CCLA opposes limits on credit for pre-sentence custody

On May 8, 2009 the Canadian Civil Liberties Association wrote to Canada’s Minister of Justice to urge the government to abandon Bill C-25, the Truth in Sentencing Act. The legislation, which limits judicial discretion to grant extra credit for pre-sentence custody, restricts judges’ power to address certain inequities in the administration of justice, such as the harsher conditions common in many of Canada’s remand centres. In CCLA’s view, the Bill risks exposing some offenders to disproportionate sentences.
