Gavrila v. Minister of Justice (Supreme Court of Canada)

This case concerned immigration law and section 7 of the Charter addressed whether refugees may be surrendered for extradition to their home country where it has been found that they would be subject to persecution.   The Supreme Court agreed that the risk of persecution had to be taken into account in the exercise of ministerial discretion.
