsi les Albertains transgenres et de genre diversifi\u00e9 de leur capacit\u00e9 \u00e0 d\u00e9fendre leurs droits constitutionnels devant les tribunaux.<\/p>\n

\"Ces lois menacent la s\u00e9curit\u00e9, la dignit\u00e9 et le bien-\u00eatre des personnes transgenres et de la diversit\u00e9 de genre, en particulier les jeunes, qui sont d\u00e9j\u00e0 confront\u00e9s \u00e0 des obstacles importants en mati\u00e8re de soins de sant\u00e9, d'\u00e9ducation, d'emploi et de vie communautaire\", a d\u00e9clar\u00e9 le commissaire europ\u00e9en \u00e0 l'\u00e9galit\u00e9 des chances pour les femmes et les hommes. Aaden Pearson<\/strong>avocat salari\u00e9 et charg\u00e9 de cours sur les droits des personnes transgenres \u00e0 l'ACLC. \"Il est honteux que le gouvernement de l'Alberta utilise son pouvoir pour outrepasser les droits des jeunes transgenres et de la diversit\u00e9 de genre, qui n'ont pas le pouvoir politique de demander des comptes au gouvernement.<\/p>\n

Le respect des libert\u00e9s civiles et des droits de l'homme est la pierre angulaire de la d\u00e9mocratie canadienne. Les Albertains comptent sur les protections garanties par la Loi sur les droits de la personne de l'Alberta<\/em> et le\u00a0Charte canadienne des droits et libert\u00e9s<\/em><\/strong>. La suspension de ces droits, en particulier pour les groupes vuln\u00e9rables, met gravement en danger les libert\u00e9s de tous les Canadiens.<\/p>\n\t<\/div>\n<\/div>\n\n\n\n\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t
