If this legislation fails to receive necessary consideration and amendments during the committee review process, it could permanently damage privacy rights in Canada.<\/p>\n<p>Since the introduction of Bill C-26 in 2022, this legislative proposal\u2019s lack of privacy safeguards, its heavy reliance on secrecy, and its potential to undermine cybersecurity have been the subject of <a href=\"https:\/\/drive.google.com\/file\/d\/1wphm9xt5diWm3M6IaBVJD08_RBIu2Nk3\/view?usp=sharing\">fierce controversy<\/a> and criticism from a chorus of witnesses testifying about the need to amend the legislation including from the Privacy and Intelligence Commissioners of Canada. Bill C-8 <a href=\"https:\/\/sencanada.ca\/Content\/Sen\/Committee\/441\/SECD\/briefs\/C-26_Brief_JointCivilSociety_e.pdf\">replicates many of these critical flaws<\/a>.<\/p>\n<p>Experts and civil society <a href=\"https:\/\/drive.google.com\/file\/d\/1E8Gx5aAjHibL7zMwucJwKlXz4Wrub-da\/view?usp=drive_link\">have warned<\/a> that the legislation would confer ministerial powers that could be used to deliberately or inadvertently compromise the security of encryption standards within telecommunications networks that people, governments, and businesses across Canada rely upon, each and every day.<\/p>\n<p>The Intelligence Commissioner of Canada <a href=\"https:\/\/www.canada.ca\/en\/intelligence-commissioner\/remarkstothestandingsenatecommitteeonnationalsecuritydefenceandveteransaffairs.html#:~:text=In%20Bill%20C,expectation%20of%20privacy.\">warned<\/a> in testimony that, if passed, the bill would authorize warrantless seizure of sensitive private information, and questioned whether this approach <a href=\"https:\/\/sencanada.ca\/en\/Content\/Sen\/Committee\/441\/SECD\/65EV-57046-E#:~:text=Senator%20LaBoucane%2DBenson%3A%20My%20question%20is%20for,this%20information.%20In%20this%20case%2C%20it%E2%80%99s%20totally%20absent.\">can be constitutionally justified<\/a>. His testimony further highlighted that \u201c[t]he glaring absentee in this bill is the Canadian public. The information that is collected is Canadians\u2019 personal information\u201d, concluding that:<\/p>\n<blockquote><p>\n\u201cIn light of the invasive nature of the Bill, it is important that meaningful safeguards be part of it so that Canadians have confidence in the cybersecurity system.\u201d\n<\/p><\/blockquote>\n<p>The Privacy Commissioner of Canada <a href=\"https:\/\/www.ourcommons.ca\/documentviewer\/en\/44-1\/SECU\/meeting-94\/evidence#:~:text=Yes%2C%20I%20think,achieve%20the%20goal.%E2%80%9D\">emphasized <\/a>that the legislation could, for example, result in the inappropriate collection and sharing of subscriber account information, communication data, website visits, metadata, location data and financial data.<\/p>\n<p>Despite the extraordinary scope of the powers in Bill C-8, even the bill\u2019s minimal safeguards <a href=\"https:\/\/sencanada.ca\/en\/Content\/Sen\/Committee\/441\/SECD\/64EV-57023-E#:~:text=I%E2%80%99ll%20start%20with%20what,is%20a%20theme%20here.\">are not applicable<\/a> to its vast new information collection powers.<\/p>\n<p>In re-introducing the bill without critical changes, the federal government is also doubling-down on encryption-breaking powers that were heavily criticized in the previous version. Civil Society and experts are now urging MPs to amend Bill C-8 to prohibit the government from issuing orders that could compromise the security of telecommunications facilities and services. Their call follows a series of warnings from cybersecurity experts in Canada and the US about the risks that a failure to address this matter would pose to Canada\u2019s economy, and to the fundamental right to privacy of people across Canada:<\/p>\n<ul>\n<li>Writing for <a href=\"https:\/\/www.theglobeandmail.com\/opinion\/article-ottawa-wants-the-power-to-create-secret-backdoors-in-our-networks-to\/\">The Globe &amp; Mail<\/a>, Citizen Lab\u2019s <strong>Kate Robertson<\/strong> and <strong>Ron Deibert<\/strong> warn that the \u201csecretive, encryption-breaking powers\u201d in Bill C-8 \u201cthreaten the online security of everyone in Canada,\u201d and that the bill \u201cempowers government officials to secretly order telecommunications companies to install backdoors inside encrypted elements in Canada\u2019s networks.\u201d<\/li>\n<li>In his <a href=\"https:\/\/www.ourcommons.ca\/DocumentViewer\/en\/44-1\/SECU\/meeting-94\/evidence#T1730\">testimony<\/a> on Bill C-26, <strong>Eric Smith<\/strong>, Senior Vice-President at the Canadian Telecommunications Association, referenced the \u201cvery broad\u201d order-making powers in the legislation, stating that \u201cIt could be requiring you not necessarily to take out equipment from your infrastructure, but to put certain equipment into your infrastructure, or to comply with certain standards. It could be weakening encryption, or it could be requiring you to intercept communications.&#8221;<\/li>\n<li>Citing the US as an example of government overreach that Canada should avoid, the <strong>Electronic Frontier Foundation<\/strong> <a href=\"https:\/\/www.eff.org\/deeplinks\/2024\/06\/security-surveillance-and-government-overreach-united-states-set-path-canada\">stated<\/a> that &#8220;the U.S. experience offers a cautionary tale of what can happen when a government grants itself broad powers to monitor and direct telecommunications networks, absent corresponding protections for human rights,\u201d and warned that &#8220;without adequate safeguards, [Bill C-8] could open the door to similar practices and orders.&#8221;<\/li>\n<\/ul>\n<p>While the federal government has recently reaffirmed that it does not seek to compromise encryption in Canada, to date, the government has been loath to even acknowledge, <a href=\"https:\/\/sencanada.ca\/Content\/Sen\/Committee\/441\/SECD\/briefs\/C-26_Brief_JointCivilSociety_e.pdf\">let alone amend<\/a> the encryption-breaking powers that are now being pushed forward again in Bill C-8. Bill C-8 would empower the federal government to secretly order telecom providers <em>\u201cto do anything or refrain from doing anything\u201d<\/em>, with no limits that would prevent such orders from being used to impose surveillance obligations on private companies, and to weaken encryption standards \u2014 something the public has long rejected as inconsistent with our privacy rights.<\/p>\n<p>A series of sensible fixes to Bill C-26\u2019s problems, inherited by Bill C-8, did not receive meaningful consideration as the bill was rushed through the Senate on the eve of Parliament\u2019s prorogation. Yet Canadians deserve a bill that does not undermine their privacy or the very cybersecurity it is intended to address.<\/p>\n<p>Since Bill C-8 was tabled, nearly <a href=\"https:\/\/action.openmedia.org\/page\/177914\/action\/1\">3,000 members of OpenMedia\u2019s community<\/a> have written to their MPs to call for Bill C-8\u2019s privacy problems to be fixed.<\/p>\n<h3>Quotes<\/h3>\n<p>\u201cBy failing to guarantee critical end-to-end encryption protocols will not be undermined, Bill C-8 risks doing more harm than good to cybersecurity. Its ongoing inclusion of warrantless data access mechanisms and use of a secrecy by default approach pose an additional threat to privacy and other civil liberties. We urge the government and parliamentarians to adopt important fixes to address these flaws.\u201d<\/p>\n<p><strong>Tamir Israel<\/strong>, Director, Privacy, Surveillance &amp; Technology Program, Canadian Civil Liberties Association (<a href=\"https:\/\/ccla.org\">CCLA<\/a>)<\/p>\n<p>\u201cThere is no such thing as a private intercepted message, and no backdoor that exists only for law enforcement. Our government knows it, yet their draft cybersecurity legislation Bill C-8 can be abused to surveil Canadians in secret, well beyond its legitimate purpose. We\u2019re asking our government to fix key problems that were overlooked during Bill C-26\u2019s deliberations, and pass legislation that protects Canadian cybersecurity and our privacy.<\/p>\n<p><strong>Matt Hatfield<\/strong>, Executive Director at <a href=\"http:\/\/openmedia.ca\/\">OpenMedia<\/a><\/p>\n<p>\u201cThe Salt Typhoon cyber espionage campaign that exploited a mandated backdoor in US telecommunications companies is a dangerous wake up call that Canada can&#8217;t afford to ignore. Locking your front doors won&#8217;t stop the wrong people from coming in a backdoor you are legally required to keep open for law enforcement. C-8 could implant backdoors into virtually every aspect of our lives on and offline by preventing telecommunications networks from using the latest Internet standards and technologies like encryption.
