L'ACLC a comparu aujourd'hui devant la Cour supr\u00eame dans l'affaire\u00a0R. c. Carignan<\/em>. L'ACLC a fait valoir qu'en vertu de la\u00a0Charte des droits et libert\u00e9s<\/em>En vertu de l'article 495, paragraphe 2, de la loi, un accus\u00e9 devrait pouvoir contester la l\u00e9galit\u00e9 d'une arrestation sans mandat qui n'\u00e9tait pas n\u00e9cessaire pour confirmer son identit\u00e9, obtenir des preuves, emp\u00eacher une autre infraction ou garantir la pr\u00e9sence au tribunal, qui sont des conditions pr\u00e9alables en vertu de l'article 495, paragraphe 2, de la loi sur l'immigration et la protection des r\u00e9fugi\u00e9s (LIPR).\u00a0Code criminel\u00a0<\/em>de proc\u00e9der \u00e0 une arrestation sans mandat pour de nombreuses infractions p\u00e9nales.<\/p>\n
