Wilson<\/em>2025 SCC 32. Cette affaire concernait l'interpr\u00e9tation de l'article 4.1(2) de la loi sur l'immigration et la protection des r\u00e9fugi\u00e9s (LIPR). <em>Loi r\u00e9glementant certaines drogues et autres substances<\/em>qui se lit comme suit :<\/p>\n<p><strong>(2)<\/strong>\u00a0Aucune personne qui demande une assistance m\u00e9dicale d'urgence ou l'aide des forces de l'ordre parce qu'elle ou une autre personne souffre d'une urgence m\u00e9dicale ne peut \u00eatre accus\u00e9e ou condamn\u00e9e pour une infraction vis\u00e9e au paragraphe 4(1) si les preuves \u00e0 l'appui de cette infraction ont \u00e9t\u00e9 obtenues ou d\u00e9couvertes parce que cette personne a demand\u00e9 de l'aide ou est rest\u00e9e sur les lieux de l'incident.<\/p>\n<p>Cette disposition visait \u00e0 garantir qu'une personne ne serait pas dissuad\u00e9e de demander des soins m\u00e9dicaux d'urgence (par exemple, en cas d'overdose) parce qu'elle pourrait \u00eatre p\u00e9nalement responsable du d\u00e9lit de simple possession d'une substance r\u00e9glement\u00e9e. La question en l'esp\u00e8ce \u00e9tait de savoir si, correctement interpr\u00e9t\u00e9e, la disposition permettait \u00e0 la police d'arr\u00eater une personne pour simple possession, malgr\u00e9 le fait qu'elle ne puisse \u00eatre inculp\u00e9e ou condamn\u00e9e.<\/p>\n<p>Dans une d\u00e9cision de 6 \u00e0 3, la Cour supr\u00eame a estim\u00e9 que l'interpr\u00e9tation correcte de l'article 4.1(2) signifie que la police ne peut pas arr\u00eater quelqu'un pour un d\u00e9lit pour lequel il b\u00e9n\u00e9ficie d'une immunit\u00e9 de poursuites p\u00e9nales. La majorit\u00e9 a d\u00e9clar\u00e9 que \"l'immunit\u00e9 d'inculpation et de condamnation pour simple possession explicitement mentionn\u00e9e \u00e0 l'article 4.1(2) de la loi sur les stup\u00e9fiants et les substances psychotropes ne peut \u00eatre invoqu\u00e9e pour arr\u00eater une personne pour un d\u00e9lit.\u00a0<em>CDSA\u00a0<\/em>inclut, par implication n\u00e9cessaire, l'immunit\u00e9 d'arrestation pour cette infraction.
