Si cette l\u00e9gislation ne re\u00e7oit pas l'attention et les amendements n\u00e9cessaires au cours de la proc\u00e9dure d'examen en commission, elle pourrait porter atteinte de mani\u00e8re permanente au droit \u00e0 la vie priv\u00e9e au Canada.<\/p>\n<p>Depuis l'introduction du projet de loi C-26 en 2022, l'absence de garanties en mati\u00e8re de protection de la vie priv\u00e9e, le recours massif au secret et le risque de compromettre la cybers\u00e9curit\u00e9 ont fait l'objet de nombreuses critiques. <a href=\"https:\/\/drive.google.com\/file\/d\/12KiMUx3zj-i5kUn5G37GfeUWesvILzkW\/view\">une vive controverse<\/a> et les critiques d'un ch\u0153ur de t\u00e9moins qui se sont exprim\u00e9s sur la n\u00e9cessit\u00e9 de modifier la l\u00e9gislation, y compris les commissaires \u00e0 la protection de la vie priv\u00e9e et au renseignement du Canada. Le projet de loi C-8 <a href=\"https:\/\/sencanada.ca\/Content\/Sen\/Committee\/441\/SECD\/briefs\/C-26_Brief_JointCivilSociety_e.pdf\">reproduit un grand nombre de ces d\u00e9fauts critiques<\/a>.<\/p>\n<p>Experts et soci\u00e9t\u00e9 civile <a href=\"https:\/\/drive.google.com\/file\/d\/1E8Gx5aAjHibL7zMwucJwKlXz4Wrub-da\/view?usp=drive_link\">ont mis en garde<\/a> que la l\u00e9gislation conf\u00e9rerait des pouvoirs minist\u00e9riels qui pourraient \u00eatre utilis\u00e9s pour compromettre d\u00e9lib\u00e9r\u00e9ment ou par inadvertance la s\u00e9curit\u00e9 des normes de cryptage au sein des r\u00e9seaux de t\u00e9l\u00e9communications dont d\u00e9pendent chaque jour les citoyens, les gouvernements et les entreprises du Canada.<\/p>\n<p>Le commissaire au renseignement du Canada <a href=\"https:\/\/www.canada.ca\/en\/intelligence-commissioner\/remarkstothestandingsenatecommitteeonnationalsecuritydefenceandveteransaffairs.html#:~:text=In%20Bill%20C,expectation%20of%20privacy.\">averti<\/a> dans son t\u00e9moignage que, s'il \u00e9tait adopt\u00e9, le projet de loi autoriserait la saisie sans mandat d'informations priv\u00e9es sensibles. <a href=\"https:\/\/sencanada.ca\/en\/Content\/Sen\/Committee\/441\/SECD\/65EV-57046-E#:~:text=Senator%20LaBoucane%2DBenson%3A%20My%20question%20is%20for,this%20information.%20In%20this%20case%2C%20it%E2%80%99s%20totally%20absent.\">peuvent \u00eatre justifi\u00e9es d'un point de vue constitutionnel<\/a>. Son t\u00e9moignage a \u00e9galement soulign\u00e9 que \"[l]e grand absent de ce projet de loi est le public canadien. Les informations collect\u00e9es sont les informations personnelles des Canadiens\", concluant que :<\/p>\n<blockquote><p>\n\"Compte tenu du caract\u00e8re invasif du projet de loi, il est important qu'il soit assorti de garanties significatives afin que les Canadiens aient confiance dans le syst\u00e8me de cybers\u00e9curit\u00e9\".\n<\/p><\/blockquote>\n<p>Le Commissaire \u00e0 la protection de la vie priv\u00e9e du Canada <a href=\"https:\/\/www.ourcommons.ca\/documentviewer\/en\/44-1\/SECU\/meeting-94\/evidence#:~:text=Yes%2C%20I%20think,achieve%20the%20goal.%E2%80%9D\">soulign\u00e9 <\/a>que la l\u00e9gislation pourrait, par exemple, entra\u00eener la collecte et le partage inappropri\u00e9s d'informations sur les comptes d'abonn\u00e9s, de donn\u00e9es de communication, de visites de sites web, de m\u00e9tadonn\u00e9es, de donn\u00e9es de localisation et de donn\u00e9es financi\u00e8res.<\/p>\n<p>Malgr\u00e9 l'\u00e9tendue extraordinaire des pouvoirs conf\u00e9r\u00e9s par le projet de loi C-8, m\u00eame les garanties minimales pr\u00e9vues par le projet de loi ne sont pas suffisantes. <a href=\"https:\/\/sencanada.ca\/en\/Content\/Sen\/Committee\/441\/SECD\/64EV-57023-E#:~:text=I%E2%80%99ll%20start%20with%20what,is%20a%20theme%20here.\">ne sont pas applicables<\/a> \u00e0 ses nouveaux et vastes pouvoirs en mati\u00e8re de collecte d'informations.<\/p>\n<p>En r\u00e9introduisant le projet de loi sans y apporter de modifications essentielles, le gouvernement f\u00e9d\u00e9ral double \u00e9galement les pouvoirs de briser le chiffrement qui ont \u00e9t\u00e9 fortement critiqu\u00e9s dans la version pr\u00e9c\u00e9dente. La soci\u00e9t\u00e9 civile et les experts demandent maintenant aux d\u00e9put\u00e9s d'amender le projet de loi C-8 afin d'interdire au gouvernement d'\u00e9mettre des ordonnances qui pourraient compromettre la s\u00e9curit\u00e9 des installations et des services de t\u00e9l\u00e9communications. Cet appel fait suite \u00e0 une s\u00e9rie de mises en garde d'experts en cybers\u00e9curit\u00e9 au Canada et aux \u00c9tats-Unis sur les risques que l'absence de solution \u00e0 ce probl\u00e8me ferait peser sur l'\u00e9conomie canadienne et sur le droit fondamental \u00e0 la vie priv\u00e9e des citoyens du pays :<\/p>\n<ul>\n<li>\u00c9crire pour <a href=\"https:\/\/www.theglobeandmail.com\/opinion\/article-ottawa-wants-the-power-to-create-secret-backdoors-in-our-networks-to\/\">The Globe &amp; Mail<\/a>Le projet de Citizen Lab, qui a pour but d'am\u00e9liorer la qualit\u00e9 de vie des citoyens, a \u00e9t\u00e9 mis en place. <strong>Kate Robertson<\/strong> et <strong>Ron Deibert<\/strong> avertissent que les \"pouvoirs secrets et destructeurs de cryptage\" du projet de loi C-8 \"menacent la s\u00e9curit\u00e9 en ligne de tous les Canadiens\" et que le projet de loi \"habilite les fonctionnaires \u00e0 ordonner secr\u00e8tement aux entreprises de t\u00e9l\u00e9communications d'installer des portes d\u00e9rob\u00e9es \u00e0 l'int\u00e9rieur des \u00e9l\u00e9ments crypt\u00e9s des r\u00e9seaux du Canada\".<\/li>\n<li>Dans son <a href=\"https:\/\/www.ourcommons.ca\/DocumentViewer\/en\/44-1\/SECU\/meeting-94\/evidence#T1730\">t\u00e9moignage<\/a> sur le projet de loi C-26, <strong>Eric Smith<\/strong>vice-pr\u00e9sident principal de l'Association canadienne des t\u00e9l\u00e9communications, a fait r\u00e9f\u00e9rence aux pouvoirs d'ordonnance \"tr\u00e8s \u00e9tendus\" de la l\u00e9gislation, d\u00e9clarant que \"cela pourrait vous obliger non pas n\u00e9cessairement \u00e0 retirer des \u00e9quipements de votre infrastructure, mais \u00e0 mettre certains \u00e9quipements dans votre infrastructure, ou \u00e0 vous conformer \u00e0 certaines normes. Il pourrait s'agir d'affaiblir le cryptage ou de vous obliger \u00e0 intercepter des communications\".<\/li>\n<li>Citant les \u00c9tats-Unis comme un exemple d'ing\u00e9rence gouvernementale que le Canada devrait \u00e9viter, la <strong>Fondation de la fronti\u00e8re \u00e9lectronique<\/strong> <a href=\"https:\/\/www.eff.org\/deeplinks\/2024\/06\/security-surveillance-and-government-overreach-united-states-set-path-canada\">d\u00e9clar\u00e9e<\/a> que \"l'exp\u00e9rience des \u00c9tats-Unis constitue une mise en garde contre ce qui peut se produire lorsqu'un gouvernement s'octroie des pouvoirs \u00e9tendus pour surveiller et diriger les r\u00e9seaux de t\u00e9l\u00e9communications, en l'absence de protections correspondantes pour les droits de l'homme\", et a averti que \"sans garanties ad\u00e9quates, [le projet de loi C-8] pourrait ouvrir la porte \u00e0 des pratiques et \u00e0 des ordonnances similaires\".<\/li>\n<\/ul>\n<p>Le gouvernement f\u00e9d\u00e9ral a r\u00e9cemment r\u00e9affirm\u00e9 qu'il ne cherchait pas \u00e0 compromettre le chiffrement au Canada, mais jusqu'\u00e0 pr\u00e9sent, il n'a m\u00eame pas voulu le reconna\u00eetre, <a href=\"https:\/\/sencanada.ca\/Content\/Sen\/Committee\/441\/SECD\/briefs\/C-26_Brief_JointCivilSociety_e.pdf\">et encore moins de modifier<\/a> les pouvoirs permettant de briser le cryptage qui sont aujourd'hui \u00e0 nouveau mis en avant dans le projet de loi C-8. Le projet de loi C-8 permettrait au gouvernement f\u00e9d\u00e9ral d'ordonner secr\u00e8tement aux fournisseurs de t\u00e9l\u00e9communications <em>\"faire quelque chose ou s'abstenir de faire quelque chose\".<\/em>La Commission a \u00e9galement d\u00e9cid\u00e9 d'adopter des ordonnances d'urgence, sans aucune limite qui emp\u00eacherait ces ordonnances d'\u00eatre utilis\u00e9es pour imposer des obligations de surveillance aux entreprises priv\u00e9es et pour affaiblir les normes de cryptage - ce que le public rejette depuis longtemps comme \u00e9tant incompatible avec nos droits en mati\u00e8re de vie priv\u00e9e.<\/p>\n<p>Une s\u00e9rie de correctifs judicieux aux probl\u00e8mes du projet de loi C-26, h\u00e9rit\u00e9s du projet de loi C-8, n'ont pas \u00e9t\u00e9 pris en consid\u00e9ration de mani\u00e8re significative lorsque le projet de loi a \u00e9t\u00e9 adopt\u00e9 \u00e0 la h\u00e2te par le S\u00e9nat \u00e0 la veille de la prorogation du Parlement. Pourtant, les Canadiens m\u00e9ritent un projet de loi qui ne porte pas atteinte \u00e0 leur vie priv\u00e9e ou \u00e0 la cybers\u00e9curit\u00e9 qu'il est cens\u00e9 r\u00e9gler.<\/p>\n<p>Depuis le d\u00e9p\u00f4t du projet de loi C-8, pr\u00e8s de <a href=\"https:\/\/action.openmedia.org\/page\/177914\/action\/1\">3 000 membres de la communaut\u00e9 OpenMedia<\/a> ont \u00e9crit \u00e0 leurs d\u00e9put\u00e9s pour demander que les probl\u00e8mes de confidentialit\u00e9 du projet de loi C-8 soient r\u00e9solus.<\/p>\n<h3>Citations<\/h3>\n<p>\"En ne garantissant pas que les protocoles essentiels de chiffrement de bout en bout ne seront pas compromis, le projet de loi C-8 risque de faire plus de mal que de bien \u00e0 la cybers\u00e9curit\u00e9. L'inclusion continue de m\u00e9canismes d'acc\u00e8s aux donn\u00e9es sans mandat et l'utilisation d'une approche de secret par d\u00e9faut constituent une menace suppl\u00e9mentaire pour la vie priv\u00e9e et d'autres libert\u00e9s civiles. Le projet de loi C-8 pourrait introduire des portes d\u00e9rob\u00e9es dans pratiquement tous les aspects de notre vie, en ligne et hors ligne, en emp\u00eachant les r\u00e9seaux de t\u00e9l\u00e9communications d'utiliser les normes et technologies Internet les plus r\u00e9centes, telles que le cryptage.
