Les citoyens canadiens ont besoin que leurs repr\u00e9sentants restent libres et sans entraves dans leur capacit\u00e9 \u00e0 demander des comptes \u00e0 l'ex\u00e9cutif. \u00c0 cette fin, la libert\u00e9 d'expression et de d\u00e9bat au Parlement est le droit le plus important accord\u00e9 aux parlementaires. L'immunit\u00e9 totale de poursuites pour les discours parlementaires permet aux parlementaires ind\u00e9pendants et \u00e0 ceux des partis minoritaires d'agir sans crainte et sans interf\u00e9rence pour contr\u00f4ler efficacement le pouvoir ex\u00e9cutif.<\/p>\n

La Alford contre Canada<\/em> Cette affaire soul\u00e8ve des questions techniques sur le privil\u00e8ge parlementaire et le r\u00e9gime de s\u00e9curit\u00e9 nationale du Canada. Dans des circonstances normales, les d\u00e9clarations faites par des parlementaires \u00e0 la Chambre des communes ou au S\u00e9nat ne feraient pas l'objet de poursuites car elles sont prot\u00e9g\u00e9es par le privil\u00e8ge parlementaire. L'article 12 de la loi canadienne sur le Comit\u00e9 des parlementaires pour la s\u00e9curit\u00e9 nationale et le renseignement (loi NSICOP) supprime ce privil\u00e8ge dans certaines circonstances. Ryan Alford, professeur de droit \u00e0 la facult\u00e9 de droit de l'universit\u00e9 Lakehead, conteste cette loi. Il soutient que l'article 12 supprime ind\u00fbment le privil\u00e8ge parlementaire des membres du NSICOP et que cela ne peut se faire qu'au moyen d'un amendement constitutionnel.<\/p>\n

La question est de savoir si le pouvoir du Parlement de \"d\u00e9finir\" le privil\u00e8ge parlementaire en vertu de l'article 18 de la loi constitutionnelle de 1867 permet une l\u00e9gislation qui expose l'exercice du privil\u00e8ge parlementaire \u00e0 un contr\u00f4le judiciaire, exposant ainsi les minorit\u00e9s parlementaires \u00e0 une pression ext\u00e9rieure qui pourrait r\u00e9duire au silence leurs voix au Parlement. L'ACLC intervient pour souligner le besoin urgent de sauvegarder l'objectif et la fonction du privil\u00e8ge parlementaire et de prot\u00e9ger la capacit\u00e9 des minorit\u00e9s parlementaires \u00e0 s'acquitter de leur devoir constitutionnel de demander des comptes au pouvoir ex\u00e9cutif. Nos repr\u00e9sentants \u00e9lus au sein d'un comit\u00e9 charg\u00e9 de superviser nos agences de s\u00e9curit\u00e9 nationale devraient avoir la possibilit\u00e9 de \"tirer la sonnette d'alarme\" au Parlement s'ils constatent des probl\u00e8mes flagrants ou des ill\u00e9galit\u00e9s.<\/p>\n
