La Charte canadienne des droits et libert\u00e9s<\/em> vient de f\u00eater ses 43rd<\/sup> anniversaire. A cette occasion, Ana\u00efs Bussi\u00e8res McNicoll (directrice du programme des libert\u00e9s fondamentales de l'ACLC) et Jin Huh (directeur ex\u00e9cutif de Social Planning Toronto) ont co-\u00e9crit un article d'opinion sonnant l'alarme sur le projet de Toronto d'interdire les manifestations offensantes ou perturbatrices - mais pacifiques - \u00e0 proximit\u00e9 de divers types d'espaces de rassemblement communautaires.<\/p>\n

\"Nous reconnaissons que les discours dissidents sont souvent controvers\u00e9s et peuvent \u00eatre per\u00e7us par beaucoup comme offensants ou m\u00eame douloureux. Pourtant, les gouvernements ne doivent pas r\u00e9pondre \u00e0 ces pr\u00e9occupations par une censure d'\u00c9tat. Comme cela a \u00e9t\u00e9 clairement \u00e9tabli en 2017 par le Cour d'appel de l'Ontario<\/a>: \"Dans une soci\u00e9t\u00e9 libre et d\u00e9mocratique, les citoyens ne doivent pas \u00eatre menott\u00e9s et \u00e9loign\u00e9s de l'espace public traditionnellement utilis\u00e9 pour l'expression de la dissidence en raison de la g\u00eane que leur protestation provoque.\" \"<\/p>\n
