\"La d\u00e9cision du gouvernement de l'Alberta d'invoquer la clause d\u00e9rogatoire pour ordonner le retour au travail des enseignants marque un moment profond\u00e9ment troublant pour notre d\u00e9mocratie\", a d\u00e9clar\u00e9 Howard Sapers, directeur g\u00e9n\u00e9ral de l'Association canadienne des libert\u00e9s civiles. \"Si l'Alberta peut utiliser la clause d\u00e9rogatoire sans cons\u00e9quence, elle n'h\u00e9sitera pas \u00e0 le faire \u00e0 nouveau - et d'autres gouvernements feront de m\u00eame.<\/p>\n

La nouvelle l\u00e9gislation est une attaque flagrante contre les droits des travailleurs qui interdit aux enseignants de faire gr\u00e8ve ou de mener des actions syndicales pendant la dur\u00e9e de la convention collective impos\u00e9e. Elle suspend \u00e9galement les n\u00e9gociations locales officielles entre les conseils scolaires et les syndicats et interdit le lock-out des enseignants pendant la dur\u00e9e de la convention. Les enseignants qui continuent \u00e0 faire gr\u00e8ve s'exposent \u00e0 des amendes pouvant aller jusqu'\u00e0 5 000 euros par jour, tandis que les syndicats s'exposent \u00e0 des amendes pouvant aller jusqu'\u00e0 500 000 euros par jour.<\/p>\n

Le fait d'invoquer la clause d\u00e9rogatoire extraordinaire pour annuler une gr\u00e8ve l\u00e9gale et imposer un contrat est une attaque directe contre le droit \u00e0 la libert\u00e9 d'association prot\u00e9g\u00e9 par la Charte\", a d\u00e9clar\u00e9 Ana\u00efs Bussi\u00e8res McNicoll, directrice du programme \"Libert\u00e9s fondamentales\" de l'ACLC.<\/p>\n

\"Nous avons d\u00e9j\u00e0 vu cela auparavant\", a ajout\u00e9 M. McNicoll. \"En 2022, l'Ontario a tent\u00e9 la m\u00eame approche avec le projet de loi 28, essayant de forcer les travailleurs de l'\u00e9ducation \u00e0 retourner au travail. Cette tentative a \u00e9chou\u00e9 - le gouvernement de l'Ontario a finalement \u00e9t\u00e9 contraint de faire marche arri\u00e8re apr\u00e8s une r\u00e9sistance \u00e9crasante de la part des syndicats et du public. L'Alberta devrait tirer les le\u00e7ons de cette exp\u00e9rience : les libert\u00e9s et les droits fondamentaux ne peuvent pas \u00eatre simplement supprim\u00e9s par la loi.<\/p>\n
